BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated March 29, 1995: "Article IIIA, Section 100-30A.3. Proposed construction will have insufficient side yard setback." PROVISIONS APPEALED FROM: Article IIIA, Sections 100-30A.3. RELIEF REQUESTED: Approval of 11" to 15" variance from side yard setback requirement, for a setback at 1319" (13.75 feet) at its closest point for a proposed seven-ft. porch addition at the northerly side of the existing single-family dwelling. Tortora, Member SECONDED BY: Serge Doyen, Jr., Member ACTION/ RESOLUTION ADOPTED: Granted as applied, with a setback at not less than 13 ft. 9 inches (or 13.75 feet) for the proposed porch addition at the north side of the existing dwellinfr. REASONS/FINDINGS: The preexisting single-family dwelling has established conforming side yards presently shown on the November 21, 1991 survey map to be 12.7' and at approximately 21 feet (scaled measurement). A seven-ft. porch is not substantial, and the relief requested at 15 inches from the requirement is not unreasonable. The property is substandard in area at 7500 sq. ft. and lot width (frontage) of 60 feet, in this R-40 Low-Density Residential Zone District. VOTE OF THE BOARD: Ayes: Serge J.
