Please be informed that we are withdrawing that application and no longer wish to obtain a rental permit, but we are nevertheless seeking to close out the outstanding building permit,BP 34638. The outstanding items cited in the inspection report you provided with your letter included enclosure of the floating stairs and reduction of the spacing between risers to no more than four inches.We have now completed that work, and would like to obtain a Certificate of Occupancy for the activities performed under that permit. To that end,I am enclosing the following items: ✓1. Check for$125.00, which includes$75.00 to renew the permit and $50.00 for the Certificate of Occupancy. 2. Signed and notarized plumber's solder certificate. V3. Copy of Certificate of Completion from Southold Board of Trustees. 11/4. A photograph of the modifications made to the stairway. We would like to point out that enclosure of the stairs is not an IRC Building.Code requirement for convenience stairs,which is the type of stairway we have constructed. These stairs lead to a mezzanine area that covers only a small portion of the house and thus does not constitute a second story.As such,the stairs are not a means of egress;they are for convenience of access,and as such,the code does not require them to have a guard rail enclosure.However,to expedite closeout of this permit and issuance of a C of O,we have installed a guard rail enclosure to enhance safety. We have also reduced the riser gap to less than four inches, as required by the code. The attached photograph depicts both of these modifications. We trust that the documentation provided herein is sufficient.to close out the outstanding permit and enable issuance of a C of O for the work performed. Given the difficulties imposed by the COVID pandemic, and considering the safety of your inspector as well as ours,I am hoping that the enclosed photograph will eliminate the need for a home inspection. The application has been revised to include the items referenced in your letter dated September 13, 2005, in which you rejected our application dated August 28, 2005, and requested additional information, along with permits from the Southold Board of Trustees. The work consists of the following scope: 1. Enclosure of an existing alcove in the outdoor deck; 2. Construction of a mezzanine area within the above enclosure; 3. Modification to the roof to accommodate the new enclosed area; and 4. Modification of front entry and expansion of decking, using existing supports. The new enclosed area and mezzanine will be used as a dining room, bathroom, and den, respectively. No change to the current footprint of the existing residence will result from the proposed work described above. No new bearing points are proposed. No variances are needed for the proposed work, since: (1) the proposed use is residential; (2) the existing R80-conforming setbacks are unaffected by the proposed work; and (3) the overall height (top of new eave at 21.0 feet above first floor Elev. 12.1) is less than 35 feet above grade. Thus, all applicable zoning code requirements are met. As requested in your September 13 letter, we have obtained both Wetlands and Coastal Erosion Permits from the Town of Southold Trustees. These permits were deemed necessary because the property is seaward of the NYSDEC Coastal Erosion Hazard Line. Town of Southold Building Department December 13,2005 Page 2 of 2 Although your September 13 letter requests us to obtain a Tidal Wetlands Permit from NYSDEC, this permit is actually not required, as your representative subsequently acknowledged during a follow-up telephone conversation to the August 28 submittal. As we discussed, although the premises is located within an Adjacent Area to tidal wetlands in both the front and rear of the house, since the work represents solely "...modification or expansion of existing functional residential structures which are and will continue to be located 75 feet or more from the most landward edge of any tidal wetland...," according to 6 NYCRR Part 661 (Tidal Wetlands Use Regulations), the NYSDEC regards such work as "NPN," or "uses not requiring a permit." (See attached excerpts with circled items). According to NYSDEC representatives, no application or waiver from that agency is required for the proposed work. In addition, Suffolk County Health Department submittal/approval is not required for the proposed scope of work. We are enclosing the following documents for your review: ■ Copy of Southold Board of Trustees' Wetlands and Coastal Erosion Permits. ■ Copy of Site Plan and Survey, depicting the location of the existing structure and lot dimensions, along with topography. Please note that no modifications to the lot have been made since the survey was performed, other than the addition of a swimming pool in 2000, which was permitted by the Town of Southold Building Department and Zoning Board of Appeals, and for which a Certificate of Occupancy has been granted. An original survey is unavailable, since the surveyor is deceased and his office is no longer in existence.
