SUBJECT: Article XXIV - Nonconforming Uses and Buildings
Our office has been contacted on many occasions concerning the
town's rule on nonconforming setbacks and expansions o!
nonconforming building. We feel that your legal opinion
concerning Section 100-242 of the zoning code as it relates to
nonconformance and the "degree of nonconformance" is
imperative.
The code section in particular is:
...100-242 - Nonconforming buildings with conforming use.
A. Nothing in this Article.sha~% be deemed t~o pr__event
the remodeling., reconstructzon~ enlargementTof a-'~
nonconforming building ... prov~ded that suc~ action
does not create any new ncnconlormance or increase
the degree of nonconformance with regard to the
regulations ~ertaining to such buildings...
With reference to 100-242 above, it has been determined by the
ZBA in the past that an increase in the degree of nonconformance
with regard to the setback or lot coverage regulations will
reGuire a variance. These expanmions or additions are outside
the footprint of the nonoonEorming building and nonconforming
setback, and do increase the degree of the nonconforming setback.
Those not requiring a variance under 100-242 above are those
that do not increase the degree of nonconformity, such as
alterations or expansions being placed at permitted conforming
~etbacks. {Provided they are conforming uses only}.

Your advice concerning the intent of the following subsection of
100-242 is also needed:
B. Reconstruction of a dam~ge~ building.
(1) A nonconforming buzld&ng damaged to the
extent of more than fifty percent ~f ~tz fair value shall not
repaired or rebuilt unless Such building ... oon~orm~ to ~he~/
height and yard setback requirements of the Bulk Schedule.
We feel that it is necessary for all departments to be advised,
in writing, o~ your legal determine%ion in order that we may all
be consistent with th~se provisions, and that any changes to the
rul~ (policy change) be established through your office.
Otherwise the laws enacted will not be taken seriously and
continue to be circumvented, and the public will only
"selective treatment."
(Sample plan~ are shown on the attached list. Pla~ "E" shows an
addition to a nonconforming building and the building was
permitted to be destroyed and rebuilt with the nonconforming
setbacks, without referral for a variance as reguired by Section
100-242B(2) above because the addition may secure some right to
retain the entire building without a variance.)

of Appeals w}gh regard to nonconforming uses and buildings. I would like you to
put this matter on the agenda for the next Legislative Committee meeting to
discuss revisions of this section of the Code for purposes of clarity and removal
of some language which creates unnecessary ambiguity, both in interpretation and
enforcement,

Dear Mr. Bayley:
For your file and information, please find attached our memorandum dated
July 3, 1991 relative to similar projects which have conforming uses with
nonconforming setbacks and reference to Section I00-241A of the Zoning
Code. The only situation in the nonconforming ~etback of a dwelling as
exists may be issued a building per, it is to remodel or renovate, or to
~ebuild within the same footprint, without expansion. This would not
expand the floor area (increasing the degree in square footage or the
nonconformity).
Please note that there has been no change in this interpre=ation. The
Town is in the procesm of a~ending the wording of theee provisions, but
this change is no= expected t~ be finalized for some time, Even if the
wording of this provi~ion were changed next month, we do not expect that
there would be any modification that would allow much expansionm without
ZBA approval by either Special Exception or variance.
Yo~r application, ae you know, has been tentatively calendared for our
April 2, 1992 .h~arings calendar. Please be sure to provide us with a
, copy of the Notice Of Disapproval from the Building Inspector together
with the additional seven prints of the site plan map, if possible,
within the next couple of days.

The purpose of this letter is to offer my professional
opinion on the above reference project.
Mr. McCarthy owns this parcel of property which has an
existing structure on it. This structure is composed of
sereral elements. The main portion of the structure
represents the greatest percentage of value of the entire
structure. The eastern improvements (garage and attached
shed) represents no more than 25% of the total value of
the improvements.
Mr. McCarthy's intention with the filed building permit
is to alter the existing structure that has the most valve
and improve the garage and shed that currently exists.
He will be using the existing foundation, and many of the
existing walls.
After a site observation, it is my opinion bhat he will not
be removing any where close to 50% of the value of the
existing structures in this process.

PROVISIONS APPEALED FROM: Article IIIA~ Section 100-30A.3.
RELIEF REQUESTED: Enlargement of porch area from 19.'4" x 17'8" as
approved u~der Building Permit #22881Z on 7/12/95, to a size of
12' x 24.' The lot coverage, as enlarged, exceeds the cede ]imi~ation
by approximately 68 square feet due to the angle of' the project. The
front yard and side yard setbacks are proposed to conform with the
zoning code requirements fop a principal structure.

ACTION/RESOLUTION ADOPTED: Approved lot coverage variance as
applied for an elllargement of the proposed porch to 19.' x 24' (instead

REASONS/FINDINGS: The vaMance is minimal and does not create any
reduction in the established side yard. The porch is proposed to
comply with all other zoning regulations.

PROVISIONS APPEALED FROM: Article IIIA~ Section 100-30A.3.
RELIEF REQUESTED: Enlargement of porch area from 12'4" x 17'8" as
approved under Building Permit #22881Z on 7/12/95, to a size of
19.' x 24.' The lot coverage, as enlarged, exceeds the code limitation
by approximately 68 square feet due to the angle of' the project. The
front yard and side yard setbacks are proposed to conform with the
zoning code requirements for a principal structure.

ACTION/RESOLUTION ADOPTED: Approved lot coverage variance as
applied for an enlargement of the proposed porch to 12' x 24' (instead
of 12'4" x 17'8").
REASONS/FINDINGS: The variance is minimal and does not create any
reduction in the established side yard. The porch is proposed to
comply with all other zoning regulations.
