Town Attorney Board of Appeals 7~ February 19, 1992 SUBJECT: Article XXIV - Nonconforming Uses and Buildings Our office has been contacted on many occasions concerning the town's rule on nonconforming setbacks and expansions o! nonconforming building. We feel that your legal opinion concerning Section 100-242 of the zoning code as it relates to nonconformance and the "degree of nonconformance" is imperative. The code section in particular is: ...100-242 - Nonconforming buildings with conforming use. A. Nothing in this Article.sha~% be deemed t~o pr__event the remodeling., reconstructzon~ enlargementTof a-'~ nonconforming building ... prov~ded that suc~ action does not create any new ncnconlormance or increase the degree of nonconformance with regard to the regulations ~ertaining to such buildings... With reference to 100-242 above, it has been determined by the ZBA in the past that an increase in the degree of nonconformance with regard to the setback or lot coverage regulations will reGuire a variance. These expanmions or additions are outside the footprint of the nonoonEorming building and nonconforming setback, and do increase the degree of the nonconforming setback. Those not requiring a variance under 100-242 above are those that do not increase the degree of nonconformity, such as alterations or expansions being placed at permitted conforming ~etbacks. {Provided they are conforming uses only}. The only situation in the nonconforming ~etback of a dwelling as exists may be issued a building per, it is to remodel or renovate, or to ~ebuild within the same footprint, without expansion. This would not expand the floor area (increasing the degree in square footage or the nonconformity). Please note that there has been no change in this interpre=ation. The Town is in the procesm of a~ending the wording of theee provisions, but this change is no= expected t~ be finalized for some time, Even if the wording of this provi~ion were changed next month, we do not expect that there would be any modification that would allow much expansionm without ZBA approval by either Special Exception or variance. The main portion of the structure represents the greatest percentage of value of the entire structure. The eastern improvements (garage and attached shed) represents no more than 25% of the total value of the improvements. Mr. McCarthy's intention with the filed building permit is to alter the existing structure that has the most valve and improve the garage and shed that currently exists. He will be using the existing foundation, and many of the existing walls. RELIEF REQUESTED: Enlargement of porch area from 19.'4" x 17'8" as approved u~der Building Permit #22881Z on 7/12/95, to a size of 12' x 24.' The lot coverage, as enlarged, exceeds the cede ]imi~ation by approximately 68 square feet due to the angle of' the project.
