ARTICLE FOURTH TRUST UIL/W LINDA GAYLE KAPLAN FIB/O ZELEK MICAH
KAPLAN,with a mailing address of 17815 Soundview Avenue, Southold,New York 11971,party
of the second part.
WITNESSETH, that the party of the first part, to whom letters testamentary were issued
by the Surrogate's Court, Suffolk County,New York on January 21, 2022 (File No. 2021-5100/A)
and by virtue of the power and authority given in and by said Last Will and Testament, and/or by
Article I 1 of the Estates, Powers and Trusts Law, and in consideration of Ten ($10) Dollars, paid
by the party of the second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Southold, in the Town of Southold, County of Suffolk and State
of New York, bounded and described as follows:
BEGINNING at a point marked by a monument on the northerly line of Sound View
Avenue at the southeasterly corner of the premises herein described and the southwesterly corner
of land now or formerly of Bartosiewicz, formerly of Bollhorst;
THENCE in a southwesterly direction along the northerly line of Sound View Avenue
South 73 degrees 27 minutes 30 seconds West a distance of 100.0 feet to a point marked by a
monument and land now or formerly of Elias Kulukundis, formerly of Sideratos;
THENCE north 1 I degrees 10 minutes 30 seconds West a distance of 218.00 feet;
THENCE along land of Manolakis north 73 degrees 29 minutes 50 seconds East a distance
of 100.69 feet to said land now or formerly of Bartosiewicz;
THENCE south 10 degrees 59 minutes 30 seconds east a distance of 218.00 feet to the
point or place of BEGINNING.
Which premises are commonly known as 17815 Soundview Avenue, Southold,New York
11971.
BEING the same premises conveyed to Zelek Micah Kaplan and Gayle Crane Kaplan,
Husband and Wife by deed dated July 16, 1976,recorded July 27, 1976 in the Office of the Suffolk
County Clerk, Liber 8075, Page 382.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in
and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvements before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
