A. This application must be filled in by typewriter OR ink and submitted to the bnilding
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contairs
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
~ and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
~ 6. Submit Planning Board Approval of completed site plan requirements.

Dear Mr. Fisher:
This is further to our conversation of this afternoon in which
I asked that a Building Permit be granted to the applicants
named above on the basis of the Town Trustees' finding of non-
jurisdiction, confirming that the project is located at least
75' from the most landward edge of any tidal wetlands, and the
merits of the project itself.
As I told you, I have recently been in contact with Robert
Greene, the DEC Regional Permit Administrator, on a project
analogous to this one, located in Riverhead Town. On the basis
of the DEC regulations, portions of which are cited below, Mr.
Greene has indicated that the DEC has found that indeed no
permit is required and their letter confirming this is in the
mail to me.
Please note that the regulations do not anyplace state that
they need be confirmed by the DEC for each case. They clearly
state that no permit is required in the present case, and
nowhere do they state that local agencies, such as your own,
must have written confirmation of this from the DEC. The
regulations stand on their own and speak for themselves ....
Section 661.5(b)(26) states that for "Substantial restora-
tion, reconstruction, modification or expansion of existing
functional residential structures which are and which will
continue to be located 75 feet or more from the most land-
ward edge of any tidal wetland" in an Adjacent Area (AA),
no permit is required (NPN).

Section 661.5(b)(50) states that for "Construction of
accessory structures or facilities for existing residential
structures where such accessory structures or facilities
are and will continue to be in full compliance with the
development restrictions of this Part" in an Adjacent Area
(AA), no permit is required (NPN).
Section 661.6(a)(1) states: "The minimum setback of all
principal buildings and other structures that are in excess
of 100 square feet (other than boardwalks ......... etc.)
shall be seventy-five feet landward of the most landward
edge of any tidal wetland." (More follows, but is not
applicable to the current project. This is the only
requirement under development restrictions which is
significant in this case.)
Section 661~5(a)(1) states: "Any type of use designated in
this section as a use not requiring a permit for the type
of area involved is not subject to the permit requirements
of this Part."
Section 661.7, Uses Not Requiring a Permit, states in (a):
"Any use, where otherwise legally permitted, listed in
Section 661.5 of the Part as a use not requiring a permit
(NPN) for a particular tidal wetland zone or for an adja-
cent area may be undertaken in such tidal wetland zone or
adjacent area without a permit under this Part, provided
such activity does not involve a regulated activity."
Section 661.4, Definitions, states in (ee)(2), in part:
"...Regulated activity shall not include any activity list-
ed in Section 661.5 of this Part as a use not requiring a
permit (NPN) for the applicable area."
My experience indicates that local building departments state
that they have been told by representatives of the DEC that
all projects (I don't know if any limit has been specified),
regardless of whether the project meets the published NPN or
non-jurisdiction criteria, must be submitted to the DEC for
review. The local building departments therefore pass this
requirement along to property owners or their agents. The un-
fortunate and unnecessary result is that the DEC is burdened
with the review of many projects which are clearly beyond the
scope intended by the regulations. Obviously this results in
some sort of added costs to all taxpayers in the State, and in
unnecessary delays and expense for individual property owners.

I recently wrote to Mr. Greene citing many of these same
references and in closing stated: "I'm sure I have not mis-
understood the intent of the writers of the regulations, and I
would appreciate your help in resolving these discrepancies
within the DEC, and then providing some mechanism for passing
the information, as appropriate, along to local building
departments. Doing this requires some faith in the basic
honesty of the people living on the land that we are all
trying to protect. My experience has been that people are
willing to comply with reasonable regulations, and the Tidal
Wetlands Land Use Regulations, as written, seem reasonable to
me."
In the meantime, we are faced with a situation in which the
property owners and the Building Department have this
unresolved matter facing them. I ask once again, therefore,
that the Building Department issue a permit for the
construction of the playhouse on the Mitarotondo property on
the basis of the findings of the Town Trustees and the
published regulations of the DEC.
