We, the undersigned, being membersof the Town board of the T=wn of South- old, Suffolk county, New York, do hereby severally waive notice of the time, place and purpose of the meeting of the Town Board to be held at in the Town of Southold, New York, on Wednesday, August 16, 1961 'do hereby c6nsen~ that the same be held on said date for the ~ransaction of any business which"~ay properly come before said meeting'. Demarest, A special meeting of the SoutholdT~wn~Board was held at th( Office, southold, N.Y. on wednesday, August 16, 1961, the Board having waived notice of the time, place and purpose-of the The meeting was called to order by the Supervisor, Lester M. at 10:30 P.M. with the following present: Supervisor Demarest-and Grathwohl; Justice Tuthill; Town AttorneyTasker Clerk Richmond; Supt. of Highways Price. Moved by Councilman Demarest;,seconded by Justice Tuthill: WHEREAS, the Southold American Legion, Griswold-Terry-Glover Posti~803 has applied to the Town Clerk of the Town of Southold, for a Bingo LiC~nse~ and WHEREAS, the Town Board has examined the application and after ti~at- ing the matter, duly made findings and determinations as requi~ law, NOW, THEREFORE, BE IT RESOLVED: That the Supervisor be and he hereby is a~thorized and directed to execute on behalf of this Board the findings and determinations required by law, and it is further RESOLVED: That the Town Clerk be and he hereby is directed to issue a Bingo License to the Southold AMerican Legion, Griswold-Terry-Glower Post 9803. Vote of Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwbhl; Justice Tuthill. Moved by Justice Tuthill; seconded by Councilman ~athwohl; RESOLVED: That the next regular monthly meeting of the Town Board will be' held at the office of the Supervisor, Lester M. Albertson, at 16 South Street, Greenport, N.Y. on Tuesday, August 29, ~961, at 3:00 P.M. Vote of-Town Board: Ayes-Supervisor Albertson; Councilmen Demarest and Grathwohl; Justice Tuthill. Moved by Justice Tuthill; seconded by Councilman Demarest: WHEREAS, Guido Ciacia, Greenport, N.Y. by petition verified the 26th day of June, 1961, petitioned the Town Board for a change of zone of certain real property described in said petition from "A" Residential and Agric- ultural District to "B" Business District, and WHEREAS, the said petition was referred to the Planning Board for its official recommendation and ueport, and WHEREAS, the Town Board pursuant to due notice thereof held a hearing thereon on August 8, 1961 at which time all interested persons were given an opportunity to be heard, minutes of which were recorded by Judith Boken, NOW, THEREFORE, BE IT RESOLVED: That the Southold Town Building Zone Ordinance including the Building Zone Maps be amended by changing from "A" Resident&al and Agricultural District to "B" Business District the following described property: ALL that certain tract or parcel of land situated at Greenport, in the Town of Southold, Suffolk County, New York, and more particularly bounded' and described as follows: BEGINNING at a point formed by the intersection of the northerly line of Kerwin Boulevard and the easterly line of the Main (State) Road, running thence N. 30° 24' 20" E. along said easterly l~ne of Main Road 50 feet to land now or formerly of Mann, thence easterly along said land now-or formerly of Mann S. 59° 35' 40" E. 125 feet to a point; thence northerly along said land now or formerly of Mann N. 30° 24' 20" E. 25 feet to a point; thence easterly along said land no~ or formerly of Mann S. 59~ 35' 40" E. 62.50 feet to a point; thence northerly along said land now or formerly of Mann N. 30° 24' 20" E. 75.00 feet to a point; thence easter- ly along said land now or formerly of. BE IT FURTHER RESOLVED: That the Townb Clerk be and he hereby is authorized and directed to cause~notice of said amendment to be posted and published pursuant to law. Moved by Justice Tuthill; seconded by Councilman Grathwohl; WHEREAS, THE Town Board on its own motiOn prOPosed ko amend the Building zone Ordinance of the Town of Southold, Suffolk County, New York, and WHEREAS, the said resolution was referred to the Planning Board for its official reco~m,endation and report, and WHEREAS, the Town Board pursuant to ~ue notice thereof held a'hearing thereon on August 8, 1961, at which time.~all interested persons were given an opportunity to be heard, NO~, THEREFORE, BE IT RESOLVED: That-the Building-Zone Or~dinance of the Town~ of Southold, Suffolk County, New York, be amended as follows: to'wit: 1. By amending Article Iii Section 300 of said ordinance by inserting therein a new paragraph to be paragraph 6B to read as follows: "6B - Cemeteries and the necessary incidental structures when authorized as a special exception by the Board of Appeals as hereinafter provided. and That the Town clerk be and he herebY is authorized and to cause notice of said amendment to be posted, and published pursuant to la~. Smith & S0n,~ Inc. by pe~iti0n verified on the 20th day of April, 1961, petitioned the Town Board for a change of zone of certain real property described in said petition from "A'~ Residential and Agricultural District to "M" Multiple Residence .District, and sa~d petition was referred to the Planning Board f~r its .on and report, and WHEREAS,. the PlanRing Board has filed its official report with ~he Town Board, and WHEREAS, ~t~e Town Board pursuant to due. notice thereof, held a hearing. on said petition on august 8, 1961, at Which time all interested~ persons were given an opportunity to be .heard, NOW,. THEREFORE, ~BE ..IT RESOLVED: That the relief, d.emanded .in Said petition. of Som~ho!~d Development CorP. and George W. smith & Sons, Inc. be same ~is~in all respects denied.
