The venting pipe is positioned near the eastern end of my propmly at app,'oximately ground level. Although my property and the Pequot Inn's properW are zoned for commercial use, the neighborhood is largely residential with many families living in close proximity to one another. Since June, my family and I have lived with strong smells of deep fried cooking. On many occasions this summer we closed most of the windows in our house to avoid having the fumes wafting in. In fact, the foggy, damp conditions over the last few months have caused a cloud of noxious smells to hover over our t/ouse, and the neighborhood. Given the outlet pipe's proximity to my property line, I was also wondering flit conforms with the Town's set back ordinances. Furthermore, I surveyed my property some years ago and I recollect that a paper road runs between my property and the Pequot Inn. It appears tlmt the vent outlet may be located on this paper road and not on the Pequot's property at all. With the vent placed in its current location, the Pequot Inn is causing me, and my neighbors, undo hardship which affects our quality of 1~. Cfiven its location and its effects, I was wondering if this vent was legal and in conformance with the zonfltg laws of the Town of Southold. This obnoxious odor has curtailed the full enjoyment of my home and property. I request that the zoning and health laws be enforced. There are sections that are rapidly approaching s~'uctaral instability. As this is above the main entrance, if this s~'uctare is declared unsafe the building would have to be declared unsafe and closed. To answer your question about changing the second floor and to allow dining on the second floor and the outside roof, the code does not permit assembly space on the second floor of a frame structure.
