determination rendered at our August 9, 1995 Regular Meeting
concerning your recent application for a variance.
For convenience purposes, we have forwarded copies of this
determination to the Building Depat'tment for their permanent
reco]~ds.
With reference to the sanitary system, you may wish to
furnish the Health Department with copies of the Town Trustees'
SEQRA determination and permit documents since they are the
"local jurisdiction" in this proiect. The Zoning Board of
Appeals does not have jurisdiction for sanitary systenm.
"Local jurisdiction" is usually the "Board of Town Trustees" for
the sanitary system~ near or adjacent to wetland areas.

During construction, concrete or leaehate shall not escape
or be d.|scharged, nor shall washings from transit mix
trucks, mlxers, or other devices enter tidal wetlands and or
protected buffer areas.
2. Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected buffer areas.
3. There shall be no disturbance to vegetated tidal wetlands O'r'
protected buffer a~eas as a result of th~ permitted
activity.
4. All areas of 'soil disturbance resulting from th~s project
shall be stabilized immediately following project completion
or pr~or to permit expiration, wl~lchever comes first. The
approved methodologies are as follows~
a. stabilization of the entire disturbed area w~th appropriate
vegetation (grasses, etc.). '
b. stiabJl~z(;d as per specifications identified on approved
plaits,
c. Temporarily stabilized with straw or hay mulch or jute
matting or other similar n~tural fiber matting within 1 week
of final ~radtng. Temporary s~abiltzat]on shall be

SPECIAL CONDITIONS
I~or Ar[ids 25 __ {. Tidal WetLand
The storage of construction eq%~tpment and materials stlall be
confined to within the project work site and or upla,~d areas
greater ~han 50 linear feet from the t.[dal wetland boundary.
An area extending from the tidal wetland boundary landward
15' shall be removed of all woodchlps and shall be allowed
to revegeta~e naturally. This 15' buffer shall then become
a permanen~ vegetated buffer zone and there shall be no
disturbance to the vegetation or topography wit, bin that
area.
A row of staked hay bales or approvable erosion control
devices shall be placed at the landward edge of the buffer
area or 15 linear feet from the property line, or as per
NYSDEC approved plan at commencement of regulated activities
and remain .in place until project is completed and all
disturbed areas stabilized with vegetation.
Roof runoff shall be directed to drywells a minimum of t00
feet landward of the tidal wetland boundary for J~,lmed~ate
on-site recharge.
Supplementary Special Conditions (A) through (F) attached
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, 8cenic, end
Recreational Rivers Permits=
A copy of this permit, including all con~itions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous ].ocation at the
work site until all authorized work has been completed.
The perm[tree shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit a~d all its general,
special, and supplementary special conditions. Any
failure to comply precisely with ali of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If a,~y of the permit
conditions are unclear, the permittee shall contact the
Divisfen of Regulatery Affairs at the address 0~ page
one or telephone (516) 444a0365.
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications- The perm[tree is advised that
substantial modification may require submission of a
new application for permit.
Ab least 48 hours 'prier to commencement of the project,
the perm[tree and contractor ,shall sign and return the
top portion of the enclosed" H~tification form
certify;ng that they are fully aware of and understand
all teims and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and return%ed,
along with photographs of the completed work and, if
required, a survey.
For puoJects lnvolvi~lg activities to be undertaken
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator ~n writing at least 48 hours prior to
recom~nencing work in subsequent years.
The gk'anting of this permit does not relieve the pez~n~.ttce

other necessary approval from the Division of La~%d

The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WHEREAS, OSCAR & BETH BLEVINS applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated August
1994

WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,

RESOLVED, that the Board of Trustees approves the application of
OSCAR & BETH BLEVINS to relocate existing house to parallel
property lines in order that a 24' X 24' garage may be built on
the east side of house, a 12' X 33' deck on west side of house,
a full foundation instead of concrete block piers, an
enlargement of existing second floor, and enclose an existing
screened porch. Permit issued under conditions that cesspools
be moved to the front yard near test hole No. 2, as far away
from wetlands as possible, res~e natural vegetated buffer, and
place snow fence along wetland line. Located 640 Haywaters

Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified

Special Condition $6 shall be modified to read: An area
extending from the tidal wetland boundary landward 30' shall
be removed of all woodchips and shall be allowed to
revegetate naturally. This 30' buffer shall then become a
peri, anent vegetated buffer zone and there shall be no
disturbance to the vegetation or topography within that
area.
Special Condition #7 shall be modified to read: A row of
staked hay bales or approvable erosion control devices shall
be placed at the landward edge of the buffer area or 30
linear feet from the property line, or as per NYSDEC
approved plan at commencement of regulated activities and
remain in place until project is completed and all disturbed
areas stabilized with vegetation.
