A copy of this determination has also been furnished to the Southold Town Building Department pertaining to your pending building permit application request. However, it will be necessary for you to contact the Building Department (765-1802) to determine what other documentation is required to re-activate your building permit application. BASIS OF APPEAL: November 15, 1995 Building Inspector Action. PROVISIONS APPEALED FROM: (former 1975 zoning) RELIEF REQUESTED: To convert use of principal building from utility stor- age to single-family dwelling use, at variance from former Appeal Nos. 1954 and 2032 which required covenants to be filed in 1975 pertaining to a limitation for a single use of the property (in 1975 was for a large "house" boat moored at the bulkhead.) Property today is nonconforming in total lot area of .626+- acre. MOTION MADE BY: Gerard P. Goebringer SECONDED BY: James Dinizio Jr. ACTION/RESOLUTION ADOPTED: Granted conversion of use from accessory storage with boat mooring to a single-family residence - within the nonconforming footprint established in the existing storage building, without further reduction into the nonconforming yard setbacks (i.e. , bulkhead) . This variance is contingent upon owner receiving Suffolk County Health Department approval for cesspools (septic) system for conversion to a single-family dwelling use, and the agreement by applicant that a "house-type" boat will not be moored at the promises. REASONS/FINDINGS: Property has been used for mooring of an owner's former (house-type) boat which contained living/sleeping quarters, and the existing building was to be used strictly for storage and utilities relative to the use of the large boat moored at the premises. Full ownership of the premises has been conveyed to Helen Rutkowski, who has no intention of mooring a large boat with sleeping/living quarters. The zoning is R-40 Low-Density Residential, and a single-family residence on the land in lieu of a house boat at the bulkhead is a more appropriate land use. Owner prefers to re-build, alter and/or modify existing footprint of storage building as a single-family, two-story residence and all other necessary approvals through the County Health Department, NYS Department of Environmental Conservation, Building Department, etc. must be obtained as required by law before construction activities commence. On July 21, 1996, at your request, an inspection of the building located at 1025 Gull Pond Road in East Marion, New York was conducted to evaluate the foundation and its ability to support the second story addition. The second story addition has been completed. The building was found to be constructed on a monolithic poured concrete foundation and inspection found it to be in acceptable condition. At the time of inspection, an area on the north side of the foundation was excavated to determine the width of the footings. The footing was measured at that location and was found to be in excess of 18 inches. The thickness of the slab was also measured at a hole that was drilled in the slab in the furnace room. The thickness at this location was found to be 11 inches. Reinforcement was also noted in the slab at this location. A load analysis was made based on the results of this inspection and the construction plans fo. the addition. The foundation was assumed to have 18 inch wide footings along its perimeter and the center areas were assumed to be 11 inches thick. The results of this analysis indicated that the second floor addition will increase the loads on the footings and soil a maximum of approximately 20%. This additional loading results in a total soil bearing load of approximately 1,650 pounds per square foot. Based on the results of this analysis, it is my professional opinion that the preexisting foundation and footings are capable of carrying the total weight of the building including the second floor addition. The addition was also found to conform with the requirements of the New York State energy code for additions as specified in section 7810.6. 1 hope this letter satisfies your needs and if you have any additional questions please call me.
