GILBERT Respondents. TO THE SUPREME COURT OF THE STATE OF NEW YORK: The Petition of Thomas Talbot by his attorney, William C. Goggins, respectfully alleges: 1. Your Petitioner resides at and is the owner of real property located at 150 Hobart Road, Southold, County of Suffolk, State of New York 2. That at all times hereinafter mentioned the Respondent, Richard Ward, is the Chairman of the Southold Town Planning Board and a member thereof has sole and complete charge of reviewing files to determine whether site plan approval is needed or required by an applicant. 3. That at all times hereinafter mentioned, the Respondent, Thomas Fisher, is the Building inspector of the Southold Town Building Department, and has sole and complete charge of reviewing files to determine whether a Certificate of Occupancy should be issued, and is charged with the enforcement of the Southold Town Code. 4. That at all times hereinafter mentioned, the Respondent, Shelly's Place, Inc., was and still is a domestic corporation duly organized and existing under and by virtue of the laws of the State of New York. 5. That at all times hereinafter mentioned, the Respondent, Mary E. Gilbert, was and still is a resident of the County of Suffolk, State of New York residing at 3650 Eugene's Road, Cutchogue, New York. 6. That the Respondent, Mary E. Gilbert, is the owner of certain real property located at 55700 Main Road, Southold, New York and further described as SCTM No. 1000-062.00-03.00-007.000. 7. Upon information and belief, the Respondent, Shelly's Place, Inc., has sole use and occupancy of the aforesaid real property pursuant to a written rental agreement with the Respondent, Mary E. Gilbert, and opepates same as a bar/drinking establislnnent. 8. On or about April 25, 1996 the Respondent, Southold Town Building Department, issued a certificate of occupancy to Respondent, Mary E. Gilbert, to renovate and alter existing restaurant as applied for resulting in the premises opening for business under the entity entitled, Shelly's Place, Inc. A copy of which is attached hereto and made a part hereof as Exhibit A. TFIE PREMISES ARE ILLEGALLY OPERATED AS A DRINKING ESTABLISHMENT 9. Upon information and belief, the Respondent, Mary E. Gilbert, operated the premises at the aforesaid property solely as a bar/drinking establishment fi•orn on or about July 2, 1986 to on or about January 1, 1991 . 10. Upon information and belief the subject premises were legally operated as a bar/drinking establishment as a preexisting nonconforming use until on or about January 1 , 1991 when it ceased operation. 11. The subject premises is located in an area zoned as Hamlet Business, which permits restaurant use pursuant to section 100-91 A. (7) of the Southold Town Code, which requires site plan approval. 12. The Hamlet Business zone further permits a drinking establishment, but only by special exception by the Zoning Board of Appeals and subject to site plan approval by the Planning Board pursuant to section 100-91 B. (7) of the Southold Town Code. 13. Upon information and belief, the Respondents, Shelly's Place, Inc. and Mary E. Gilbert, sought to engage the premises as a drinking establishment wider the guise of a purported restaurant use. 14. Upon information and belief, on or about November 24, 1995 the Respondents Planning Board had a private meeting with the Respondents, Mary E. Gilbert and Shelly's Place, Inc., or their attorney regarding waiver of site plan. 15. That by letter dated November 28, 1995, the Respondent, Planning Board, informed the Respondent, Shelly's Place, Inc., that the Planning Board would waive site plan approval conditioned upon receipt of a. letter stating that the business will be operated as a restaurant, and further conditioned on a letter from a nearby merchant stating that overflow off the street parking will be available. 16. In response to the aforesaid Planning Board letter, the attorney for the Respondent, Shelly's Place, Inc., sent a letter dated November 27, 1995 (the day before the Planning Board letter) informing the Planning Board of the Respondents intent to operate the premises as a restaurant. 17. On or about April 1, 1996, and continuing to the present time, the aforesaid premises have been operated as a bar/drinking establishment, not as a restaurant. 18. The Respondent, Mary E. Gilbert, permits the Respondent, Shelly's Place, Inc., to continue to operate the premises as a bar/drinking establishment. 19. The Respondent, Building Department, permits the Respondent, Shelly's Place, Inc., to continue to operate the premises as a bar/drinking establishment. 20. The Respondent, Shelly's Place, Inc., operates the premises as a bar/drinking establishment. 21. The Respondent, Shelly's Place, Inc., operates the bar/drinking establishment causing load music, live entertanunent and other noise to exist at the premises from 8:00 p.m. until 4:00 a.m. consistent with that of a drinking establishment. 22. The Respondent, Shelly's Place, Inc., offers late night happy hours from 9:00 a.m. to midnight as well as happy hours from 4:00 P.M. to 7:00 p.m. consistent with that of a drinking establislunent. 23. That most patrons of the premises arrive and depart to and from the premises between the hours of 9:00 p.m. and 4:30 a.m. 24. That most of the patrons of the premises park vehicles on Hobart Avenue, Southold, New York which is an adjacent neighborhood street where the Petitioner resides with his family, and not at the off street parking area provided by the Respondent, Shelly's Place, Inc. 25. The patrons of the premises urinate on the Petitioners lawn, and on the lawns of the neighboring residential properties in the late evening hours when a restaurant would nonnally be closed, and when a bar/drinking establishment would nonnally engage in operation. 26. The Respondent, Southold Town Building Department, has failed to enforce the Southold Town Code in allowing the premises to be operated as a bar/drinking establislmnent. 27. The Petitioner asks that the Respondent, Shelly's Place, Inc., be prohibited from operating the premises as a bar/drinking establishment. 28. The Petitioner further asks that the Respondent, Southold Town Building Department, be compelled to enforce the Southold Town Code iu not allowing the premises to be operated as a bar/drinking establishment. THE PLANNING BOARD IMPROPERLY WAIVED SITE PLAN APPROVAL THEREBY PREVENTING THE SURROUNDING NEIGHBORS AN OPPORTUNITY TO BE HEARD 29. That section 100-250 of the Southold Town Code provides in pertinent part, " ...any change in use or intensity or use which will affect the characteristics of the site in ten-ns of parking, loading, access, drainage, open, space or utilities will require site plan approval. In all cases where this chapter requires approval of site development plans by'the Planning Board, no building permit shall be issued by the Building inspector except upon authorization of and in conformity with the site plan approval by the planning board and all other public agencies involved." 30. That section 100-252 of the Southold Town Code provides, "In considering and acting upon site development plans, the Planning Board shall take into consideration the public health, safety and welfare, the economic impact and the comfort and convenience of the public in general and the residents of the immediate neighborhood in particular and may prescribe appropriate conditions and safeguards as may be required in order that the result of its action may, to the maximum extent possible, fiirther the expressed intent of this chapter and the accomplisluneut of the following objectives in particular: A. Interior circulation and parking: that adequate off-street parking and loading spaces are provided to satisfy the parking needs of the proposed uses on site and that the interior circulation system is so designed to provide convenient access to such spaces consistent With pedestrian safety, and, further, that loading areas shall not impede tile flow of interior pedestrian and vehicular traffic..." 31 . That section 100-253 A. of the Southold Town Code provides, "No building pennit shall be issued for any structure or building for which use a site plan is pursuant to this chapter 100, until detennhiation has been made by the Planning Board as to whether a site plan or an amendment thereto is required and, if required, that an approved site development plan or approved amendment of any such plan has been secured by the applicant from the Planning Board and presented to the Building Inspector, along with ail necessary approvals and permits as may be required by other public agencies." 32. On or about November 28, 1995, the Respondent, Southold Town Plaiming Board, waived site plan approval conditioned upon request of a letter stating that the business will be operated as a restaurant, and further conditioned upon a letter from a nearby merchant stating that overflow off the street parking will be available. 33. hi response to the aforesaid Plarming Board letter, the attorney for 1 the Respondent, Shelly's Place, Inc., sent a letter dated November 27, 1995 I i (the day before the Planning Board letter) infonning the Planning Board of the Respondents intent to operate the premises as a restaurant. 34. On or about April 12, 1996, the Petitioner learned that the Respondent, Shelly's Place, Inc., was operating the subject premises as a bar/drinking establislnnent. 35. The Respondent, Mary E. Gilbert, remodeled and altered the premises without site plan approval in violation of law. 36. The Respondent, Planning Board, detennination to waive site plan approval was arbitrary, capricious, unreasonable and contrary to law. 37. Upon information and belief, The Respondent, Planning Board, waived site plan approval to prevent the neighbors the ability to voice their concerns in a site review process. 38. Upon information and belief, the Respondent, Planning Board, waived site plan approval to avoid public scrutiny of its arbitrary, capricious and unreasonable decision in waiving the site plan. 39. Upon information and belief the Respondent, Planning Board, waived site plan approval for the Respondents, Shelly's Place, Inc. and Mary E. Gilbert, while directing other applicants in similar situations to proceed through the site plan approval process. 40. Upon information and belief, the Respondent, Planning Board, waived site plan approval without considering the impact upon the residents of the immediate neighborhood. 41 . Upon infonnation and belief, the Respondent, Planning Board, waived site plan approval without considering the impact upon the public health, safety and welfare of the general public and residents of the immediate neighborhood. 41. Upon information and belief, the Respondent, Planning Board, failed to properly address the parking situation at the premises, and failed to provide for handicap parking. 42. Upon information and belief, the Respondent, Planning Board, waived site plan approval because it believes that it is above the law and can arbitrarily and capriciously decide when one applicant must proceed with the timely and costly application procedure of site plan approval to assure public health, safety and welfare, the comfort and convenience of the general public and the residents of the immediate neighborhood as opposed to when another applicant can avoid such application. 43. Upon information and belief, the Respondent, Planning Board, arbitrarily and capriciously chose not to impose the provisions of the Southold Town Code Site plan approval process upon the Respondents, Shelly's Place, Inc. and Mary E. Gilbert. j 44. The Respondent, Building Department, issued a Certificate of Occupancy in violation of law. 7 1 THE PLANNING BOARD ILLEGALLY EXPANDED A NONCONFORMING PRE-EXISTING USE BECAUSE OF IT'S DESIRE TO WAIVE SITE PLAN APPROVAL, 45. On or about November 28, 1995, the Respondent, Southold Town Planning.Board waived site plan approval conditioned upon a letter from a nearby merchant stating that overflow off the street parking will be available. 46. The Planning Board accepted a letter for off site parking where the parking spaces are located diagonally across an intersection from the subject t 4 i I; I premises, and which parking spaces extend to the public highway to the point where half of each parking space is on the public highway. 47. The off-site parking location is also a nonconforming pre-existing use. 48. The Planning Board's approval of the off-site parking is an illegal expansion of a nonconforming pre-existing use. THE PREMISES LOST ITS NONCONFORMING PRE-EXISTING USE AS A DRINKING ESTABLISHMENT 49. The premises has always been operated as a drinking establishment, and it has always enjoyed a pre-existing nonconforming use until it closed for business on or about January 1, 1991. 50. Upon information and belief the liquor license at the premises expired or was surrendered on or about January 1 , 1991 . 51 . Upon information and belief, the Respondent Mary E. Gilbert was issued a liquor license on April 11, 1996. 52. Upon information and belief, the Respondent, Shelly's Place, Inc., opened its business as a drinking establishment operating under Respondent, Mary E. Gilbert's, liquor license. 53. Upon information and belief, there was no liquor license issued to the premises for the period between January 1, 1991 and April 11 , 1996. 54. Upon information and belief, a bar/drinking establishment must have a liquor license to conduct business as a bar/drinking establislmnent and/or restaurant serving alcohol. 55. Gilbert, lost its standing as a non conforming pre-existing lot. 59. By operation of law, the Respondent, Mary E. Gilbert, lost its standing as a non conforming pre-existing building. 60. Upon information and belief, the Respondent, Planning Board, arbitrarily and capriciously chose to ignore the Respondent, Mary E. Gilbert's, loss of its pre-existing nonconforming use at the subject premises by operation of law caused by the discontinuance of the use for a period exceeding two (2) years. 61. My once quiet residential neighborhood is now upset and in disarray because of it. The new"pub","Shelly's Place'at the corner of our one-way street,Hobart Road,in Southold. "Shelly's Place"has been constructed inside of a house. There is very little parking yet hundreds of vehicles are arriving both day and night. The cars are also driving the wrong way on a one way street as they are probably not familiar with this area. The patrons have been loud,appear intoxicated,and "rowdy"in general from what we have witnessed so far. Weekends mean noise until 3 or 4 a.m.for us. I should also mention that I have a two year old son. Not only is the noise disruptive to his sleep but I am now in constant fear for his safety with the amount of traffic at all hours. Myself and the other neighbors are also upset at the way these cars are now parking all over our front lawns. I am asking that you please conduct a police survey so that the highway department is able to construct and install the signs that we now need to help make this situation tolerable. My own home borders the "Shelly's Place"property. I cry when I watch my property values decline. I put my heart and soul not to mention all of our money(we didn't have much) to renovate this old house so that we could remain out here in this community and so our son could grow up here as well. I dont know how the building department ever allowed the permits for something like this when every week it seems standards are stricter and stricter for everyone else.
