i. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual.natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system,contains
less than 2/10 of i% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirement.~.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and

DECISION
PETITION NO. 557-94-52
Upon the application of Michael Rethfeld and Ellie Foshay, filed pursuant to 19
NYCRR 450 on December 22, 1994, and upon taking testimony and hearing argument
thereon at a duly noticed hearing before the Hauppauge Uniform Code Regional Board
of Review held at the Hauppauge State Office Building, Veterans Memorial Highway,
Hauppauge, New York, on May ll, 1995, and upon all other papers in this matter, the
Board makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SQUGHT
The petition pertains to the construction of an addition to an existing A1
(one-family) occupancy, to create a building of three stories in height, type 5
(wood frame) construction, approximately 3,612 square ~eet in gross area, at Cresent
Avenue, Fisher's Island, Town of Southold, County of Suffolk, State of New York.
The petitioner is seeking relief from:
9 NYCRR 705.2(b), which prohibits a three story wood frame single-family
dwelling [petitioner wishes to enclose an observation deck, thus creating a
third story].
FIND!NOS OF FACT
This concerns a three-story, wood frame, one-family dwelling adjoining a large
body of water. The owners wish to modify the third level observation deck by
enclosing it.

2. Relief is requested in light of alternatives to strict compliance. Petitioner
offers an electrically wired and interconnected fire- and smoke-detecting system
at the third floor level, connected to a central station. In order to be fully
effective, this system should be installed throughout the building, so if one
alarm sounds, all alarms will sound to signal an emergency situation.
3. The petitioner offers a partial NFPA-13D sprinkler system at the third floor
level. In order to be as safe as the code intends, this sprinkler system should
include protection of the interior stairway, continuous to grade level.
Petitioner subsequently has proposed to install such a sprinkler system.
4. With respect to the required water supply for such a system, petitioner states
that the island has public water service and that if necessary, a water tank
and/or pump system would be engineered to provide for the sprinkler system in
the building.
5. The island has a volunteer fire department.
6. Petitioner offers to install a noncomplying exterior spiral staircase from the
third floor to grade. The stair originally proposed is 18 inches in clear
width, and less than four inches of tread width at it converging end. The code
requires a means of egress to be 2'8" in clear width, when it accesses a
mezzanine, and the petitioner agreed to comply with this width requirement.
7. On the lower floors, the closest windows to the spiral stair are 42 inches away.
Although NFPA-101 prohibits openings within an exterior stair without having
opening protectives, the stair appears to be in the best feasible location.
8. Petitioner states that this stair will only be used for emergency egress,
however, this would be hard to enforce.
9. The proposed alternatives mitigate the concerns for the fire and life safety of
the occupants and users of the building.

10. In the plans and drawings submitted by the petitioner, a fourth level
observation tower is shown. This tower will be removed from the plans and will
not be constructed as part of this project.

Strict compliance with the provisions of the Uniform Fire Prevention and
Building Code would be unnecessary in light of alternatives which ensure the
achievement of the Gode's intended objective or in light of alternatives which,
without a loss in the level of safety, achieve the Code's intended objective mere
efficiently, effectively or economically.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRi{
705.2(b), be and is hereby GRANTED with the following conditions:
1. The third floor observation room and the exit stair to grade shall be
sprinklered, in accordance with NFPA 13D, and the system shall be engineered to
provide adequate water service, as required.
2. The exterior spiral stair, provided as the second means of egress from the third
floor observation room shall comply with NFPA-IO1 requirements.
3. The railings proposed at the deck level will be designed to limit the passage of
a four inch sphere, as proposed by the petitioner.
4. The building shall be equipped with an electrically wired and integrated fire-
and smoke-detecting system, throughout the entire building, connected to a
central station alarm.
5. The building shall oomply with the New York State Uniform Fire Prevention and
Building Code in all other respects.

Furthermore, it should be noted that the decision of this Board is limited to
the specific building and application before it, as contained within the petition,
and should not be interpreted to give implied approval of any general plans or
specifications presented in support of this application.
