SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINIISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply
dated April 3, 2023 stating that this application is considered a matter for local determination as there appears to be
no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject property is a42,750 sq.ft.non-conforming lot in an R-80 Zoning
District. The property has a road frontage of 190 feet along Ole Jule Lane, then turns east for 225.00 feet, turning
south in the rear yard for 190 feet, then returning 225 feet back to Ole Jule Lane. The property is improved with an r
existing two-story residence, with a one and one-half story frame garage. There is also an accessory in-ground
swimming pool in the rear yard all as shown on survey prepared by PJM Land Surveying, dated July 26, 2021.
BASIS OF APPLICATION: Request for a Variance from Article I11, Section 280-15; and the Building Inspector's
January 23, 2023 Notice of Disapproval based on an application for a permit to construct a raised patio with gable
roof attached to a single-family dwelling which will place the existing accessory garage in a non-permitted side yard;
at 1) accessory garage located in other than the code permitted rear yard; located at: 305 Ole Jule Lane, Mattituck,
NY. SCTM No. 1000-114-12-14.2.
RELIEF REQUESTED: The applicant requests a variance to relocate an existing garage in a side yard due to an
addition of a raised patio on the rear of the house.
ADDITIONAL INFORMATION: The existing accessory garage currently exists with Zoning Board relief granted
in ZBA# 6177, dated July 24, 2008. There is also a Certificate of Occupancy# 42270, dated August 25, 2021.

FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on August 3, 2023 at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property
and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The proposed covered patio will not be visible from the street,
and the existing accessory garage will remain in the same location so that there will be no visible change with respect
to its location. Photographs showing aerial views of the property and surrounding properties have been submitted
showing existing natural vegetative barrier for adequate screening.
2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue,other than an area variance. Since the garage already legally exists in the current location,
any addition to the rear of the existing house would put the garage in the side yard; therefore, requiring variance
relief.
3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief
from the code. However, the accessory garage already exists with previous variance relief, and this is, in fact, a
technical variance since the proposed addition to the house does not require variance relief as it complies with all
zoning regulations.
4. Town Law $267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of a raised patio addition and an existing accessory garage while preserving and
protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New
York Town Law 267-13,motion was offered by Member Lehnert,seconded by Member Weisman(Chairperson),and
duly carried, to
GRANT the variance as applied for and shown on the Site Plan and Architectural Plans (Sheet T-001.00) drawn by
Paul Christakos, Architect, last revised March 20, 2023.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.

Any deviation from the survey, site plan and/or architectural drawings cited in this decision, or work exceeding
the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department
of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public
hearing before the Zoning Board of Appeals.
Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey
cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted
herein, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property
that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in
this action.
TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town
of Southold any variance granted by the Board of Appeals shall become null and void where a
Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with
the Suffolk County Clerk,within three (3)years from the date such variance was granted. The
Board of Appeals may, upon written request prior to the date of expiration, grant an extension not
to exceed three (3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S
RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME
FRAME DESCRIBED HEREIN. Failure to comply in a timely manner may result in the denial by
the Building Department of a Certificate of Occupancy, nullify the approved variance relief, and
require a new variance application with public hearing before the Board of Appeals

Reasons for Appeal
The applicant proposes to construct a new patio with a gabled roof in the rear yard of the
premises. A variance is required to maintain the existing garage in its current location. The
proposed patio relocates the rear of the house seven feet east thereby placing the garage partially
in a side yard.
An undesirable change will not be produced in the character of the neighborhood if the
requested variance is granted. The accessory garage will remain in its current location so there
will be no visible change with respect to its location. Also, the proposed patio will not be visible
to pedestrians on the street because it is in the rear yard.
The requested relief is not substantial because most of the existing garage will still be
located within the rear yard of the premises. Also, most of the patio lines up with the garage,
only a small portion that is 7' x 19'8"juts into the rear yard.
The variance will not have an adverse effect or impact on the physical or environmental
conditions of the neighborhood. The proposed patio is being placed in the rear yard of the
premises to serve as a shaded area for entertaining and the owner's personal use. There is an
existing pool in the rear yard with no covered cabana or portico to provide cover from the
elements. The rear yard is flat with no other physical attributes to deter the owner from
constructing the patio. Also, no vegetation will be removed to construct the patio in its proposed
location.
The alleged difficulty is not self-created because the location of the garage and house
were established prior to the applicant purchasing the premises. The applicant is, therefore,
limited with respect to the placement of the proposed patio due to placement of existing
structures.
The proposed variance is needed to provide a shaded area in the rear of the premises that
can be used for dining and recreation. As explained, the proposed improvement will have no
impact on the character of the neighborhood because the garage will remain in its existing
location and there will be no visible difference in its location-- it still appears to be wholly
within the rear yard of the premises.

PROPERTY-FACTS/DESCRIPTION- The subject property is a conforming 42,750 square foot
parcel in the R46'District, measuring 199 feet along Old Jule Lane to the west, 225.00 ft. along
the northern boundary, 225 feet along the southern boundary, and 190 feet along the eastern
boundary and improved with a single family dwelling, as shown on the survey by Stanley J.
Isaksen, Jr.L.S. dated December 30, 1999.
BA- S19:'Ok-APPUCATIO : Request for Variances under Section 280-115, based on the Building
Inspector's May 1, 9008 amended Notice of Disapproval, which states that accessory buildings can
have a maximum height of 22 feet and a maximum area of 750 sq. ft. when building on a size
between 40,000 and 59,999 square feet.
FINDINGS.OF FACT
The Zoning Board of Appeals held a public hearing on this application on June 26, 2008 at which
time written and oral evidence were presented. Based upon all testimony, documentation,
personal inspection of the property, and other evidence, the Zoning Board finds the following facts
to be true and relevant:
AREAVARIANORRELIEF RtOUESTED The applicants seek variances to allow a proposed
accessory garage .at 952 square feet, and 22 feet in height, as shown on the December 30, 1999
survey, amended May 15, 2008 by Stanley J. Isaksen, Jr., licensed land surveyor and shown on
the Drawing Map prepared April 21, 2008 by Donald G. Feiler, Architect (also date-stamped May
15, 2008).

REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and
personal inspections, the Board makes the following findings:
1. Town-Law, X267-b(3)(b)(3)(l).
A) Grant of a variance for the square footage of the garage, from 750 square feet to
952 square feet, would have an adverse environmental effect on the character of the
neighborhood, owing to the magnitude of the proposed departure from area norms.
Alternative relief allowing 800 square feet would avoid that effect. The proposed
setback from the street and the size and flatness of the lot, and the existence of
mature landscape screening along the property line, effectively negate any adverse
effect.
B) Grant of a variance for the height of the garage will not have an adverse effect on
the character of the neighborhood. The size and flatness of the lot, and the
existence of mature landscape screening along the property line will prevent an
adverse effect on the neighborhood.
2. Town-Lary U67-b(3)(b)(2).. The applicants indicated that they converted their existing garage
to living space for a family member, and this was the reason for the request of a detached garage.
The applicants also indicated they wanted to create a roof height similar to their home, to allow
more ceiling height in the storage area on the second floor, and to match the roof configuration of
the home. The benefit of a detached garage with moderate storage space on the second floor can
be achieved by constructing a smaller garage. The size of the lot allows the applicant to create
additional storage to build a separate accessory structure.
3. Town Law §261-b(3)(b)(3). The proposed variance for increase in square footage of the garage
is substantial. It would amount to an increase of 33%. A height variance of three (3) feet,
amounting to 12%, is not substantial.
4. Town Law 6267-b(3)(b)(5?. The need for a variance with respect to both the size and height of
the garage has been self-created.
5. Town.Law§267-b(3)0)(4). No evidence has been submitted to suggest that a variance in this
residential community will have an adverse impact on the physical or environmental conditions in
the neighborhood.
6. Town Law 267-b. Grant of the relief requested is the minimum action necessary and
adequate to enable the applicant to enjoy the benefit of an accessory garage on their property,
while preserving and protecting the character of the neighborhood and the health, safety and
welfare of the community.

yard of the premises. A variance is required to maintain the existing garage in its current

RE: INSTRUCTIONS FOR PUBLIC HEARING
Dear Applicant;
Pursuant to the New York State Governor's announcement lifting many COVID-19 restrictions,
the Town will now resume IN-PERSON meetings that are open to the public. For those who wish
to attend the meeting virtually, for health and safety reasons, we will continue via Zoom Webinar,
as well. Therefore,the August 3, 2023 Zoning Board of Appeals Regular Meeting will be held
BOTH in person in the Town Hall Meeting Room at 53095 Main Road, Southold AND via video
conferencing (Zoom Webinar), and a transcript will be provided at a later date. The public will
have an opportunity to see and hear the meeting live, and make comments.
,Below, please see instructions required to prepare for the ZBA public hearing which includes:
;PLEASE READ CAREFULLY.
1. Yellow sign to post on your property a minimum of seven(7) days prior to your hearing, to be
placed not more than 10 feet from the front property line (within your property) bordering the
street. If you border more than one street or roadway, an extra sign is supplied for posting on
both street frontages. Posting should be done no later than July 26, 2023. To avoid
weather damage to your sign please affix it to a sturdy surface such as plywood. If your
sign is damaged please call the office and we will provide you with another one. Prior to
your public hearing, members of the Board of Appeals will-each conduct a personal
inspection of-your property. If a Board member reports that there is no signage visibly
on display as required by law, your scheduled hearing will be adiourned to a later date
to ensure compliance with Chapter 55-1 (B) 1 of the Town Code.

3. Legal Notice of in person meeting,as well as video conferencing. Instructions for participation
will follow, and will be posted on the Town's Website under the meeting date, and the Legal
Notice section of Suffolk Times Newspaper.

and Determination,the originals of which were filed with the Town Clerk regarding the above
variance applications.
Before commencing any construction activities, a building permit is necessary. Please be sure to
submit an application along with a copy of the attached determination to the Building
Department.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three
(3)years from the date such variance was granted. The Board of Appeals may, upon written
request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one
(1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE
COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN.
Failure to comply in a timely manner may result in the denial by the Building Department of a
Certificate of Occupancy, nullify the approved variance relief, and require a new variance
application with public hearing before the Board of Appeals

To Whom It May Concern,
We are proposing a connected, covered patio in the rear yard of this one-family frame dwelling. The patio
cover/roof will extend 7'-0" further back than the front face of the existing garage. The garage is currently
located in the rear yard. This will locate the existing garage partially within a side yard which is contrary to
the zoning ordinance of the Town. Kindly provide a denial letter for us to proceed with filing for a variance.
