Kiernan, ~G((~ Assistant Town Attorney DATE: August 27, 1993 RE: Minor Subdivision of Cranberry Acres, Southold SCTM 1000-89-4-10.2 , q It is my understanding that the Building Department has received an inquiry from a prospective purchaser of the above-referenced lot as to whether a building permit can be issued, assuming that Health Department approvals are obtained. You will recall that this three-lot subdivision was approved at a time which the Planning Board did not require the filing of minor subdivision maps in the County Clerk's office. The subdivider, Mr. Edward R. Deutsch, has been unable to file the maps now due to the fact that the owner of the partially completed building on lot no. 3 is in serious arrears in the payment of property taxes and the map will not be accepted by the County Clerk for filing until all the taxes are paid to date. In light of the Planning Board's policy which was in existence at the time the subdivision was approved, it would appear to me that the Town must issue the building permit assuming the subject lot has received the necessary Health Department approvals.
