Mrs. Leary has obtained the above referenced Building Permit which was issued in violation of Southold Town Code, and which if completed will produce an undesirable change in the character of Fleet's Neck, and create a detriment to nearby properties including but not limited to destruction of my client's property value. Repeated efforts to resolve this situation with the Southold Building Department have met with no avail. I write to you now to respectfully request your assistance, and also to put you on express notice that my clients intend to take whatever legal action is necessary to defend their property rights. Specific violations found in Building Permit #21730, which was both applied for and issued on 10/22/93, are: 1. Failure to state on the survey uses of the subject land. As Mr. Fisher acknowledged to me, he is aware of the existence of Right of Ways which are not indicated by the application. While the Town is not an enforcer of private rights, the Town must consider the existence of private property in order to apply public land use control laws. .,A. Applications. A substandard setback for a proposed new garage (please refer to my letter of November 22, 1993 to Mr. Fisher). Mr. Fisher proposed a clever "interpretation" of the Zoning Law by which he suggests that there is no difference between a sloped "flag lot" like the subject one and a flat "cookie \0 cutter lot". The accessway alleged to be the "Front Yard" cfp is nothing more than a common unpaved driveway and is Da 7 proposed to be paved over. Calling this area a "Front Yard" is definitely inconsistent with both the intent and the letter of the Code. "YARD - An open space . . . which is, exclusive of trees, shrubs and natural rock formations, unoccupied and unobstructed from the ground upward. "SETBACK - An area extending the full width of the lot " Southold Town Code §1DO-13 3. Failure to comply with the required application for a permit from the Suffolk County Department of Health Services for sewage disposal system. The survey presented indicates a substandard side yard setback (less than 5 feet) and a likely problem with seepage of sewage into Cutchogue Harbor \,,cv(the proposed system is virtually on the beach). "No building permit shall be issued for any building until approval has been received from the Suffolk County Department of Health Services for the proposed water supply and sewage disposal system." Southold Town Code §100-281 4. Insufficient evidence of NYS DEC waiver in the building permit application file. A reference by waiver number alone a is easily subject to potential for permit rigging if the t information provided to the DEC was inconsistent with the facts as presented in the building permit application. 5. The proposed plan is for almost complete consumption of the subject parcel of land. The front yard especially is proposed to be almost completely covered by pavement. The above referenced permit is null and void and of no effect, without the necessity for any proceedings, revocations or nullification thereof . . Southold Town Code §100-281 "No building permit shall be issued unless the proposed construction or use is in full conformity with all the provisions of this chapter and the provisions of all other applicable laws, ordinances, rules and regulations." Southold Town Code § 100-281 Despite the facts that; the aforementioned permit has been brought to the attention of Mr. Fisher - by letter from Lawrence Kissling dated November 12, 1993 and follow-up telephone conferences, and a conference in person with yours truly on Monday, November 16, 1993, and follow-up letter from yours truly dated November 22, 1993; And that Mr. Fisher agreed to review the permit and contact yours truly with his findings, no response has been received from Mr. Fisher. It is believed that construction is scheduled to start presently. Therefore, you are hereby put on notice that, unless you take IMMEDIATE ACTION to correct the illegal action complained of herein, both Mr. Fisher, personally, and the Town of Southold, will be charged with liability for any diminutions in property values suffered as a result of the gross negligence and willful contempt of law manifest by the illegal issuance of the above referenced permit and refusal to correct same, and if you choose to disregard this notice, with any court costs and attorney's fees necessarily incurred to correct this problem. For 13 years prior to that I was a summer resident old Cutchogue. j I occupy these premises under lease; terms of which I pay i the Southold Town taxes and have a right of way to the beach on the westerly side of the Leary property. This right of way has been upheld in court. The proposed positioning of the aaragein the Leary build- ing plan would block both air and view of,'Peconic bay, and thereby greatly reduce the value and enjoyment of my res- idence. The building permit application indicates that the DEC and Town Trustees do not have, or have waived jurisdiction, but I can find no mention of SCDHS. Please call me about the above. This letter is to serve as a reminder that you then agreed to review the aforementioned permit for apparent lack of compliance with the required front yard setback. I await your response. The applicant's survey shows a substandard setback for a new garage (18 feet, 35 feet less than the minimum provided for accessory buildings by Southold Town Zoning Law, note the parallel 1150 FOOT FRONT YARD SETBACK" as indicated on the same survey in relation to the principal building envelope). As applied to the applicant's property, the minimum front yard set-back requirement serves the public interest and should not be deviated from. In the proposed location a building would constitute a substantial detriment to nearby property and produce an undesirable change in the character of the neighborhood. The location proposed for the garage may be optimal to maximize the use of applicant's lot, but the enjoyment and value of the adjacent lot would be severely diminished. A variance would not serve the welfare of the neighborhood. The ability exists to situate the proposed garage to conform to legal standards. Please call or write soon to inform me of your decision. Mrs. Leary has obtained the above referenced Building Permit which was issued in violation of Southold Town Code, and which if completed will produce an undesirable change in the character of Fleet's Neck, and create a detriment to nearby properties including but not limited to destruction of my client's property value. Repeated efforts to resolve this situation with the Southold Building Department have met with no avail. I write to you now to respectfully request your assistance, and also to put you on express notice that my clients intend to take whatever legal action is necessary to defend their property rights. Specific violations found in Building Permit #21730, which was both applied for and issued on 10/22/93, are: 1. Failure to state on the survey uses of the subject land. As Mr. Fisher acknowledged to me, he is aware of the existence of Right of Ways which are not indicated by the application. While the Town is not an enforcer of private rights, the Town must consider the existence of private property in order to apply public land use control laws. "A. Applications. Every application for a building permit shall contain the following information . . . The existing and intended use of all buildings, existing or proposed, the use of land . . . A substandard setback for a proposed new garage (please refer to my letter of November 22, 1993 to Mr'. Fisher). Mr. Fisher proposed a clever "interpretation" of the Zoning Law by which he suggests that there is no difference between a sloped "flag lot" like the subject one and a flat "cookie a u>' cutter lot". The accessway alleged to be the "Front Yard" is nothing more than a common unpaved driveway and is proposed to be paved over. Calling this area a "Front Yard" J~ is definitely inconsistent with both the intent and the letter of the Code. "YARD - An open space . . . which is, exclusive of trees, shrubs and natural rock formations, unoccupied and unobstructed from the ground upward. "SETBACK - An area extending the full width of the lot " Southold Town Code 5100-13 3. Failure to comply with the required application for a permit from the Suffolk County Department of Health Services for sewage disposal system. The survey presented indicates a substandard side yard setback (less than 5 feet) and a likely problem with seepage of sewage into Cutchogue Harbor F (the proposed system is virtually on the beach). "No building permit shall be issued for any building until approval has been received from the Suffolk County Department of Health Services for the proposed water supply and sewage disposal system." Southold Town Code §100-281 4. Insufficient evidence of NYS DEC waiver in the building permit application file. A reference by waiver number alone is easily subject to potential for permit rigging if the "J information provided to the DEC was inconsistent with the facts as presented in the building permit application. 5. The proposed plan is for almost complete consumption of the subject parcel of land. The front yard especially is proposed to be almost completely covered by pavement. Southold Town Code S 100-281 Despite the facts that; the aforementioned permit has been brought to the attention of Mr. Fisher - by letter from Lawrence Kissling dated Novenber 12, 1993 and follow-up telephone conferences, and a conference in person with yours truly on Monday, November 16, 1993, and follow-up letter from yours truly dated November 22, 1993; And that Mr. Fisher agreed to review the permit and contact yours truly with his findings, no response has been received from Mr. Fisher. It is believed that construction is scheduled to start presently. Therefore, you are hereby put on notice that, unless you take IMMEDIATE ACTION to correct the illegal action complained of herein, both Mr. Fisher, personally, and the Town of Southold, will be charged with liability for any diminutions in property values suffered as a result of the gross negligence and willful contempt of law manifest by the illegal issuance of the above referenced permit and refusal to correct same, and if you choose to disregard this notice, with any court costs and attorney's fees necessarily incurred to correct this problem.
