A. This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2 Final Approval from Health Dent. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 17, lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and

1. Accurate survey of property showing all property lines, streets, 'building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.

1. The permitted site or facility, including relevant records, is subject to In-
spection at reasonable hours and intervals by an authorized representative of
the Department of FrnironTental Conservation (the Departrrent) to determine
whether the permittee is catplying with this permit and the ECL. Such represen-
tative may order the vork suspended pursuant to ECL 71-0301 and SAPA'401(3)..

2. The Department reserves the right to modify, suspend or revoke this permit m hen:
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found;
b) the permit was obtained by misrepresentation or failure to disclose
relevant facts;
c) rww rraterial information is discovered; or
d) envirortrental conditions, relevant technology, or applicable larv or
regulation haverrateriaily changed since the permit wes issued.
3. The permittee rrust submit a separate written application to the Department for,
reneneI, modification or transfer of this permit. Such application must include
any fours, fees or suppierental information the Department requires. Any
renenel, modification or transfer granted by the Departrrentrrust be in writing.
4. The permittee must submit a renenei application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination System (SRMS), Hazardous ftste Nbnagerrent Facilities

Facilities (SAW); and
b) 30 days before expiration of all other permit types.

the Department or any of the terms, conditions or requirerents contained in such
order or determination.

6. The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all damages, direct or indirect, of v~lhataver
nature and by Mmever suffered, arising out of the project described in this
permit and has agreed to indemify and save harmless the State from suits,
actions, dareges and costs of every nare and description resulting from this
project.
7. This permit does not convey to the pe rmi ttee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the irrpairment of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permit.
8. The permittee is responsible for obtaining any other permits, approvals, lands,

1. During construction, concrete or leachate shall not escape
or be discharged, nor shall washings from transit mix
trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas.
2. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted
activity.
4. The storage of construction equipment and materials shall be
confined to within the project work site and or upland areas
greater than 50 linear feet from the tidal wetland boundary.
5. All disturbed areas where soil will be temporarily exposed
or stockpiled for longer than one (1) week shall be
contained by a continuous line of staked hay bales/silt
curtain or other written NYSDEC approved method and placed
on the seaward side between the fill and wetland or
protected buffer area. Tarps are authorized to supplement
these approved methods.

SPECIAL CONDITIONS
For Article 25 ( Tidal Wetlands
6. All fill shall consist of "clean" gravel and soil (not
asphalt, slag, flyash, broken concrete or demolition
debris).
7. No excavation of the beach is authorized for the purpose of
obtaining fill or stone materials.
8. All peripheral berms, cofferdams, rock revetments, seawalls,
gabions, bulkheads etc. shall be completed prior to
placement of any fill material behind such structures.
9. Equipment operation below apparent high water is strictly
prohibited.
10. Prior to any construction or removal of bulkheads and other
shoreline stabilization structures all backfill shall be
excavated landward of the bulkhead and retained so as not to
enter the waterway, tidal wetland or protected buffer area.
11. A row of staked hay bales or approvable erosion control
devices shall be placed at the landward edge of the buffer
area or 30 linear feet from the property line, or as per
NYSDEC approved plan at commencement of regulated activities
and remain in place until project is completed and all
disturbed areas stabilized with vegetation.
12. Roof runoff shall be directed to drywells a minimum of 75
feet landward of the tidal wetland boundary for immediate
on-site recharge.
13. Sanitary system (bottom of tank and leaching pools) shall be,
located a minimum of 2f above seasonal high groundwater.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion management; and wild, Scenic, and
Recreational Rivers Permits:
A. A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit .
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
B. The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
C. If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
D. At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if,
required, a survey.
E. For projects involving activities to be undertaken in
phases over a'period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
F. The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

INSTRUCTIONS FOR FINAL APPROVAL OF CONSTRUCTED SYSTEMS
It is the applicant's responsibility to call the Department to arrange inspections of the sewage disposal system and water
supply facilities prior to backfilling. These include inspections of the soil excavation for the sewage disposal system
and inspections of the water supply well, well lateral, public water supply line, disposal system, piping and filial
grading. Other inspections may be required.
Following satisfactory construction and inspections:
L The applicant must submit 4 prints of an as-built plan (up to and including 11"x1T'), by a licensed design
professional, of the subject property showing tine following:
a. the lot location and dimensions;
b. the lot number(s) and the name of the subdivision, if applicable;
C. permanent structures (i.e., buildings, driveways, walkways, swimming pools, decks, etc.);
d, the exact location of the private well, if applicable (give at least 2 dimensions measured from the comers of the
buildhng);
e. the exact location of the public water line, if applicable;
f. the exact location of the septic tank and leaching pool(s), if applicable. Give 2 dimensions from the building
corners to the covers of the septic tank and each leaching pool;
g. the exact location of the sewer line from the dwelling to the street; if applicable; and
h. have a clear area at least 3"x5" for the Department's approval stamp.
2. The applicant must submit a certificate from the sewage disposal installer attesting that the system has been
installed according to the criteria of the Suffolk County Department of Health Services, when applicable.
3. If a well has been installed as the potable water supply, tine applicant must submit a current well water analysis
(within one year) and a well driller's certificate. If the well or water quality does not conform to standards, proof
of corrective measures will be required. Refer to "Standards and Procedures for Private Water Systems."
4. In those cases where public sewers are utilized for the dwelling, the applicant is also to submit one (1) copy of the
sewer line inspection approval from the public sewer district. In districts operated by Suffolk County, two (2)
copies of Form S-9, duly executed by the Suffolk County Department of Public Works, are required.
5. In those cases in which the installation and connection of the public water service line has not been inspected by
tine Department of Health Services, a tap letter from the appropriate water company is required.
HEALTH DEPARTMENT REFERENCE NUMBER MUST
BE ON ALL CORRESPONDENCE OR DOCUMENTS SUBMITTED.

Statement of Problem
Construction standards require that the distance between sanitary systems and shallow private
wells be at least 150 feet. The applicant is proposing installing the sanitary system less than
150 feet from a private well.
Findings and Facts
1. Proposed reconstruction of a single-family residence on a 11,200 square foot parcel.
Original dwelling was built in 1937.
2. The existing undersized sanitary system will be replaced by a new five-pool system 100
feet from Goose Creek.
3. The proposed sanitary system leaching pool will be less than 150 feet to three neighbors'
existing wells (approximately 55 to 85 feet). One of the wells (Ortner) is upgradient of
the sanitary system. The applicant is using the existing on-site well which is only 40
feet to the proposed sanitary system.
4. The existing separation distances between sanitary systems and wells for the houses in the
area are less than 150 feet.
5. Site is in Groundwater Management Zone #TV.
6. Public water is not available.
7. Depth to groundwater is about 7.4 feet.

8. Soils are loamy and coarse sand 0-10 feet; silty sand 10-19 feet; fine to coarse sand
19.25 feet.
Determination
It was a 3 to 0 determination of the Board to grant the request for the variance, provided the
following conditions are met:
• Applicant shall offer to relocate and/or deepen affected neighbors' private
wells (Schwan & Basile). The offer shall be held open until the department
issues final approval for the project.
• Applicant covenants, in language acceptable to the County Attorney, that the
on-site well does not meet the department's separation distances from
potential sources of contamination.

The following action was taken by the Board of Town Trustees
during its regular meeting held on April 27, 1995 regarding the .
above matter:
WHEREAS, Land Use Co, on behalf of ROBERT MELCHIONE,
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated January 18, 1995 and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on April 27, 1995, at which time all
interested persons were given an opportunity to be,heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town, '
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
ROBERT MELCHIONE to enlarge living area of two-story dwelling
by constructing a framed addition that will extend the length

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.

work shall cause unreasonable obstruction to free navigation, the said Permittee will be requited,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
