SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated March 20, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming 7,244.20 square feet, .17 acre, rectangular- shaped parcel located in the R40 Zoning District measures 50 feet along Sigsbee Road, then runs 144.95 feet along a residentially developed lot to the south,then runs 50 feet along a residentially developed lot to the west,then returns to the roadway 144.81 feet along a residentially developed lot to the north. The subject lot is improved with a one story frame dwelling with attached deck and outdoor shower,a concrete driveway and a single-car accessory garage, as shown on the survey prepared by Kenneth M.Woychuk,Licensed Land Surveyor,and last revised March 7,2023. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's January 20, 2023, Amended March 16, 2023 Notice of Disapproval based on an application for a permit to demolish an existing garage,construct a porch addition,and build a new garage at; 1)more than the code permitted maximum lot coverage of 20%; located at 1930 Sigsbee Road,Mattituck,NY. SCTM No. 1000-144-1-14. RELIEF REQUESTED: The applicant requests a variance for alterations and additions to a single-family residence, including the addition of 133 square feet covered front porch, a 72 square feet rear deck and the construction of a new garage measuring 16 feet by 26 feet (416 square feet) that will yield a lot coverage of 23.9% where the code allows a maximum of 20% lot coverage. ADDITIONAL INFORMATION: The applicant provided, as part of their survey, lot calculations illustrating the current lot coverage of 22.7%indicating the existing conditions which include improvements proposed to be removed as part of this application and a tabulation of proposed lot coverage of 23.9%(increase of 1.2%) after the addition of covered front porch, reconfigured rear deck and an enlarged accessory garage with second floor storage space. Page 2,July 20,2023 #7794,Carey SCTM No. 1000-144-1-14 The applicant provided construction drawings including a key, site plan,floor plans, and elevations labeled Al-A13 prepared by Jake Lachapelle, Registered Architect, dated February 26, 2023. The applicant provided the following Certificate of Occupancy for improvements on the parcel: #Z-17822 dated March 9, 1989 covering a one family residence with accessory one car garage #Z-18556 dated November 13, 1989 covering an addition to a one family dwelling No member of the public, or an immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 6, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Sigsbee Road neighborhood consists of smaller residences developed in the early 20`'Century on substantially less than code conforming lots,many of which have been updated and expanded to reflect 21" Century tastes and needs. Based on Board knowledge several homes in the immediate area have been granted similar relief for excessive lot coverage. Open-air front porches are common to older homes in this area(and throughout the Town of Southold)as are rear decks and accessory garages. The existing house will be enhanced by the addition of a front porch and will contribute positively to the streetscape and community character. The demolition of the existing garage and replacement with a new garage with a second-floor storage area,will allow the resident additional storage and the ability to park a car in the modest structure without detrimental consequences. Few area residents or passersby will be able to distinguish the relief requested. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. The applicant's lot is severely encumbered by its small size. Furthermore,the applicant proposes to reduce in size and rebuild the existing rear deck as part of their application in order to enhance their residence (and the streetscape) with a front porch in an attempt to maintain existing lot coverage, while constructing a new functional garage to better accommodate current needs. 3. Town Law X267-b(3)(b)(3). The variance granted herein is not mathematically substantial, representing 1.2% over the existing lot coverage of 22.7%,or 3.9%overall relief from the code. In addition, other immediate properties on Sigsbee Road and the surrounding area have received similar relief in order to accommodate similar improvements as part of updating their residence to accommodate modern needs. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of excessive lot coverage of 23.9% where the code allows a maximum of 20% to accommodate the addition of a covered front porch, rear deck and new two-story garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The front porch is to remain unenclosed,without the benefit of screening or windows of any kind and is to remain unheated and unconditioned. 2. The rear deck cannot be enclosed, roofed over or conditioned in anyway. 3. The accessory garage is not to contain any plumbing other than a single hose spigot for water and only basic electrical for lighting. At no time is the accessory garage to be used for anything other than as a garage for the storage of a car or other common and related items. 4. The second floor of the garage structure is to remain accessible via the proposed exterior stairs ONLY and is not to be insulated or finished in anyway and shall not be conditioned with any heat or cooling source, nor shall it be used for habitation,as an office or workspace or any purpose other than storage and shall remain unconditioned non-habitable space. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Please feel free to call or write me for further details. i We recently received approval from the board for our petition for relief from section 280-124(B); i.e.we asked for and were granted an area variance for the property at 1930 Sigsbee Road, Mattituck. Four conditions were included in the approval letter,the first three of which were discussed in our July 6th hearing and are consistent with the submitted plans.We are asking for reconsideration of a part of the fourth condition,as follows. The fourth condition states the following: "The second floor of the garage structure is to remain accessible via the proposed exterior stairs ONLY and is not to be insulated or finished in anyway and shall not be conditioned with any cooling or heating source, nor shall it be used for habitation, as an office or workspace, or any purpose other than storage and shall remain unconditioned non-habitable space." We only request permission to insulate the building. The submitted drawings show both the garage and the upstairs storage as insulated,finished space. Over the course of a summer or winter day the temperature within a building can swing 50 degrees or more in our climate. Insulation reduces the effects of drastic temperature swings as follows: • Insulating the building reduces thermal stress on the building structure and building materials, lengthening its life. It's long been a cornerstone of building science that thermal cycling (on very hot days as well as freezing days) is destructive to the basic materials we use in construction:wood fiber, cement in concrete,gypsum, paint, etc.The force applied by thermal expansion within a material can be tens of thousands of pounds. Freezing ambient moisture within the building materials is especially destructive.Thermal failure is widespread in unconditioned buildings due to freeze/thaw cycle; any action we can take to reduce its effects are in all our interests. By spending a little money on insulation now the homeowner can see a much extended life for this building. •Insulating the building reduces thermal stress on the items kept within the building. Whether the objects in the building are papers or an automobile, extreme hot and cold cause stress to the material, and shorten their life. •As we move towards an electric vehicle future our garages need to be insulated. Lithium batteries are especially susceptible to hot and cold.They lose capacity at lower temperatures and are more susceptible to fire at higher temperatures. •Insulating the building makes it more comfortable for its users.We don't just make buildings to store things, but also for people to use. Insulation will make this significant investment of money and resources a more comfortable space year round, not just for a few months in the spring and fall. We'd like to understand the board's goal in prohibiting insulation in the conditions of our approval. If we can understand this we may be able to propose a solution that achieves the board's ends as well as our goal of making the best building we can,and follows state code and local ordinance. 1 Please advise how we may address your concerns and move forward.,I'm available any time should you need more detail.
