FDJ CO 4 TERMS AND CONDITIONS The Permittee Daniel Ferrara&Jamie Schwartz residing at 1805 Laurel Way,Mattituck, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the-Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. Box 1179 Southold, NY 11971 Re: Pending Wetland Permit Application/Proposal to build single family residence Ferrara/Schwartz Property; 1805 Laurel Way, Mattituck; SCTM#1000-121-4-24 Public Hearing: August 16, 2023 Dear Members of the Board, My family owns the property at 1875 Laurel Way, directly adjacent to the proposed project. Unfortunately, I am unable to attend the public meeting scheduled for 8/16/2023 due to a prior commitment. Therefore, I am writing to voice two concerns over the project. 1. Southold Town Code § 275-3 1)(1)(a)[1]. The application indicates that a portion of the proposed residence will be located 74 feet away from the edge of the Lake, which violates the 100-foot setback requirement for freshwater wetlands. 2. Southold Town Code § 275-6 A(9). Laurel Lake has suffered from recurring harmful blue green algae blooms since 2016. Algae blooms are caused/exacerbated by increased nutrient levels—in particular, nitrogen and phosphorous. Please consider whether this project will add to the problem. For example,will the addition of impervious materials on the parcel affect the flow of rainwater and create more runoff into the lake,thereby contributing to future algae blooms? Box 11971 Board of Trustees Southold,NY 11971 RE: SCTM# 1000-121-4-24 August 16, 2023 Public Hearing on the Ferrara/Schwartz Wetland Permit Application to Build a single family residence at 1805 Laurel Way, Mattituck Dear Members of the Board of Trustees: My family owns property at 1875 Laurel Way which is adjacent to the proposed site for construction of a new single family residence on a pie-shaped parcel of land. I share the concerns succinctly outlined in the August 10, 2023 letter of Mary Louise Gagliano. Unfortunately, I am unable to attend the August 16th hearing,but would like to reiterate the following concerns: 1) The proposed new building does not adhere to the Wetlands set back requirements of 100 feet for a new residence. Southold Town Code, Chapter 275-3 (D)(1)(a)(1). 2) The permit does not adequately provide a"statement of the effect, if any,on the wetlands and tidal waters of the Town that may result by reason of such proposed operations." Southold Town Code, Chapter 275-6 (A)(9). Laurel Lake was once a pristine haven for swimmers. It provided crucial summer recreation for citizens at the town beach, children at adjacent camps, and residents lucky enough to own homes on the lake. In recent years,the emergence of the blue algae described in Ms. Gagliano's letter, has profoundly deterred swimming in the lake. Sadly, nowadays no one ventures into the lake's waters for a refreshing swim. We have even been cautioned of the dangers the water poses to pets. A key purpose of the Southold Town Code is "improvement of water quality"which is an important issue for the hearing to address. Southold Town Code, Chapter 275-3(B) In addition to these vital concerns about maintaining the lake's quality, I am concerned that the proposed driveway and close proximity of the house to the road(Laurel Lake Way)will have a negative effect on the aesthetics of the community as defined by the Southold Town Code: "The natural intrinsic appearance of a site or object in the context of surrounding land use,views,viewsheds and vistas important to the community." Southold Town Code, Chapter 275-2(A). • It is not clear that the proposed driveway will provide adequate parking space to keep cars off the vital passageway of Laurel Way. • The proposed close proximity of the house to Laurel Way does not reflect the community's pattern of setting housing a discreet distance from the roadways. Your consideration of these concerns will be sincerely appreciated by our family. Laurel Lake is a precious community resource. As the New York State Department of Environmental Conservation notes on its website, it is a"scenic 30 acre 347 foot deep kettle hole lake "that was formed nearly 10,000 years ago. While I fully appreciate the intent and right of the owner to develop this newly acquired property, it is my genuine concern that this very unique and environmentally sensitive area is carefully considered and fully protected. The documentation that we received indicates that at least part of the proposed development would be within 100 feet of the designated wetland area on Laurel Lake. This is currently an undeveloped lot and I have serious concerns regarding disturbance to the neutral space inside the designated wetlands' boundary area. The Suffolk County Water Authority and Peconic Land Trust both recognize the sensitivity of the Lake and surrounding lands which could seriously and negatively impact public health. Laurel Lake and the surrounding area is a unique, hidden gem within Southold Township that MUST remain as such. It merits the consideration of a conservation district protected for future generations and residents alike to enjoy. We all have recently seen the explosion in development of the North Fork and it is quite concerning that we may very well loose what makes us so special. We are not the Hamptons and do not want to be subject to the over development and environmental loss that has plagued their communities. This is why (especially in the Laurel Lake community) all guidelines intended to protect our natural environments and resources must be strictly adhered to. I'd like to speak with whomever came out to possibly clear this up and avoid any delays and costly reports for me, that will be as said, a hardship. I was told to ribbon the trees in front of the 100' wetland area that I'd like to remove which i did. About 9. 1 can easily demark them by hand on a plan etc... All the other trees are staying, as we prefer a more natural landscape. Obviously, behind the line, trees are coming down for house, driveway, septic etc. not of your jurisdiction but again, not wholesale just what i need. To the Board of Trustees, I would like to raise an objection to the proposed building plan at 1805 Laurel Way in Mattituck. If my understanding is correct,the drawings of the building plan indicate that at least part of the proposed dwelling would be built within 100 feet of the wetland line on Laurel Lake. Considering that this is an undeveloped lot, located in a very environmentally sensitive location, there is no reason to place a structure or disturb the natural space inside the 100 foot wetlands line. As you're aware, Laurel Lake has been plagued by seasonal algae blooms over the past few years. This of course has had a very negative impact on this estuary. This Lake is also an expression of ground water which is very close in proximity to wells & pumping stations owned by the Suffolk County Water Authority. All things considered; this is a very environmentally sensitive area that could potentially impact public well-being. An effort to consider what can be done to mitigate the infiltration of algae toxins in Laurel Lake needs to be considered. And that would include the added pressure from possible nitrogen fertilizer run off as well as septic seepage. New lakefront construction on an undeveloped lot should be carefully considered.
