EASEMENT APPURTENANT AGREEMENT

THIS INDENTURE made this! day of December 2022 by and between
WENDY A. GRIFFITHS, with an address at 7475 Peconic Bay Boulevard,
Laurel, New York, 11948 ( hereinafter referred to as ("Grantor"), and JOAN
QUINN-ROACHE, indivdually and as Executrix of the Estate of JOHN B.
ROACHE III, a/k/a JOHN BENEDICT ROACHE III a/k/a J. BENEDICT
ROACHE III with an address at 2930 Bray Avenue, Laurel, New York, 11948
{ hereinafter referred as "Grantee"),
WHEREAS, Grantor owns certain improved lands situate at 7475
Peconic Bay Blvd, Laurel, New York, 11948, Suffolk County Tax Map No District
1000 Section 126.00 Block 10.00 Lot 011.000, more fully described in the
legal description annexed hereto as Exhibit "A", and made a part hereof
( "Grantor's Property"); and
WHEREAS, Grantee owns certain partially improved lands situate at 2930
Bray Avenue, Laurel, New York, 11948, Suffolk County Tax Map No. District
1000 Section 126.00 Block 10.00 Lot 010.000, more fully described in the legal
description annexed hereto as Exhibit "B", and made a part hereof ( "Grantee's
Property); and
WHEREAS there exists on Grantor's property certain improvements that
benefit the property of the Grantee including but not limited to paving stones, a
fence, part of a pool, trees and landscaping (the "Improvements").

WHEREAS, Grantee is desirous of a Exclusive Perpetual Easement
Appurtenant over a 1,149.5 square foot portion of the property of the
Grantor depicted as Easement Area "A" on the survey of Grantor's and
Grantee's properties prepared by Kenneth M. Woychuk Land Surveying
PLLC, on September 19th, 2022, a copy of which is annexed hereto as
Exhibit "C", to allow the Improvements benefiting the property of Grantee
to remain in perpetuity. The metes and bounds of this Easement Area "A"
are more fully described in Exhibit "D" annexed hereto; and
WHEREAS, Grantor, for good and valuable consideration, is
desirous of granting a Exclusive Perpetual Easement Appurtenant to
Grantee over the Easement Area so that Grantee can have exclusive
undisturbed access to and use of the improvements on Grantor's property
that lie within the Easement Area.

WITNESSETH
1. Grantor does hereby grant, transfer, bargain and convey unto Grantee, in
perpetuity, a Exclusive Perpetual Easement Appurtenant on over and
under the Easement Area "A" on the property of the Grantor depicted on
Exhibit "C" annexed hereto and more fully described in Exhibit "D"
annexed hereto.
2. The nature, character and extent of the Exclusive Perpetual Easement
Appurtenant hereby granted is as follows:
A. Grantee shall have the Exclusive right to use, traverse, access,
improve and maintain said easement area comprised of 1,149.5
square feet along the northeastern side of the property of the
Grantor and Grantor, her heirs, successors and assigns hereby
forever waives any right to use, traverse access, improve or
maintain the Easement Area without the permission of the
Grantee.
B. The location of the Easement Area "A" described in Exhibit "D" shall
not be changed without the written consent of both parties and
their respective representatives.
C. Any and all costs associated with the use of the Easement Area
shall be borne solely by the Grantee. Grantee, in conjunction with
the use of the easement by the Grantee, agrees to provide the
Grantor proof of liability insurance provided for by the Grantee,
naming the Grantor, her heirs, successors and assigns as the case
may be, as an additional insured thereon as the interest of the
Grantor may appear. Grantee, her successors and/or assigns,
shall notify Grantor by certified mail return receipt requested, of
any change in ownership in order to facilitate changes in the
coverage and/or endorsement.
D. Grantee agrees to forever indemnify, save and hold the Grantor
harmless from any and all claims for property damage and/or
personal injury arising out of the use and enjoyment of said
Easement area "A" by Grantor, her heirs successors and assigns,
invitees and trespassers to the extent not covered by insurance.
3. This Exclusive Easement Appurtenant Agreement shall
inure to the benefit of, and bind the parties, their heirs,
successors, legal representatives and/or assigns, and shall
run with the land in perpetuity.
