Fisher, Senior Building Inspector FROM: Melissa Spiro, PlannerMSlJS RE: Setbacks for Cluster Developments DATE: May 19, 1995 The Planning Board reviewed your May 17, 1995 memorandum in regard to setbacks for cluster developments at last night's work session. As you are aware, there are some cluster subdivisions for which building setbacks were not specified by the Planning Board at the time it approved the final plats. In order to clarify the building setback requirements for cluster subdivisions without specified building setbacks, the Planning Board has established the following: 1. Cluster subdivisions approved between May. 29, 1973 and January 31, 1983: Yard setbacks may be reduced to fifty (50) percent of minimum required setbacks during that time. 2. Cluster subdivisions approved between February 1, 1983 and January 9, 1989: Yard setbacks may be reduced to thirty (30) percent of minimum required setbacks during that time. 3. Cluster subdivisions approved after January 10, 1989: Must be referred back to the Planning Board. The Planning Board will determine the setbacks allowed for the particular subdivision. The Planning Board established the above mentioned requirements based on the information listed below: A. The cluster development section of the code was added on May 29, 1973. From May 29, 1973, until the code was revised on February 1, 1983, the lot area, width, depth, front yard, rear yard, and side yards in cluster developments were permitted to be reduced to a maximum of fifty percent (50%) of the minimum requirements set forth in the Bulk and Parking Schedule. B. The cluster development section of the code was amended on February 1, 1983. The amendment, which was in effect until January 10, 1989, changed the fifty percent (50%) reduction for lot width, depth, front yard, rear yard and side yards to a maximum reduction of thirty percent (30%) of the minimum requirements set forth in the Bulk and Parking Schedule. C. On January 10, 1989, the cluster development section of the code was revised to allow lot area, width, depth, front yard, rear yard and side yards to be reduced to less than the minimum requirements set forth in the bulk schedule provided that such modification or changes did not result in a greater average density or coverage of dwelling units than permitted in the applicable zoning district. In my correspondence in September I voiced my concern in the possible rain run-off from the building project on "oneysuckle hills. During the rainstorm on Friday, "ctober 6 rain water from the building site flowed down on ou r road causing a lot of damage. See pictures Numbered oo(D . The force of the waters flowing down dug a ravine that got deeper and deeper. lictures~ and V show the ravine at up to 188nches deep. Due to the fact that my property is down hill, I have had some minor problems in the past which have been corrected by the installation of railroad ties to redirect the run offs. The additional rain run offs now caused bjr the building project has made my problem immpossible to live with. To repair the damage caused bSt the storm I was forced to call on Raymond Nine to fill and grade the road, copy of the bill is enclosed. I do not want to be held responsible for~any water run off from the buiding site. I feel that immediate action is called for in redirecting the runoffs. Edwards T Telephone (516) 765-1938 PLANNING BOARD OFFICE TOWN OF SOUTHOLD May 2, 1995€ Mr. Peter Danowski MAY 3 1995 Attorney at Law 616 Roanoke Avenue, Box 779 Riverhead, NY 11901 RE: Approved Major Subdivision Honeysuckle Hills SCTM #1000-99-3-(4.1-4.2) Dear Mr. Danowskl: The following resolution was adopted by the Southold Town Planning Board at a meeting held on May 1, 1995: WHEREAS, Walter Gatz, owner of the original subdivision map known as "Honeysuckle Hills at Mattituck", and the current owner of Lot Number 12 on said subdivision, has requested that the Town Planning Board authorize the filing of an Affidavit of Correction; and WHEREAS, the request for the Affidavit of Correction relates to a reservation for possible future highway dedication at a location on Lot No. 12 on said map; and WHEREAS, this Planning Board has reviewed the request and the records of the Planning Board, and has determined that this reservation is no longer necessary, and the Town does not need the area of Lot Number 12 for present or future highway dedication; NOW, THEREFORE, BE IT RESOLVED that the Planning Board does hereby authorize the filing of an Affidavit of Correction or Amendment removing the reservation for possible future highway dedication from Lot Number 12.
