Dear Members of the Board:
It is my understanding that the building department was advised that a site plan is
required for a simple "tenant change"to the above referenced property. There is no legal basis to
impose a site plan review when there is no change to the existing footprint of the building, there
is no change to the existing parking, drainage or open space on this property which has already
been the subject of Planning Board review. Attached is a copy the resolution dated December
12, 2011 at which time the Board undertook a complete review of this improved property.
The proposed tenant Amos Mehringer intends to rent the space previously occupied by
Crystal Clear. In 2011, a full site plan was prepared which included the Hispanic Restaurant,
Zappeta's barber shop (Doctors Office), and the existing tenant(Crystal Clear) shown as "Office
& Storage" located in the rear portion of the property. As the Board is aware, the Planning
Board "site plans the entire property." As is evident from the resolution dated December 12,
2011, the Board reviewed the site plan including all tenant spaces which were expressly
identified in the Board's resolution.
A previous request to the building department for a tenant change, Marilu Mutiservices
Corp. (offering customized personal services and retail to many of the same customers of the
other two businesses)was considered "a change of use"to the "office and storage"previously
reviewed. This tenant was rejected.
However, Amos Mehringer intends to maintain his business office and storage (home
improvement and construction business previously located in his home as a "home occupation")
in the location shown on the site plan as "Office and Storage". Mr. Mehringer's business is a
significantly smaller business than Crystal Clear was at this site in 2011.

We object to the Board's determination that site plan is required when there is both a
Planning Board Resolution and a Site Plan which was reviewed, changes made to the site
plan, conditions imposed and completed. There was a full Health Department review
including all uses on the site, as well as construction of drainage completed. The site plan
reviewed included the Office and Storage use. After careful review and months of revisions,
the Planning Board resolved to "waive" site plan. That was "an action" of the Board. There
has been no change, the Board's 2011 site plan waiver remains a determination which the
property owner and tenants may rely upon and which is binding upon the owner and this Board.
Simply stated,the proposed tenant occupancy change to a previously reviewed site plan does not
trigger site plan review.
Furthermore, the Board's determination is a financial hardship to my client and Mr.
Mehringer. The moratorium was not intended to prevent the normal movement of tenants within
existing spaces or to prevent existing businesses from renting their existing spaces to tenants.
This is a fully developed property which the Town of Southold had the benefit of reviewing for
adequacy of lighting, traffic circulation, drainage, and other standard site plan elements.
The tenant does not intent to make any changes to the space and my client does not
intend to seek a building permit unless requested by the building department. The office has a
bathroom and storage, all as shown on the site plan.
Please advise the building department that, after further review of the record, no site plan
is required.

Dear Mr. Barratt:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on December 12, 2011:
WHEREAS, this site plan is for the proposed modification of 1,293 s.f. of an
existing 2,156 s.f. building for a 16 seat single service restaurant on a .48 acre
parcel in the HB District. The site also contains a second 982 s.f. building currently
used for offices. There are 22 existing parking spaces on site and no more are
proposed; and
WHEREAS, the applicant submitted an application for site plan review on
September 8, 2011; and
WHEREAS, at a Work Session on October 3, 2011, the Planning Board accepted
the application for review with revisions; and
WHEREAS, the Southold Town Planning Board, pursuant to State Environmental
Quality Review (SEAR) 6 NYCRR, Part 617.5 (c) (1) has determined that the
proposed action is a Type 11 Action as it falls within the following description for 6
NYCRR, Part 617.5 (c) (1) "maintenance or repair involving no substantial
changes in an existing structure or facility," and not subject to review under
SEQRA; and

WHEREAS, on October 27, 2011, the Planning Board, pursuant to Southold Town
Code §280-131 C., distributed the application to the required agencies for their
comments; and
WHEREAS, on November 1, 2011, the Mattituck Fire District determined there
was adequate fire protection and emergency access for the site; and
WHEREAS, on November 14, 2011, a public hearing was held and closed by the
Planning Board for the above-referenced site plan; and
WHEREAS, the Southold Town Planning Board, pursuant to §280-133 C of the
Southold Town Code, has the discretion to waive any or all of the requirements in
§280-133 for those applications involving modifications to existing structures with
no substantial change to the existing footprint, where the Planning Board
determines that such modifications will not require significant changes to existing
major site design features necessary to further the objectives set forth in Town
Code §280-129 to maintain public health, safety, and welfare. The Planning Board
has found that this application is eligible for a waiver of site plan because the
footprint of the subject building will not change, the proposed use will be using only
a portion of the building on site and the majority of the proposed alterations will be
to the interior of the structure, the driveway is existing,with no other possible
location, the proposed use will not significantly increase the intensity of the use of
the site as compared to previous uses, and public health, safety and welfare can
be served by the fulfillment of several requirements, listed below in the resolution,
prior to the issuance of a Building Permit; and
WHEREAS, at a Work Session held on November 28, 2011, the Planning Board
found that all applicable requirements of the Site Plan Regulations Article XXIV,
§280 —Site Plan Approval of the Town of Southold may be waived; therefore, be it
RESOLVED, that the Southold Town Planning Board hereby waives the entire site
plan requirement for the Proposed Site Plan Application for"La Gran Villa
Restaurant" referenced above with the following conditions:
1. Install a "No Left Turn" sign at the property line on the east side of the
driveway to ensure safe egress from the site;
2. Control storm water run-off by meeting the minimum requirements of
Chapter 236 of the Southold Town Code;
3. Any exterior lighting that is added after the date of this resolution must
comply with the Town Lighting Code §172; and

4. Prior to the issuance of a Certificate of Occupancy, the Planning Board
requests a courtesy inspection of the site.
