Dear Mr. Fisher:
This letter is in response to a letter addressed to your Department by William Goggins,
Esq, in reference to the above matter. Frankly, I'm quite surprised by the letter in view of the
fact that this matter has been fully discussed with the attorney within the last week.
First of all, Mr. and Mrs. Aebisher tried unsuccessfully, by unlawful means, to prohibit
the adjacent owners from using the 10 foot right of way. After their attorney conferred with
Richard Greenfield, the original developer of the subdivision, and Rudy Bruer, Esq., the
attorney for Mr. Greenfield, the Aebishers' reconsidered their position.
At a special meeting called at Mr. Goggins' office (which Mr, and Mrs. Aebisher failed
to attend), the entire subdivision was reviewed with Mr. Goggins, in fact, that upon
reconsideration, he indicated that it would appear that the owners of Lots 2 and 3 and Mr.
Ross had a 10 foot right of way for ingress and egress over the property and as set forth in
the filed map and the declaration which is contained in the enclosed Deed (highlighted in
yellow).
This is a filed map, as indicated above, which was approved by the Planning Board,
which clearly shows the 10 foot right of way. The respective title companies have insured the
right to use the right of way, and in Mr. and MIS. Aebishers' title policy their title company
excepted the rights of others to use not only the right of way, but the travelled dirt road.
Mr. and Mrs. Aebisher have pending, before your very Department, an open building
permit for the construction of their own new home, and they are using the very same 10 foot
right of way. A building permit'was granted to them and a permit, likewise, has to be
granted to Mr. and Mrs. Stanzoni for the very same reason. Failure to issue a permit to my
client would mean that the permit for Mr. and Mrs. Aebisher would have to be revoked and a
certificate of occupancy denied for their home, which is presently under construction.

What Mr. and Mrs. Aebisher have been unable to do legally, they are attempting to do

that they cannot gain by legal means. This is about as despicable a tactic as I have seen in
many years and should not be condoned.
I have already discussed this matter with the Planning Board, and they have refused to
get involved in this matter. Their position is that if Mr. and Mrs. Aebisher have a grievance,
that they should file the necessary applications and law suits in a court of law where all the
parties, including the title companies, will have an opportunity to address the issues. The
subdivision map as originally approved gave all the owners legal access to their property,
including ingress and egress to their property over the 10 foot right of way. All the code
requires is a minimum amount of access to the property by way of the 25 foot right of way,
which was provided for in the subdivision map and as approved by the Planning Board. From
the point where the 25 foot right of way terminates is not an issue. From that point on,
whether access to the actual home is by way of a 10 foot right of way or a private driveway,
should not be a factor. As long as the legal requirements are met, then a building permit
must be issued.
Incidentally, the 10 foot travelled dirt road and right of way is the only access that Mr.
Ross has to his property on the Sound, and your failure to issue a permit to Mr. and Mrs.
Stanzoni, would in effect be denying Mr. Ross access to his property.
As indicated above, I believe this matter should be addressed in the Courts, and not
through your department. I think their position is without merit, and is not only being made
in bad faith, but contrary to all legal and moral standards that prevail in the community.
I trust that as, if, and when Mr. Stanzoni does make an application for a building
permit, that it will be issued within your normal time frame.

Dear Mr. Fish:
Please be advised that I represent Peter I. Aebisher and Mildred Aebisher
who own property located at SCTM No. 1000-073.00-04.00-002.001. The
above referenced property to the west of Aebisher's is owned by Gary
Stanzoni and Doreen Stanzoni. Upon information and belief, Mr. and Mrs.
Stanzoni are applying for a building permit to erect a one family dwelling.
Upon information and belief, they intend on gaining access to said dwelling
over a ten (10) foot in width easement, which in our opinion, is in direct
violation of Section 280-a of the Town Law as well as other provisienq of the
Town Law.
Before issuing a building permit to Mr. and Mrs. Stanzoni, we request that
the Building Department seek opinions from the Zoning Board of Appeals,

the Planning Board and the Town Attorney.
