APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
Vpre-existing" land uses:
1. Accurate sBrvey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Due to the recent Freedom of Information request filed by
Patricia Parvis, dated October 17, 1997 of Freudenthal &
Elkowitz Consulting Group, Inc., it has been brought to the
attention of the Building Department that the above building
permit does not have a Certificate of Occupancy because it lacks
final Planning Board Approval.
Please advise me as to the status of the final approval so
that Certificate of Occupancy can be issued.

This letter will confirm your telephone conversation of
3uly 2, 1992, with staff member Robert Kassner regarding the
above referenced property.
You had indicated the following changes would be made to
your submission of June 17, 1992:
The northernmost tank will be moved in line with the
other three tanks so that there is sufficient space to
back a truck out of the garage.
Any possible outdoor lighting will be shown on the
plan. The lighting will be shielded to the premises.
Street trees and shrubs will be planted along
the south side of the property facing the railroad
tracks, YoungsAvenue, and between Burts'Reliable
and Agway.
A sketch of any proposed outdoor sign, showing
dimensions and color.

In response to your letter dated April 28, 1993, transmitted herewith for your
review is a letter from Bennett Orlowski, dated November 9, 1992, informing the
undersigned that the Planning Board has waived the site plan review for this
project. A copy of this letter was simultaneously sent to your attention at that
time. Also transmitted again is the Building Permit application and a check for
the application fee $1,275.00 (based on a total new construction area of 5,500
s.f.).
These plans have been approved by the Suffolk County Health Department and a copy
of the approved plans and permit to construct are transmitted herewith.

Reasons Supporting This Determination:
The project involves the replacement of above ground
storage tanks with above ground tanks of the same
capacity conforming to current Health Department
Standards. The use is a permitted use in this Light
Industrial Zone (LI), therefore the project meets
current zoning.
The project has been found to meet the standards of
Article 12 of the Suffolk County Sanitary Code and has
therefore been approved by the suffolk County Depart-
ment of Health Services for construction. A permit for
above ground toxic/hazardous liquid storage tank system
and drum storage facilities has been issued, thus con-
forming to all Department of Health requirements.
There has not been any correspondence received from the
New York State Department of Environmental Conservation
in the allotted time. Therefore, it is assumed that there
are no comments or objections from that agency.

The following resolution was adopted by the Southold Town
Planning board at a meeting held on Monday, October 4, 1993:
WHEREAS, Romanelli Realty, Inc. is the owner of the property
known and designated as Burt's Reliable, Inc. SCTM~
1000-60-1-6 located at 1515 Youngs Ave., Southold; and
WHEREAS, a formal application for the approval of this site plan
was submitted on July 21, 1993; and
WHEREAS, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared .itself lead agency, and issued a Negative Declaration
on September 14, 1993; and
WHEREAS, this site plan was certified by Thomas Fisher, Building
Inspector, on September 29, 1993; and
WHEREAS, all the requirements of the Site Plan Regulations of
the Town of Southold have been met; and now therefore,
