A. This application must be filled in by typewriter OR ink and submiltte(1 N S4,?~ g- j
inspector with the following: for new building or new use:
1. Final survey of.property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 12 lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
B. For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
" "pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
2. A properly completed application and a consent to inspect signed by the applicant.

BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector on
March 23, 1995. "Proposed 10 ft. high fence will exceed four ft. height of fence
in front yard area."
PROVISIONS APPEALED FROM: Article XXIII, Section 100-231.
RELIEF REQUESTED: Up to 10 ft. maximum height of proposed fence for tennis
court structure in a front yard.

ACTION/ R.ESOLUTION ADOPTED: Granted excessive height of proposed 60' x
120' tennis court fence enclosure not to exceed 10 ft. from ground level, with
the condition there be no lighting, and setbacks from property lines shall be as
applied.
REASONS/ FINDINGS: This property is a waterfront parcel. Section 100-33C
provides that accessory buildings and structures may be located in a front
yard. Accessory buildings are permitted to a height of 18 feet, while fences in
a frontyard are not permitted above four feet in height. The setbacks of the
proposed tennis court and fence enclosure is greater than that required for a
principal building. The variance is not substantial in relation to other
buildings which are permitted in this yard area. No undesirable change is
produced by the proposed fence height in the area designated in this
application. The benefit sought cannot be achieved by some other feasible
method other than an area variance. There will be no adverse effect or impact
on the physical or environmental conditions of the neighborhood.

Gentlemen:
Enclosed is a building permit application for tennis
court and fence. Also enclosed are three copies of the
survey and sketch. The court is proposed at an angle to the
streets so that it will run in a North-South direction.
The structures are permitted in the front yard since
the property is a waterfront parcel and falls with 100-33C.
I believe we have complied with the setbacks from both front
yards.
The application includes a request for a fence
surrounding the court which will be 10 feet in height at the
ends and a portion of the sides, and 5 feet in height along
the central portion of the sides.
Please issue your notice of disapproval as to the
fence.

sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets

c. The work covered by this application may not be commenced before issuance of Building Permit.
