Box 1179 Southold,NY 11971 Re: Application of Bradford R. Burnham Suffolk County Tax Map Number 1000-10-4-13.10 Location: Peninsula Road, Fishers Island,New York Dear Trustees: Please be advised that this office represents Elbert M. Burr of Salem, Connecticut. Our client is the owner of property located off of Peninsula Road on Fishers Island which abuts the property of Bradford R. Burnham which is the subject of a land use application currently pending before the Board of Trustees for the Town of Southold to the south and to the west. In addition, our client is the holder of a life estate in and to a certain right of way,ten feet in width, extending northeasterly to West Harbor. I will preface this letter by stating that our client does not object to the Applicant's redevelopment plan for the redevelopment of his property. With that being said, he does have concerts with respect to the development initiative which will be set forth in this correspondence in order to ensure that the Board of Trustees for the Town of Southold, in administering the land use application, incorporate adequate protections for our client's rights, improvements and concerns as enunciated in this correspondence. When, in this correspondence, I reference the "Plan", the Plan refers to that certain plat entitled "Plan of Peninsula at Fishers Island Owned By Charles W. Hedge & prances G. Thorp. Scale 50 Feet To The Inch By Chandler&Palmer Engrs.Norwich,Conn. 1913.Revised Oct. 1951 Revised July 1953 Revised Sept. 1967 Lot Areas Added Jan. 29, 1976". M:\Burr,Elbert\Itr.Board of Trustees.docx 4 y : AUGDiD 1 6 2023 Board of Trustees Town of Southold Southold Tnvrn August 11, 2023 ___ Board of Trustees Page 2 of 3 By reference to the Plan, our client's property includes (i) a certain roadway 20 feet in width extending northerly approximately 100 feet removed westerly from Darbies Cove to West Harbor. This 20 foot strip of land abuts the Burnham property designated as Lots 1 and 28 and a 20 foot strip extending easterly to the west (ii) a 20 foot strip of land, also utilized as a roadway, abutting Lots 18,20, 22,24,25,26,27 and 28 to the south and(iii) a 10 foot in width reserved for life right of way for access to the beach area located adjacent westerly to the easterly lines of Lots 6, 22 and an aforementioned 20 foot wide strip extending easterly as depicted on the Plan and southerly of Lots 1 — 8, which 10 foot wide right of way, reserved for life, provides access to the beach area along West Harbor, and which constitutes an interest in real property. In addition, our client is the owner of a single family residence and Lots 12— 15 as delineated on the Plan(as well as other real property interests on the Peninsula)which are not germane to this correspondence. Our client owns and maintains the private roadways referenced above. In addition, our client owns underground utility lines installed within the limits of the private roadways referenced above and as depicted on the Plan, which provide water, electricity and telephone services to our client's dwelling house. We have reviewed materials available online with respect to the permit application pending before the Board of Trustees of the Town of Southold, including, but not limited to, a plan entitled "Site Development Plan Prepared For: R. Bradford Burnham 2680 Peninsula Road Fishers Island, New York Site Plan Designed By: PMP Drawn By: PMP Issue Date: 02/21/2023 Revisions No. 1 NYSDEC Comments By PMP 03/10/2023 2 SCDHS Comments By PMP 06/05/2023 Project No: 078019 Scale: 1" = 20' Drawing No.: Sheet 1" prepared by CHA Engineers of Rocky Hill, Connecticut and received by the Southold Board of Trustees as of July 7, 2023. The first concern enunciated herein is the fact that the plan presented for administration does not appear to properly delineate our client's interest as an abutting property owner. The Plan, if approved, should be approved with the condition that it be revised to properly reflect the interests of Elbert M. Burr enunciated in this correspondence. While our client takes no position on the compliance of the application with the permitting requirements being administered by the Board of Trustees of the Town of Southold, and does not object to the construction of the improvements proposed by the Applicant, as enunciated above, it does request that adequate conditions be incorporated into any permit issued to address the following concerns in the event that the application is approved: 1. As indicated above, our client maintains underground utilities within the limits of the private roadway which he owns and which abuts the Applicant's property. Adequate provisions must be made to ensure that the integrity of these installations is not compromised by any construction engaged in under the auspices of any permit issued. MABurr,Elbert\ltr.Board of Trustees.docx tY Board of Trustees r AUG 2 23 Town of Southol August 11,2023 a .v..,. . . . Pae 3 of 3 s'' "k r 2. That the permit incorporate provisions prohibiting the parking of any vehicles within the limits of the private roadway owned by our client for the duration of the construction project. 3. That construction activities must be coordinated in order to ensure that the private roadway remains open and available for access by fire, police, ambulance and other public safety vehicles at all times. 4. That connections for water, electric or telephone to provide utility services to the new home proposed for construction by the Applicant must be coordinated in such a manner that any interruption of our client's utility services is minimized. In addition, all such interconnections must be accomplished in accordance with the regulatory requirements of each utility providing utility service. 5. That, upon the completion of construction of the improvements under the permit applied for,any damage to the private roadway be fully restored to its current condition. Very truly yours, E B "I"M. BURNHAM SCTM# 1000-10-4-13.10 J.M.O. Environmental Consulting on behalf of BRADFORD R. BURNHAM requests a Wetland Permit to raze the existing dwelling and construct a proposed 4,805sq.ft. single family dwelling with associated I/A OWTS system; a 679sq.ft. garage; 2,587sq.ft. of decks; a 386sq.ft. porch; 272sq.ft. of walkways; a 461 sq.ft. planter; and 373sq.ft. of paved area; install six 8'x6' drywells for roof runoff; remove and replace underground utilities; remove and replace water service; remove existing gravel driveway and restore with loam and seed, and install an new gravel driveway. Located: R.O.W. Off Peninsula Road, Fishers Island. SCTM# 1000-10-4-13.10 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the LWRP policy 4. Policy 4 of the LWRP does not support the expansion of a building within a FEMA FLOOD ZONE AE. These areas experience structure loss from storm events. It is recommended that the Board verify the flood zones in relation to the structure. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
