THIS INDENTURE, made as of thea3 day of March, 2023
BETWEEN Patricia Mudd, residing at 39695 County Road 48, Southold,
New York 11971 and Jahn E. Lademann, residing at 3790 Alvah' s Lane,
Cutchogue, New York 11935, as Co-Executors of the Estate of John M.
Lademann, late of Cutchogue, County of Suffolk, New York, deceased,
who died on the 315t day of October, 2021,
party of the first part, and,
Daniel T. Sweeney and Justine T. Sweeney, as tenants by the entirety,
residing at 40 Jewel Street, Brooklyn, New York 11222,
party of the second part,
WITNESSETH, that whereas letters testamentary were issued to the Co-Executors by
the Surrogate's Court, Suffolk County, New York, on March 22, 2022, File No. 2022-290,
and by virtue of the power and authority given in and by said last will and testament,
and/or by Article 11 of the Estates, Powers and Trusts Law, and in consideration of ONE
MILLION ONE HUNDRED THOUSAND DOLLARS and 00/100 ($1,100,000.00), paid by the party of
the second part, does hereby grant and release unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever, in and
to
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being in the Town of Southold, County of Suffolk,
State of New York, being more particularly bounded and described on Schedule "A" annexed
hereto and made a part hereof.
Being and intended to be the same premises described in a Deed made by Hope Prior Smith
to John M. Lademann and Joan A. Lademann by Deed dated July 17, 1981 and recorded in the
Office of the Clerk of the County of Suffolk on July 27, 1981 in Liber 9091 Page 596.
TOGETHER with all right, title and interest, if any, of the party of the first part in
and to any streets and roads abutting the above described premises to the center lines
thereof; TOGETHER with the appurtenances and also all the estate which the said decedent
had at the time of decedent's death in said premises, and also the estate therein, which
the party of the first part has or has power to convey or dispose of, whether
individually, or by virtue of said will or otherwise; TO HAVE AND TO HOLD the premises
herein granted unto the party of the second part, the distributees or successors and
assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way whatever,
except as aforesaid.
Subject to the trust fund provisions of Section 13 of the Lien Law.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
