Cuddy, Esq. 445 Griffing Avenue Riverhead, New York 11901 ' RE: 8 Hands Farm Expedited Site Plan Review-Tables and Chairs for Customers Dear Mr. Cuddy: Danielle Cordier, Esq. and Robert Somers talked to Tom Geppel this afternoon about an appearance ticket dated December 2017 issued by the Town's Ordinance Inspector to the farm operator, which he received at his last Court appearance in April. The ticket relates to the presence of tables and chairs on premises, absent site plan approval. The Department's March 28, 2018 letter to Supervisor Scott Russell mentioned that seating is available in the kitchen as well as on several picnic tables located outside of the building. This seating is for farm yis tors and for the on-site consumption of food by.farm customers. Mr. Geppel informed Department staff that the seating and tables were added to his amended site plan, which is currently under review by the Town. The Department's March 28t" letter to the Town states that.the food truck and kitchen contribute to the preparation„ processing and marketing of crops, livestock and livestock"products grown on the farm. The farm depends upon the direct marketing of its crops/livestock and value-added products to support the agricultural operation. The chairs and tables found inside the building where the kitchen is located and outside of the building adjacent to the food truck, are part of the faun operation's marketing of on-farm product and part of the farm operation for purposes of ANVIL §305-a. The Department'administers AML §305-a to protect a farm operation's ability to sell its products for both off-site and on-site consumption. In the Departments Griew, including the proposed location of on--site food consumption within the streamlined amended site plan would not be unreasonably restrictive. A question has arisen as to the offering of food as part of the farm operation. The Town Code Enforcement officer has served a violation stating that LIV2MAX LLC failed to obtain site plan approval for tables and chairs used for dining purposes as part of the farm stand operation. The farm stand building has been approved. LIV2MAX LLC has made an application for site plan approval, although there is an outstanding Code violation requiring site plan approval. The Planning staff will not process it until they are in receipt of a referral from you. We now enclose a Building Permit application together with a farm site plan. Also, enclosed is a letter dated May 22, 2018 from the NYS Department of Agriculture and Markets by Michael Latham, Director. The Department's conclusion is that the use of the farm stand building, the food truck and tables and chairs inside and outside of the building are part of the farm operation, although it will be subject to a simplified site plan review process for agricultural uses.
