Suc letter, I am told by Frank Cichanowicz ill, is to assure the Town of Southold that I will of change certain aspects of the construction after it has been inspected and , proved. If the above mentioned request is true as ' was related to me I then cannot understand why, unless it is routinely requested of roperty owners, I am being asked to comply with this request. The request seems to want me to ' e assurances above and bayond what the law rcquests. My contractor has advised me th, I have complied with the code(a fact that even the inspector confirmed) but for say c unmentioned reason that same inspector is now imposing additional requirem is that seem unconventional, retaliatory and arbitrary. In all of my previous experienc s in commercial and residential construction I have never been asked to write a letter f the sort requested here. I am well aware of my o ligations under the law and the consequences for failing to coply with such reg ions. Upon Application of THOMAS PULS and, DONNA, RICCO. A variance is requested from Article 111, Section 100-33 for permission to locate swimmingpool with fence enclosure in an area other than the required rear yard. Location of. Property: 1350 Eugene's Road, Cutchogue; NY; County Tax Map Parcel No. 1000-97-6-1.2. Zone District: R-80 Residential. The subject premises is a substandard lot. WHEREAS, a public hearing was held on March 2, 1994 and May 4, 1994, at which time all persons who desired to be heard were heard and their testimony -recorded; and WHEREAS, the Board has carefully considered all testimony and documentation submitted concerning this application, WHEREAS, Board Members have personally viewed and are familiar with the premises in question, its present zoning, and the surrounding areas; and WHEREAS, the Board made the following findings of..fact: 1. BASIS OF DISAPPROVAL. This is an application based upon the following Notice of Disapproval, from the Building Inspector to construct a pool with fencing partly in the side yard and partly in the rear yard area, which Notice dated February 9, 1994 is worded as follows: Disapproved on the following grounds: Under Article III, Section 100-33 accessory structures and uses shall be located in the required rear yard. Action required by the Zoning Board of Appeals; Action also required by the Board of Town Trustees and N.Y. State Department of Environmental Conservation...." 2. CODE REQUIREMENTS." Article III, Section 100-33, requires accessory buildings and structures to be located in the rear yard, or in the case of a waterfront parcel, in the front yard. The rear yard of this parcel is technically that yard area south/southeast of the Page, 2 - Appl. PROPERTY DATA. The premises in, question was conveyed by Mark McDonald. and. Patrick Carrig on January 6, 1984. to the applicants herein: The subject parcel is described (rather than part of a subdivision) and is situated on the southerly side of. Eugenos Road, Cutchogue (East). The size of this parcel is shown to be approximately .73 of an acre with 202 ft. frontage along Eugene!s Road, and is improved with a single-family, two-story frame house situated 61.3 feet from the front property line, 24.8 feet from the westerly side property line, and approxinately 90 feet from the rear of the foundation to the tie line along high water mark (74+- feet from the edge of. the deck steps to the southerly highwater line, and 77+- feet to the easterly highwater line, at its closest points). The property has variable. and low contours, which lend to the limitations for building in reasonable locations while, meeting all other zoning code requirements. 4. PROPOSAL. This application is a request to locate an 18 ft. by 38 ft. inground swimming pool in the side yard approximately-8 ft. from the easterly side of the dwelling which will leave a setback at 52 feet from the easterly property line. A 9-ft. open deck with raised wall and planter will further reduce the setback to the side property line to a distance of 49 feet at one point and 42.6 feet at another point. 5. INSPECTION(S) AND RESEARCH DATA. (a) An inspection of the site reveals ° that- the house is presently set back approximately 90 feet from the side property line (along the highwater mark) at its closest point. No other buildings or structure are proposed {or exist at the premises) except that landscaping and berm areas are to be placed in the front yard, not to exceed four feet in height. (b) Regrading and new landscaped areas must be done to keep surface water runoff directed away from the tidal wetlands and the property owners will be required to either truck the pool water off site, or properly install drywell drains. 6. OTHER TOWN AGENCY JURISDICTION/REVIEW. Submitted for the record is a copy. of the written authorization issued by the Board of Southold Town Trustees dated March 24, 1994 under Permit No. 4296 for this project. No information has been submitted to show whether or not a permit was acted upon by the N.Y.S. Department of Environmental Conservation, for which an application may be pending at this time. Prior to issuance of a building permit for the PagP 3 - Appl. Department of Environmental Conservation. 7. EFFECTS OF RELIEF REQUESTED. It is the position of this Board that in considering the relief requested and more particularly shown on the landscape plans - dated 2-9-94 prepared by Briarcliff Landscape that: (a) the location of the swimmingpool structure in - the side yard is not unreasonable in light of- the fact that the rearyard has low elevations-and may not be disturbed; (b) the grant of the relief to locate the pool in the requested sideyard rather than the rearyard will not alter the essential character of the neighborhood due to the nature of, the layout and characteristics of this--site; (c) the benefit sought to be achieved by the appellants cannot be achieved by a method other than a.-variance under the zoning regulations; (d) the difficulty will not have- an adverse effect or impact on the physical or environmental conditions in.the neighborhood since the appellants will be required to either truck the pool water off site or install drywells as recommended by the environmental agencies of the Town and State. NOW, THEREFORE, on motion by Member Wilton, seconded by Chairman Goehringer, it was RESOLVED, to GRANT relief, to locate the proposed 18 ft. by 38 ft. swimmingpool with nine-ft. deck area and fence enclosure in • the easterly side yard, as requested, SUBJECT TO THE FOLLOWING CONDITIONS: 1. That the pool area be open to the sky, without a building enclosure; 2. That there be no lighting that would be adverse to neighboring areas; 3. That the fence be placed as. required by the Building Inspector for safety purposes; 4.
