APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
'!pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: Applicant's property is located along Minnehaha
Boulevard at Laughing Waters, Southold. A survey prepared by Stanley J. Isaksen shows
an existing dwelling on'a 10,5610.23 sq. ft. parcel. This property has frontage along
Minnehaha Boulevard oH the east and south property lines.
BASIS OF APPEAL: Article XXIV, Section 100-244B based on the Building Inspector's
October 5, 2000 Notic~ of Disapproval for the reason that the proposed addition will
exceed the code limitation of 20% for lot coverage by all building construction.
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: Proposed 20x20 ft. garage
addition, or 400 sq. ft. of additional lot coverage. The existing garage at the north end of
the dwelling will be converted to additional living area (bedroom).
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
(1) The grant of the are!a variance will not produce an undesirable change in character
of neighborhood or a d'etnment to nearby properties. The increase is only 2.7% of the
overall lot size. An increase of lot coverage at 284 sq. ft. over the allowable 20% will not
be visually noticeable.
(2) The benefit sought [ay the applicant cannot be achieved by some method, feasible for
applicant to pursue, otller than an area variance. It will not be feasible to remove any
existing construction areas for a garage.
(:3) The raquested area! variance is not substantial, represen tha tota) lot size.
(4) lhe proposed garage will not have an adverse effect or impact on the physical or
environmental conditions in tho neighborhood or district. The garage will meet the coda
setback requirements ~nd will be located off the area presently used as a garage
(proposed to be converted for additional bedroom area).
In considering this appliCation, the Board deems the grant of an increased lot coverage for
a garage, as the minimgm necessary and adequate, and at the same time preserves and
protects the character of the neighborhood, and the health, safety, welfare of the
community.
