TREADWELL SECRETARY OF STATE -------------------------------------------- In the Matter of the Petition of: DECISION Joel Lauber For a Variance to the New York State PETITION NO. 1999-0474 Uniform Fire Prevention & Building Code -------------------------------------------- Upon the application of Joel Lauber, filed pursuant to 19 NYCRR 450 on May 6, 1999, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a new building for C5 (wine sales and tasting) occupancy, one story in height, of type 5b (wood frame) construction, approximately 1,300 square feet in area, located at 45,470 Main Rd., Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 900.2(f)-Table III-900, which requires that in a C5 occupancy having between 31 and 100 occupants that a total of 2 water closets and 2 lavatories are required, and 9 NYCRR 900.2(f)(6), which requires toilet facilities designed for use by more than one person at a time, to be in separate rooms for each sex. [The petitioner requests relief to allow only one single use unisex accessible toilet room for the entire building.] FINDINGS OF FACT 1. Although the square footage in the proposed wine tasting area within the new building would allow for approximately 70 occupants, it will be rare when that many persons wilt be gathered at one time due to the nature of the business. Therefore, the one unisex toilet room should be adequate for the use of this building. 2. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 900.2(f)-Table 111-900 and 900.2(f)(6), to allow only one single use unisex accessible toilet room for the entire building; be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the single use unisex accessible toilet room meet all applicable requirements of CABO/ANSI A117.1 1972 and the Uniform Code. 2. That the building be in compliance with the Uniform Code in all other respects. 3. That the primary use of the building be specifically for wine tasting. This DECISION is issued under 19 NYCRR 450.6. Unless obiected to by the petitioner in a writing received by the Department the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
