Re: SCTM # 86-6-3.1 Dear Mr. Simon: The following action was taken by the Board of Town Trustees during its regular meeting held on July 27, 1995 regarding the above matter: WHEREAS, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 7, 1995, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 27, 1995, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of ROBERT SIMON to construct a 23' X 32' garage on westerly portion of property with an access bridge across wetland area approx. 10' wide and 50' long raised 8' above wetland supported by concrete piers on each end. As per my 8/26/95 letter to Mr. Thomas Fisher, Southold Town Head Building Inspector, a well driven on a deeded Right-of-Way is illegal, and must be removed. A ROW shared among a community of property owners cannot be used for the purpose of construction, whether it be buildings, cesspools, or well points. - I am insisting that this issue be enforced by our Southold Town Government; any wells or piping installed by Mr. Simon on this ROW have to be removed. 2. There is an additional 40 feet deeded set-back requirement, stated in documentation validated through my attorney as well as in my 8/ 6/95 written correspondence to you. This 40 feet deeded set-back require- ment, which is included in both Mr. Simon's and my property deeds, clearly prohibits the construction of any building or structure on this set-back area. - I am directing that this property deed set-back restriction be aggressively enforced by our Southold Town Government; any attempt by Mr. Simon to construct on this set-back area has to be prohibited. As I have mentioned to you several times in previous correspondence, I dq not intend to finance legal tasks which are the delegated responsibilities of my town government. Your statement in your 9/6/95 letter that I may have persue legal action in courts outside the town of Southold in order to enforce construction/deed violations occurring within the town of Southold is both ludicrous and incorrect. Mr. Wickham, my property taxes being paid to the Town of Southold are to be used to protect my property rights. NU:. Fisher: As you are aware, there is a deeded 30' x 100' right of way separating the properties of Mr. Robert Simon and myself. This ROW extends the entire length of Wood Lane to Indian Neck Lane. This past week, Mr. Simon began driving a well in the middle of this right of way. Construction on this right of way is-illegal. I am requesting that the Town Building Department immediately direct Mr. Simon to remove this well off the right of way. I assume that when you recently renewed Mr. Simon's Building Permit, Mr. Simon was required to submit a detailed property plan survey showing the exact location of and minimum allowed linear separation of his cesspools from his proposed well point. Why, then, is Mr. Simon drilling a well in the middle of a deeded right of way? Did the Town Building Department grant approval for this? Was Suffolk County Health Services Department directed to draw water from this well for the purpose of Mr. Simon obtaining a CO? Edmund J. The reason I am writing this letter as an ordinary citizen is that I am absolutely astonished at the lack of commonsense in both the NYS DEC and Southold Town Board of Trustees in even considering approval of this bridge because the "plans" as submitted by Mr. Simon do not bear the seal of a licensed engineer, do not state the load bearing capacity, nor are there any specifications or plans for the footings for the bridge abutments. Therefore, rather than have what I predict will happen (that the bridge will end up collapsing into the wetlands either due to the weight of vehicles or northeast storms), I was just wondering for the protection of Mr. Simon, his family, and others, whether or not a Building Permit with proper plans and specifications will be required to be obtained from the Southold Town Building Department. I want to thank you for your prompt response to my prior letters of complaint dated May 27 and June 25, 1995, concerning Mr. Simon's house. However, there are several points which I raised in my May 27th letter which I believe have not yet been addressed: 1. The house and cupola may exceed the 35' maximum height as allowed by Town Code, Section 100-30A.3. 2. The deck which is attached to the house may extend over wetlands on his property. 3. A chimney ends below the highest point of the house as presently constructed. I would appreciate you checking into this matter and advising me of your findings on each of these points. If these violations do in fact exist, then I do not understand how your Building Department has allowed work to continue and why Mr. Simon has not been cited for these violations and ordered to stop work. Town Hall Main Road Southold, NY 11971 Gentlemen: It is my understanding that Mr. Robert Simon, homeowner of property bordering my residence, Wood Lane, Peconic, is initiating the filing of building permits and/or variances for the construction/erection of a garage/barn building on his front yard property. Please be informed: * There is a deeded 30 foot ROW + 40 foot setback separating our front yard properties. This setback extends the full length of Mr. Simon's property (100 feet), into the middle of Richmond Creek wetlands. * Mr. Simon's house currently borders on the edge of both the setback and the wetlands. Therefore, for Mr. Simon to build will require a variance to either the wetlands or to the 70 foot setback. * I totally oppose the granting of this variance, for reasons of causing devaluation to my property as well as damage to the bordering wetlands. * I have discussed all of these issues with Mr. Simon no less than three times, during the past 12 months, but apparently Mr. Simon is still intent on pursuing construction. Since I travel frequently, I am unable to consistently review Suffolk Times Legal _ notices regarding granting of building variances. Therefore, I am requesting that my attorney, Richard Lark, please be notified of any pending requests or Town action relating to the above mentioned subject. I am writing this letter to formally complain about Mr. Simon's activities on his property. I understand Mr. Simon got a permit from the Town of Southold on February 14, 1990, to construct a house on his property. It is also my understanding Mr. Simon has never obtained a certificate of occupancy from your department and that in fact his building permit expired on August 14, 1991 and has not been renewed. Be advised that Mr. Simon is presently living in this unfinished house contrary to the rules of the Town of Southold. Also, I am concerned that Mr. Simon has constructed a deck attached to his house over the wetlands on his property. Mr. Simon has also constructed a chimney which ends below the highest point of the house as presently constructed, which could be a fire hazard. 1 believe the height of the house which includes a cupola may exceed the 35' maximum height as allowed by your Town Code. Landward of the 10' above mean sea level elevation contour on a gradual, natural slope. Landward of the topographic crest of a bluff; cliff or dune which is greater than 10' in elevation above mean sea level. Therefore, no permit is required under the Tidal Wetlands Act (Article 25 of the Environmental Conservation Law). Please be advised, however, that no construction, sedimentation or disturbance of any kind may take place seaward of the 10' contour or topographic crest without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation in this area as a result of your project. Such precautions may include providing adequate work area between the 10' contour or topographic crest and the project (i.e. a 15' to 20' wide construction area) or erection of a temporary fence, barrier, or hay bale berm. Please note that any additional work, or modification to the project as described, may require authorization by this Department. Please contact this office if such are contemplated.
