That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the'work herein.authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. The information you requested in the email was not included in this application because it is an existing dock built in 1999 (permit#4991). This is not reconstruction. The owner did not realize he had to "transfer" the permit to maintain the existing structure. The owner used the same piles and substructure/framing of the catwalk(as can be seen from the pictures) and the Board could see on a field inspection. The original existing planks on the catwalk were placed too low on the piles and were being swamped during high tides. Rather than replace the planks low on the piles, the wood planks were raised on the existing piles and substructure 18" higher. The same piles & subframe remains (the work done is normal maintenance of the wood planks). There was no disturbance below or adjacent to the existing structure. No work was done in the water. The existing wood ramp (3 x 14)was reused, but because the planks on the catwalk went up 18" ,the ramp was close to falling off of the float. The float was replaced due to normal wear&tear(the old float is shown in the pictures). The replaced wood planks on the existing dock are in the same location, using the same structure and attached to the same piles. The owner added an extra 4' x 4'platform to the float in order to reuse the same wood ramp. I have explained that the float can not be more than 120 SF. (either the 4' x 4' extension gets cut off or another solution may be recommended by the Trustees) i The new application proposed a 12' aluminum ramp. However, without a 4' x 4'platform on the float the aluminum ramp has to be @4' longer. Unless the BOard would allow the wood planks to remain, the existing I wood planks on the catwalk would be replaced with "flow-thru" (based on the Board's typical preferences). i ` The existing piles are the same, they were not moved. Because the catwalk went up 18", the overall length of f the catwalk is slightly shorter. Note that the permit from 1999 had a 25' catwalk(we propose 24') and a 3' x 14'hinged ramp (we propose a 3' x 12' aluminum ramp). The Float is in the same location. The Trustee's correspondence from the 1999 permit allowed the owner to use the float as either an "L" or a "T" . The prior owner had the float in an "L" position-this has not changed. 1 Given the above facts, I would ask that our application continue to be processed. There is no change proposed +� to the location of the catwalk,piles, or the float in the canal. I I 2 I We would request that the inspection be scheduled so that we can review the project in the field. If any alterations to the structure are required they can be discussed in the field. Without the 4' x 4' extension of the float(to keep the float to no more than 120 SF)the proposed aluminum ramp length would have to be longer than the 12' as proposed (same length as the previous ramp, i.e. 14' + to account for the extra 18" height). I would remind the Board that the owner received a ticket for doing work on the permitted dock because he was not aware that he had to transfer the 1999 permit into his name. This would have been easily corrected, when discovered, by allowing the owner to transfer the permit. He was told he could not "transfer" the existing permit(I think because you believed that the dock had been "reconstructed"). That is not the case. We paid for a new permit(doubled as a penalty) for the existing structure. The Court is expecting us to have our application reviewed. The dock is existing, the applicant bought the house with a dock(WHICH HE MADE SURE WAS BUILT WITH A PERMIT)and was merely maintaining the existing structure. That would have been allowed had the permit been "transferred". Unfortunately, it is not commonly known by the public, the brokers, or many lawyers that you require the new owner to transfer permits for the existing structures into their name.
