Kim Fuentes, Coordinator, Julie McGivney,Assistant Town Attorney and Ben Johnson,Assistant Town Attorney WORK SESSION: 3:00 PM RESOLUTION ADOPTED: The Commission discussed de minimus applications, that do not rise to the level of requiring public hearings, and the issuance of Certificate of Appropriateness. A motion was made to adopt the following resolution by Commissioner Ostroski, seconded by a Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) (Commissioner Cubie absent) RESOLVED, The Historic Preservation Commission hereby adopts this rule, pursuant to Chapter 170(4)(E)(2), to declare proposals, that are de minumus and not rising to the level of public hearing, may be issued a Certificate of Appropriateness. Pre submission Conferences: (30 Minutes allotted to each presentation) 3:05 P.M. -Tony and Jane Asch —for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to install a generator on premises having a single family dwelling, located at 290 Skippers Lane, Orient, NY. SCTM No. 1000-25-1-1. • Jane Asch, owner, appeared before the commission to describe her project. • To create proper shielding of the generator, it was agreed by both the Commission and the applicant to install both fencing and shrubbery. • The Commission agreed that the matter was deminimus and did not need to proceed to a public hearing. RESOLUTION ADOPTED: A Motion was made, pursuant to Chapter 170 of the Town Code, under the powers of the Commission,we have the authority to issue a Certificate of Appropriateness for matters that do not rise to the level of requiring a public hearing when deemed appropriate and impose conditions of approval as written in the Certificate of Appropriateness, by Commissioner Ostroski and seconded by Page 2, Minutes of Meeting of the Historic Preservation Commission June 22, 2023 Commissioner Woodhouse. AYES: Commissioners Ostroski, Surchin, Wexler, Cubie, Woodhouse and de Conciliis (6-0). (Commission Cubie absent) RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness to permit the installation generator shielded by a fence and vegetative shrubbery on the subject residential property, by Commissioner Ostroski and seconded by Commissioner Woodhouse. AYES: Commissioners Ostroski, Surchin, Wexler, Cubie, Woodhouse and de Conciliis (6-0). (Commission Cubie absent) 3:14 P.M. - I.V.N.N. LLC c/o Snowdon-Jones -for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to construct additions and alterations to a single family dwelling, located at 585 Orchard, Orient, NY. SCTM No. 1000-25-2-14.1. • David Snowdon-Jones, Architect, and Nick Mazzaferro, Engineer, appeared before the Commission on behalf of their client to explain the project and presented photographs. • Materials list including Windows were discussed. Whether windows are Anderson Series A, E, or Green Mountain, a materials listing should be placed on the building plans/elevations. • The Commission requested additional renderings of property view from Orchard Street. • The Commission agreed to move this matter to a public hearing. RESOLUTION ADOPTED: A Motion was made to set a public hearing for July 27, 2023 by Commissioner Wexler and seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, Woodhouse and de Conciliis (6-0). 3:25 P.M. -Geoffrey Schwartz, Brooke Ellis—for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to replace a roof in kind of a single family dwelling, located at 22715 Main Road, Orient, NY. SCTM No. 1000-18-2-21. • Louis Benitez, appeared before the commission on behalf of his client. • The improvements include replacing in-kind shingles described as Carriage House-Black Pearl, and installment of in-kind white aluminum gutters and leaders. The Commission agreed that the matter was de minimus and did not need to proceed to a public hearing. RESOLUTION ADOPTED: A Motion was made, pursuant to Chapter 170 of the Town Code, under the powers of the Commission, we have the authority to issue a Certificate of Appropriateness for matters that do not rise to the level of requiring a public hearing when deemed appropriate and impose conditions of approval as written in the Certificate of Appropriateness, by Commissioner de Conciliis and seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, Woodhouse and de Consiliis (6-0). RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness to permit the replacement of in-kind shingles described as Carriage House-Black Pearl, and permit the installment of in-kind aluminum gutters and leaders, by Commissioner Wexler, seconded by Commissioner Woodhouse. AYES: Commissioners Surchin, Wexler, Santana, Cubie, de Conciliis, and Woodhouse. (6-0) Revision 7/5/2023 Page 3, Minutes of Meeting of the Historic Preservation Commission June 22, 2023 3:42 P.M. -JOTAS Corp., Joan Turturro -for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to install a wood fence and repair foundation on premises having a commercial building, located at 1000 Village Lane, Orient, NY. SCTM No. 1000-25-1-18. • Joan Chambers, representative and Joan Turturro, owner, appeared before the commission to describe the condition of the foundation and presented photographs. • Photographs were included in the,application depicting the "as built" 6 feet high wooden fencing. • The Commission requested the applicant-revise the building plans to include "new parging on CMU Block foundation above Grade at 8 Inches". • The Commission agreed the matter did not require public hearing for proposed foundation repairs and the "as-built"wood fence. RESOLUTION ADOPTED: A Motion was made, pursuant to Chapter 170 of the Town Code, under the powers of the Commission,we have the authority to issue a Certificate" of Appropriateness for matters that do not rise to the level of requiring a public hearing when deemed appropriate and impose conditions of approval as written in the Certificate of Appropriateness, by Commissioner Ostroski and seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, Woodhouse and de Conciliis (6-0). FOUNDATION RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness to permit the repair of the foundation upon premises having a commercial building, by Commissioner Ostroski and seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, Woodhouse and de Conciliis (6-0). FENCE RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness to legalize the "as-built" 6 feet high wooden fence upon premises having a commercial building, by Commissioner Woodhouse and seconded by Commissioner de Conciliis. AYES: Commissioners Ostroski, Surchin,Wexler, Santana, Woodhouse and de Conciliis (6-0). 4:18 P.M. - Kathleen Becker, Trustee—to Amend a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to construct alterations and additions to a single family dwelling located at 154 King Street, Orient, NY. SCTM No. 1000-26-2-3. • Barbara Cohen, representative appeared before the commission on behalf of her client to describe the subject property, historic'district, historic boundary, and, surrounding properties in order to dispute the jurisdiction of this Commission. • Both the Chairperson and the Assistant7own Attorney responded by outlining the Commission's Jurisdiction as determine by the Town Board and the Town Board's recognition of the Town's historic landmarks with an adopted Town Register of Historic Landmarks. Revision 7/5/2023 Page 4, Minutes of Meeting of the Historic Preservation Commission June 22, 2023 • Several pages of the building plan were distributed showing the prior approval of July 28, 2022, and the current revision submitted to the Building Department showing the demolition of the garage and changes to the facade/windows. • The Chairperson remarked that demolition of any portion of the project was never discussed during prior meetings. • It was agreed that the Northern and Eastern elevation/facade of the structure is of interest to the Commission. • The Commission requested a full set of plans to include existing conditions plans and demolition plans. • The revised plans will be submitted prior to the July 27, 2023 Pre-submission Conference. Regular Meeting Called to Order: 5:20 pm Pledge of Allegiance: Approval of Minutes: Motion to approve June 22, 2023 Meeting Minutes by Commissioner Mariella, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, Woodhouse and de Conciliis (6-0). Motion approved. PUBLIC HEARINGS (2): 5:20 P.M. -Sean and Catharine Norris—for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to construct a deck addition with stairway attached to an existing single family dwelling, located at 30325 Route 25, Cutchogue, NY. SCTM No. 1000-102-2-18. • Sean Norris, appeared before the Commission to explain the project and presented photographs. • The concreted patio will be lifted and the only visible area from the right of way will be the stairs on the west side. • Materials will consist of a MMI pre-hung exterior door, and a balcony, an expanded deck, a second floor deck, and exterior stairs made of ACQ Treated Lumber. • The Commission agreed to Close the Public Hearing. RESOLUTION ADOPTED: A motion was made to Close ,the Public Hearing, by Commissioner Ostroski, seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness to approve the construction of a deck addition with a stairway attached an existing single family, by Commissioner Ostroski, seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) 5: 25 P.M. - Orient Realty, LLC —for a Certificate of Appropriateness under Section 170-7(b) of the Southold Town Code at a registered landmark property to legalize an as-built hot tub on premises having a single family dwelling located at 675 Skippers Lane, Orient, NY. SCTM No. 1000-24-2-1. Revision 7/5/2023 Page 5, Minutes of Meeting of the Historic Preservation Commission June 22, 2023 • Peter Marren appeared before the Commission to explain the project and presented photographs. • Members of the Commission agreed that the spacing between the mahogany fence slats should be 1-1/2 inch. • Barbara Friedman, in attendance, spoke in opposition of the required spacing. • The Commission agreed to Close the Public Hearing. • Three separate motions were made to approve a Certificate of Appropriateness; 1) Balcony, Terrace (photo A.1), 2) Wooden Fence Shielding Mechanics, 3) Hot Tub and Outdoor Shower. RESOLUTION ADOPTED: A motion was made to Close the Public Hearing, by Commissioner Ostroski, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) BALCONY/TERRACE RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness for the balcony-terrace, by Commissioner Ostroski, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) MAHOGANY FENCE RESOLUTION, ADOPTED: A motion was made to approve a Certificate of Appropriateness for the mahogany fence shielding mechanics, slats spaced at 1-1/2 Inch, by Commissioner Ostroski, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Santana and de Conciliis. NAYS: Wexler, Woodhouse. (4-2) AS BUILT HOT TUB,AS BUILT OUTDOOR SHOWER RESOLUTION ADOPTED: A motion was made to approve a Certificate of Appropriateness for the "as-built" hot tub and "as-built" outdoor shower, by Commissioner Ostroski, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) Old Business: 1. Landmark Incentive— No activity. 2. Potential Awards or Request Historical Status, include individuals, non-profit organizations, etc. No Activity 3. HPC Handbook. Revision is currently in process. 4. Shiloh Baptist Church — Landmark will be included in the National Register and the Commission will research funding for the Church. New Business: 1. John & Margaret Smyth -Application for Listing on the Southold Town Register of Designated Landmarks. —A site visit was scheduled for June 2, 2023. The Assistant Town Attorney will draft Revision 7/5/2023 Page 6, Minutes of Meeting of the Historic Preservation Commission June 22, 2023 a resolution for the Town Board to accept the structure as a Town Registered Historic Landmark. RESOLUTION ADOPTED: A motion was made to accept the Barn situated on the property of John & Margaret Smyth, 29330 NYS Route 25, Cutchogue, NY, SCTM No. 1000-102-6- 23.1 as a Designated landmark by Commissioner Woodhouse,seconded by Commissioner Wexler. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) 2. Laura Flavin — By Email, June 2, 2023, the applicant requested a change in her application in order to correct the location of the swimming pool. The commission agreed to Rescind the Certificate of Appropriateness granted on May 25, 2023, Res. No. 5.25.23.2. The Commission Coordinator requested a new application. RESOLUTION ADOPTED: A motion was made to Rescind Certificate of Appropriateness, Laura Flavin, No. 5.25.23.2, dated May 25, 2023, by Commissioner Ostroski, seconded by Commissioner Surchin. AYES: Commissioners Ostroski, Surchin, Wexler, Santana, de Conciliis, and Woodhouse. (6-0) 3. Cutchogue New Suffolk Library—The Commission reviewed the report and photos submitted by Rosemary Winters and expressed their approval of the completed project. Meeting Adjourned: 6:03 P.M. RESOLUTION ADOPTED: Motion to exit the public meeting and enter into Executive Session was made by Chairperson Ostroski seconded by Commissioner Surchin.
