SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type H category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply
dated August 25,2021 stating that this application is considered a matter for local determination as there appears to
be no significant county-wide or inter-community-impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming, .325-acre, 14,172 square foot
parcel located on a corner lot with two front yards in the R-40 Zoning District. The northerly property line measures
102.06 feet,the easterly property line measures 140.59 feet and is adjacent to Eighth Street,the southerly property
line measures 101.69 feet and is adjacent to Corwin Street and the easterly property line measures 139.00 feet. The
parcel is improved with a one-and-one half story single family framed dwelling with a fenced in in-ground swimming
pool in the rear yard as shown on the survey prepared by Gary Benz,LS and dated June 9,2020.
BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124; and the Building
Inspector's August 6,2021 Notice of Disapproval based on an application for a permit to demolish and reconstruct
a single-family dwelling;at 1)located Iess than the code minimum required front yard setback of 35 feet; located at:
255 Corwin Street, Greenport,NY. SCTM No. 1000-48-1-44.2.
RELIEF REQUESTED: The applicant requests a variance to demolish (as per Town Code definition) and
reconstruct, in place,a single-family dwelling with two front yards. The applicant'proposes a secondary front yard
setback of 19.4 feet on Eighth Street where the Code requires a minimum of 25 feet for a Secondary front yard,
however,pursuant to section 280-104A:
"Established front yard setback. Where property in the vicinity is improved with principal buildings with front
yards of less than that required by the provision ofthis chapter,the front.yard setback shall be the average setback
of the existing buildings within 300 feet of the proposed building on the same side of the street within the same
use district." The average setback on Eighth Street is 24.8 feet.

Since the average front yard setback on Eighth Street is 24.8 feet,the proposed addition will require a variance for
less than the required 24.8 feet. The Site Plan and Architectural Plans (A-1 thru A4) prepared by David A.
DiGiovanni,Architect,updated January 21,2021, show the proposed addition of a full second story, renovations to
the first floor and renovations to the cellar all to stay within the existing footprint.
ADDITIONAL INFORMATION: The existing dwelling was issued a Certificate of Occupancy,No.Z6517 on June
10, 1975,the in-ground swimming pool and fence where issued a Certificate of Occupancy No.Z15862 on June 18,
1987. The subject property is the beneficiary of Zoning Board of Appeals decisions: #1946 dated September 12,
1974 and#7481 dated April 16,2021,both relative to reduced front yard setback.
On April 15,2021,the applicant was granted a variance for a front yard setback to construct additions and alteration
to a single-family dwelling, Appeal No. 7481. Since the structure was demolished, the applicant was forced to
request a de minimus approval from the ZBA,which was denied on August 2,2021. This current application requests
variances for the demolition and reconstruction of a single-family dwelling.
The property located to the south is zoned industrial (LI)with a large industrial building. Other properties in the
direct vicinity of the subject dwelling have lesser front yard setbacks than what the applicant proposes.
No.member of the public or immediate neighbor spoke in favor of or against this application. A letter of support was
received prior to the public hearing.
During the public hearing,the applicant was requested to provide the Board with copy of their Suffolk County Board
of Health approval for a traditional waste-water sanitary system. On the afternoon ofDecember 2,2021,the applicant
provided a copy of the Suffolk County Board of Health approval dated November 6,2021 for a traditional(non-I/A)
sanitary system approved for a 4-bedroom single-family residence valid until November 6,2024.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on December 2,2021 at which time written .
and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property
and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and
relevant and makes the following findings:
1. Town Law&267-b(3 (b) )(1). Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Many of the residences in the nearby neighborhood have less than
the code required front yard setbacks. The property to the south of the subject property zoned for industry improved
with large commercial buildings, furthermore, the subject parcel is the beneficiary of two prior ZBA decisions
granting relief for reduced front yard setbacks.
2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible
for the applicant to pursue, other than an area variance. The current existing home is a one and one-half story
structure. The applicant wishes to make a full second floor that will add 650 square feet to the dwelling. The footprint
of the single-family dwelling will remain the same.
3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 21.7%total
relief from the code. However,this is an existing structure that has an existing Certificate of Occupancy,based upon
two prior Zoning Board of Appeals decisions,and the current,non-conforming front yard setback will be maintained.

4. Town Law 6267=b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law 1267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law 4267-b. Grant of the requested relief is the minimum action.necessary and adequate to enable the
applicant to enjoy the benefit of a fully renovated,two story residence as the result of demolition as defined by Town
Code while preserving and protecting the character of the neighborhood and the health, safety and welfare of the
community,
RESOLUTION OF TIS BOARD:In considering all of the above factors and applying the balancing test under New
York Town Law 267-13,motion was offered by Member Planamento,seconded by Member Weisman(Chairperson)
and duly carried,to
GRANT the variance as applied for,and shown on the Site Plan last revised May 27,2021 and Architectural Plans
last revised January 7,2021 (Sheets A-1 through A-4)prepared by David A.DiGiovanni,Architect.
Any deviation from the survey, site plan and/or architectural,drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require anew application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variances)granted herein as shown on the architectural drawings, site plan and/or survey
cited above,such as alterations, extensions, or demolitions, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,setback
or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other
features as are expressly addressed in this action. In the event that this is an approval subject to conditions, the
approval shall not be deemed effective until such time that the foregoing conditions are met, and failure to comply
therewith will render this approval null and void.
Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the
Board of Appeals shall become null and void where a Certificate of Occupancy has not been
procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three'
(3)years from the date such variance was granted. The Board of Appeals may,upon written
request prior to the date of expiration,grant an extension not to exceed three(3) consecutive one
(1)'year terms.

We are in receipt of your correspondence dated July 19, 2021 requesting a de minimus approval for a
demolition of the above referenced single family dwelling. In your letter you explain the project consists of
constructing a raised roof to obtain full height ceiling above an existing second floor within an existing
footprint,and that the Southold Town Plans Examiner, after reviewing your submissions to the Building
Department, has determined that the project be considered a demolition and new construction.
We reviewed your letter and the Zoning Board of Appeals determinations No. 7481, dated April 15,2021. The
applicant was granted relief for less than the code required front yard setback for additions and alteration to an
existing single family dwelling. Accordingly,we rely on the Building Department's expertise to determine
whether a project is considered a demolition of an existing structure.
Since it is the Building Department's assessment that the subject structure is being demolished,pursuant to
Town Code, we concur, and a notice of disapproval will issue for variances that are required. This decision is
consistent with other determinations we have issued to applicants having similar or identical circumstances.
As a result,your request is not de minimus in nature. Should you wish to pursue the rebuilding of a single
family dwelling,you will need variance relief with a new application and a public hearing.

To whom it may concern,
We hereby respectfully request a De minimis approval for the previously approved
application as noted above. The scope of the project is to construct a raised roof'structure to
obtain full height ceiling above an existing 2'd floor, all within the existing footprint. There is
also a 1 story addition of 189 sf which is in compliance to zoning. The relief sought was to
maintain an existing non-complying front yard, which was granted.(dated 4/20/21)
When the project was filed for permitting(4/26/21), the plan examiner raised the objection
that based on Town code section 280-4,this project would be considered a demolition and
new construction. This is based on the idea the construction value exceeds 50% of existing
market value of the existing construction. We than provided an appraisal of the current
structure($415,000) and, value engineered the project(volume and scope remains, quality of
finished decreased). The cost estimate based on the value engineered plans was$192,800.
415,000 (50%)=207,500 -207,500> 192,800 which make the construction cost less than
50% of the existing building value.
This documentation was submitted to the plan examiner and rejected (copy of email
attached).
It must be noted that the scope of this project never changed from the originally filing of
12/4/20. We received our denial letter on 1/22/21 and filed to maintain the non complying
front yard with the BZA on 2/5/21. We had our public hearing on 4/l/2 1.

The house originally was a 4 bedroom house with.2 full bathrooms. The proposed is still
4 bedrooms with 3 baths,the existing cellar, I't floor, most of the I't floor walls, and the 2d
floor are to remain.
Based on the above and attached we hereby respectfully request approval to maintain the
existing non-conforming front yards, and that this prQject will not be viewed as a demolition
and new construction but as a renovation and addition.

This appraisal is made for the purpose of developing a replacement cost value of
the subject dwelling as of 5/24/2021. The rights will be in fee simple value..
D. Definition of Market Value and Interest Appraised
Market value means the most probable price which a property should bring in a
competitive and open market under all conditions requisite to a fait,sale, the buyer and
.seller each acting prudently and knowledgeably, assuming the price is not affected by
undue stimulus. Implicit in this definitionare the consummation of a sale as.of a.
specified date and the passing of title from seller to buyer under conditions whereby:

F. Use and Scope of the Appraisal
This appraisal will be used by the client for internal and personal business use.
The scope of my appraisal includes:
extensive research of the market;
analysis of all data to arrive at an appropriate value estimate;
collection and confirmation of the indicated date;
reporting of my conclusions in a logical method.
The subject is planning a renovation/expansion and must meet specific Town of
Southold guidelines. The Cost Approach will be the only approach used to indicate the
replacement cost value of the subject building. A replacement cost will be applied to the
subject building from Marshall&Swift,an expert in the field of residential construction
costs in the subject area. The Sales Comparison Approach.or Income Approach will not
be used due to the instructions to complete a depreciable cost approach only to comply
with the Town of Southold.
The subject home at the time of inspection was gutted and ready for extensive
renovations. The pictures shown are from the subject owner and shows the interior
.layout at the time.of purchase in 2020. Renovations were in the process at that time too.

G. Economic Trends
In,the early part of 1987 we witnessed a peak in real estate market activity and
prices. In 1988 through 1990 we saw a down trend in real estate market value mainly due
to an oversupply of listings, lack of motivated.sellers,few buyers and poor economic
conditions.
The end of 1990 and the early part of 1991 had indicated a bottoming out of
prices and a slight increase in market activity. The early part of 1992. to the current time
has continued to indicate more market activity mainly due to more realistic pricing of
sellers and an increase of buyer interest. In 1993,the'East End of Long Island generated
its most sales since 1988. A combination of low bank interestrates and motivated sellers
were the major teasoris. 1994 was.similar.
In 1995, and 1996 in particular,the market activity increased and was rated as
good for low priced homes and home-sites and fair to good for.other price ranges
depending on.the offering prices. Vacant acreage and farms indicated an increase in
number.of sales. Commercial properties had a similar trend based on asking prices. The
overall marketplace was rated as"active market" and the.trend for 1997 was a seller's
market with an increase-in the number of sales,and sellers receiving at or near asking
prices. 1998 continued to.be a very active marketplace. The number of sales increased
and inventory dropped. The residential market was very-strong,the vacant land
marketplace was strong and the commercial marketplace fair but improved. 1999
continued as a very strong buyer's market for residential.property. Commercial.property
was not as strong as the residential market. 2000.through 2006 continued to be a very
strong seller's market for all,types of residential properties. Commercial properties
showed more activity and indicated a fair to good marketplace.
2007 continued to indicate a good marketplace for the area. The.listing base.increased
for residential and commercial properties and there were many qualified buyers. 2009,
like 2008,started off with a high level of inventory, but,prices have decreased. The
interest rates are still attractive and loans are available from many competitive sources
nationally and locally. However,due to the financial crisis beginning in September and
October,2008,borrowing will continue to be more difficult for consumers and
corporations. The financial crisis has resulted in major investment and lending
institutions either going bankrupt or needing bailout assistance from other healthier
corporations and/or the Federal Government. This problem continued to adversely affect
the real estate marketplace through 2009. 2010 through 2012 started slowly,but the
number of sales increased from the years before on the North Fork. 2013 and 2014
indicated a slow increase in the number of sales and dwindling supply of listings. 2015
and 2016 indicated an increase in the number of sales,a reduction in listings and a slow
rise in property values. The same trend continued from 2017 to 2019.

Mortgages are available and interest rates are attractive. The economic trends for
the East End of Long Island are favorable. Interest rates are declining and there is more
buyer interest. Owners willing to negotiate are finding qualified buyers. This trend
continued.until early March,2020. The Corona Virus pandemic began approximately the
third week in March and is still affecting the local real estate marketplace. The
immediateeffect was the de-listing of homes for sale as many sellers did not want their
homes shown risking contracting the virus from unknown potential buyers. It.appears
many New York City dwellers are leaving for,the suburbs and the North Fork.of Long
Island has received many inquiries to purchase here. The Hamptons witnessed more of
an increase in interest and sales than the North Fork. The immediate effect resulted in a
poor marketplace;the number of sales per month was reduced to approximately %2 the
normal totals. The last month and the current marketplace has indicated an increase in
the number of pending sales that indicate the marketplace to.be improving. However,the
number of listings are very low and the lower residential prices are increasing. The
outlook appears to be favorable and this should continue through 2021.

The subject is a 1. 1/2 story, frame cottage,built approximately in 1974. The
exterior is cedar siding with wood windows with aluminum storms and screens, asphalt
shingle roof and aluminum gutters. The dwelling measures 1,440 total square feet on two
floors. The first floor has 960 sq. ft. of finished area and the second floor has 480 sq. ft.
The interior has wood floors and sheetrock walls and ceilings. There are 6 rooms;
4 bedrooms and one bathroom with a tile floor. The first floor has 2 bedrooms,full
bathroom,kitchen with a range,refrigerator, washer—dryer and dishwasher. There is a
full basement 20 ft. x 32 ft.and an adjoining crawl space area 10 ft. x 32 ft. The home is
heated with oil hot water.

Following this procedure assists the appraiser in reaching a sound value
conclusion. During the process the appraiser is guided by his knowledge of real estate
economics and conditions existing in the subject market. All available information
concerning the subject property is considered in relationship to economic principles and
of the three approaches that will provide the most accurate indicator of defined value.
These value indications are reconciled by the appraiser and the final valuation indication
is estimated.
In the case of the subject property and the appraisal instructions,the appraiser has
relied on the Cost Approach.This approach will provide the most accurate indicator for
derivation of a final replacement cost value. The Income Approach.and Sales
Comparison Approaches were not used due to the instructions to provide a replacement

The Cost Approach used replacement cost figures from.Marshall/Swift
Building Cost Manual. The square foot areas were taken from the Town of Southold
property data records. The subject dwelling is to be valued for the replacement cost. The
class type for the dwelling is good Class D—wood'bearing walls with good shingles, dry
walls,wood floors,oil heat. The basement is mostly full with a crawl space. The current
marketplace is rated as excellent due to the high volume,of sales.resulting in'a very low
.listing inventory. The area is also witnessing a large increase in home renovations and
new construction resulting in delays for lumber and supplies. The cost of lumberds
increasing as well. The area is well known for extreme weather conditions—such as a
long hurricane season,normally from August to November and snow/ice storms in the
winter.
