All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed prior to placement of any fill material behind such structures. 9. Prior to any construction or removal of bulkheads and other shoreline stabilization structures all backfill shall be excavated landward of the bulkhead and retained so as not to enter the waterway, tidal wetland or protected buffer area. 11. A copy of this permit, including all conditions and approved plans, shall be available at the project site whenever authorized work is in progress. The permit . sign enclosed with the permit shall be protected from the weather and posted in a conspicuous location at the work site until all authorized work has been completed. B. The permittee shall require that any contractor, project engineer, or other person responsible for the overall supervision of this project reads, understands, and complies with this permit and all its general, special, and supplementary special conditions. Any failure to comply precisely with all of the terms and conditions of this permit, unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. C. If project design modifications become necessary after permit issuance, the permittee shall submit the appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. The applicant must submit a certificate from the sewage disposal installer attesting that the system has been installed according to the criteria of the Suffolk County Department of Health Services, when applicable. 3. Applicant: Robert J. Melchione, C35 Glen Hollow Drive, Holtsville, NY 11742 Notice of Hearing: May 24, 1995 - Hearing Date: June 8, 1995 Statement of Problem Construction standards require that the distance between sanitary systems and shallow private wells be at least 150 feet. The applicant is proposing installing the sanitary system less than 150 feet from a private well. Findings and Facts 1. Proposed reconstruction of a single-family residence on a 11,200 square foot parcel. Original dwelling was built in 1937. 2. The existing undersized sanitary system will be replaced by a new five-pool system 100 feet from Goose Creek. 3. The proposed sanitary system leaching pool will be less than 150 feet to three neighbors' existing wells (approximately 55 to 85 feet). One of the wells (Ortner) is upgradient of the sanitary system. The applicant is using the existing on-site well which is only 40 feet to the proposed sanitary system. 4. The existing separation distances between sanitary systems and wells for the houses in the area are less than 150 feet. 5. Site is in Groundwater Management Zone #TV. 6. Findings and Facts (cont'd) 8. Soils are loamy and coarse sand 0-10 feet; silty sand 10-19 feet; fine to coarse sand 19.25 feet. Determination It was a 3 to 0 determination of the Board to grant the request for the variance, provided the following conditions are met: • Applicant shall offer to relocate and/or deepen affected neighbors' private wells (Schwan & Basile). The offer shall be held open until the department issues final approval for the project. • Applicant covenants, in language acceptable to the County Attorney, that the on-site well does not meet the department's separation distances from potential sources of contamination.
