WITNESSETH, that the party of the first part to whom letters testamentary were issued by the Surrogate's Court of the

BEGINNING at a point on the southeasterly side of Peconic Bay Boulevard where same is intersected by the northeasterly
line of land now or formerly of Evelyn A. Stewart, said point being located as follows: From the corner formed by the
intersection of the southwesterly side of Bray Avenue with the north-westerly side of Peconic Bay Boulevard measuring
(1S1) north 59 degrees 52 minutes 40 seconds east across Peconic Bay Boulevard, 151.50 feet to the south-easterly side
of Peconic Bay Boulevard;(2^d) along the southeasterly side of Peconic Bay Boulevard north 40 degrees 49 minutes 10
seconds east 105.50 feet and (3rd) still along the southeasterly side of Peconic Bay Boulevard north 40 degrees 51
minutes 50 seconds east 200.00 feet to the aforesaid point of beginning and form said point of beginning;
RUNNING THENCE along the southeasterly side of Peconic Bay Boulevard(1) north 40 degrees 51 minutes 50 seconds
east 0.60 feet and (2) north 40 degrees 58 minutes 50 seconds east 97.50 feet to land now or formerly of Janet Pullman
Redhead;

THENCE along said land of Stewart north 26 degrees 20 minutes 20 seconds west 328.16 feet to the southeasterly side
of Peconic Bay Boulevard at the point or place of BEGINNING.
TOGETHER with all right, title and interest, it any,of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof;TOGETHER with the appurtenances and all the estate and rights of
the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein granted unto the party of
the second part,the heirs or successors and assigns of the party of the second part forever,
SUBJECT TO a mortgage with Country Wide Home Loans, Inc.dated July 17, 2007, and recorded on August 10, 2007 in
Liber M00021581 and Page 645 in the Suffolk County Clerks Office,
BEING AND INTENDED TO BE the same premises conveyed to the party to the first part by deed dated August 13, 1986,
and recorded on August 3, 1987, in Liber 10380 Page 231 in the Suffolk County Clerk's Office.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be
applied first for the purpose of paying the cost of the improvement before using any part of the total of the same for any
other purpose.
The word "party" shall be construed as if it read "parties"whenever the sense of this indenture so requires.
