(631) 765-1809 MINUTES SPECIAL MEETING THURSDAY,JULY 20,2023 A special meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, July 20, 2023 commencing at 4:00 P.M. The public had access to view and listen to the meeting as it was happening via Zoom. However, this meeting was not a public hearing and no testimony was solicited or received. -Present were: Leslie Kanes Weisman, Chairperson Kim Fuentes, Board Assistant Nicholas Planamento, Vice Chair Elizabeth Sakarellos, Sr. Office Assistant Eric Dantes, Member Julie McGivney, Asst. Town Attorney Patricia Acampora, Member Rob Lehnert, Member 4:04 P.M. Chairperson Weisman opened the meeting in order to call for Executive Session. Vote of the Board: Ayes: Member Weisman (Chairpersonl, Planamento, Acampora and Lehnert. This Resolution was duly adopted(4-0� EXECUTIVE SESSION: 4:04 P.M. Motion was offered by Chairperson Weisman, seconded by Member Acampora to enter into Executive Session in order to receive Attorney Advice. Vote of the Board: Ayes: Members Weisman (Chairperson), Planamento, Acampora and Lehnert. This Resolution was duly adopted(4- Q1 4:47 P.M. Motion was offered by Chairperson Weisman, seconded by Member Lehnert to exit Executive Session. Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes, Lehnert, Planamento, and Acampora. The Board discussed meeting dates for Year 2024. C. , The Board discussed extension requests. POSSIBLE RESOLUTION TO ADJOURN/CLOSE THE FOLLOWING HEARINGS: RQA PROPERTIES, LLC#7800 - Request for Variances from Article XXIII, Section 280-123A and the Building Inspector's March 15, 2023 Notice of Disapproval based on an application for a permit to legalize several "as built" additions and accessory structures at an existing auto body repair business 1) A nonconforming building containing a nonconforming use shall not be enlarged, or structurally altered or moved, unless the use of such building is changed to a conforming use; 2) "as built" improvements results in increase in floor area greater than prior alternative relief that was previously granted in ZBA File No. 5759 dated December 27, 2005; located at: 29950 Main Road, Cutchogue, NY. SCTM No. 1000-102-3-1. RESOLUTION: A motion was offered by Chairperson Weisman, seconded by Member Planamento to Adjourn the Hearin to o August 3, 2023. Vote of the Board: Ayes: All. This Resolution was duly adopted (L--O) DELIBERATIONS/POSSIBLE DECISIONS/RESOLUTIONS: Agenda items and commenced deliberations on the following applications. The original determinations of each of the following applications as decided are filed with the Southold Town Clerk: GRANT RELIEF AS APPLIED: James Burleigh Morton and Carol DeGraff Morton, Morton JB Living Trust#7803 Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Planamento, Lehnert, and Acampora. This Resolution was duly adopted (5-0). GRANT RELIEF AS APPLIED WITH CONDITIONS: Nancy Burke#7792SE Patrick Carey#7794 220 Navy St. Trust, Colin Cowley#7796 Matthew and Jill Perry#7798 - Katie and Jonathan Vigdorchik#7802 Vote of the Board:- Ayes: Members Weisman(Chairperson), Dantes, Planamento, Lehnert, and Acampora. This Resolution was duly adopted (5-0). This Resolution was duly adopted ,5-0). DECISION TABLED: Constance,Levy#7801 Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Planamento, Lehnert, and Acampora. This Resolution was duly adopted 5-0). WITHDRAWN APPLICATION_ACCEPTED Kenneth and Elizabeth McCulloch#7799 Vote of the Board: Ayes: Members Weisman(Chairperson), Dantes, Planamento, Lehnert, and Acampora. This Resolution was duly adopted 5-0). RESOLUTIONS: RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to authorize advertising of hearings for the Regular Meeting to be held on Thursday, August 3, 2023, which will commence at 9:00 AM for Executive Session, and 10:00 A.M. for Work Session and Regular Meeting. Vote of the Board: Ayes: , Member Weisman(Chairperson), Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted(5-0). RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Lennert to approve Minutes from the Regular Meeting held July 6, 2023. Vote of the Board: Ayes. Member Weisman(Chairperson), Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted 5-0). ' RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Planamento to approve a Six(6) Month Extension of Appeal No. 7041, Mattebella Vineyards, 46005 NYS Route 25, Southold. SCTM No. 1000-75-2-15.1 & 15.2. This is a Fourth(4th) Extension for Six Months to expire January 6, 2024. Vote of the Board: Ayes: Member Weisman(Chairperson), Dantes, Planamento,Acampora and Lehnert. This Resolution was duly adopted(5-0). Minutes of ZBA July 20,2023 Special Meeting Page 4 RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Acampora to approve a Three (3)Month Extension of Appeal No. 7043, Michael and Sara Colodner, 130 Willis Creek Drive, Mattituck, SCTM No. 1000-115-17-17.8. Three Month Extension to expire October 20, 2023. Vote of the Board: Ayes: Member Weisman(Chairperson), Dantes, Planamento, Acampora and Lehnert. This Resolution was duly adopted(5-0).
