Grillo and Others - Fence Application Our File No. 4340 This will confirm that the five ft. height granted by the ZBA in the above matter may not be located closer than 93 ft. from Peconic Bay Boulevard which is the end of the first lot. No fencing was permitted between Peconic Bay Boulevard and the garage existing on the first lot, for visibility. The height is limited to four feet from the garage to the beginning of the second lot, which appears to be about 93 ft. in length. The length for the proposed 5 ft. height extends from the beginning of the second lot, for 340 ft. (415 ft. less the 95+- ft. for the length of the first lot, plus the 15 ft. = 340). If the applicant disagrees with these figures, survey with the actual distances for each right-of-way if one is available. they should provide a lot shown along the I hope that will help to complete your file. Fence height from be~Sf garage existing at the entrance of the subject right-of-way may not be higher than four feet and shall not obstruct existing windows of garage. Any other fencing which does not comply with height requirements must comply with zoning restrictions (unless a new application is filed for consideration and subsequently acted upon by the ZBA). REASONS/FINDINGS: Location of fencing is along the back yard areas of existing neighboring dweliings, although the back yards are technically defined under the present zoning code as front yard areas limited to four ft. height without action by the ZBA. The amount of relief alternatively granted is not substantial being a variance of one foot. The variance is not unreasonable under the circumstances existing in this neighborhood.
