A meeting of the Southold Town Conservation Advisory Council was held Wed., June 7,
2023 in the Town Hall Conference Room and via Zoom.

CALL TO ORDER
John Stein called the meeting to order at 4:35PM.
REPORTS
Carol Brown attended the Board of Trustees meeting held on May 17th. The applications
made on behalf the residents of The Strand, East Marion were approved with 15' non-turf
buffers planted with native vegetation, berms, access to the property by barge, and
removal of all sandbags.

Carol attended Volunteer Day at Southold High School on Tues., June 6th. She spoke with
several students who are interested in joining the CAC once a mission statement is
developed.
CLIMATE SMART COMMUNITIES
Anne Murray, Southold Land Use Coordinator for the NFEC requested an update on the
Climate Smart Communities program and offered her assistance with grant applications
protecting the aquifer. Chairman Stein will be inviting Andrew Manitt, Deputy Director of
the Sustainability Institute at Molloy University to a future meeting and will have
information on the town's website by July 15th
Carol Brown gave a brief summary,of the Suffolk Co. Water Quality Protection and
Restoration Program and Land Stewardship Initiatives Funding opportunity entitled
Implement the Southold Town Comprehensive Plan to Conserve and Protect Water
Quality. The Town Board authorized the CAC and the Water Advisory Committee to work
with the NFEC and the GFEE to work with Suffolk County in the identification of
opportunities to sustain potable water.'Councilman Mealy reminded the CAC members to
submit a brief biography to Mark Terry by June 8th
APPROVAL OF MINUTES
Moved by John Stein, seconded by Inga Van Eysden, to Approve the Minutes of May 10,
2023.
RECOMMENDATIONS -WETLAND PERMIT & COASTAL EROSION PERMIT
APPLICATIONS
Moved by John Chandler, seconded by Maggie Merrill, it was
RESOLVED to SUPPORT the application of 220 FLORAL BLVD. CORP. to remove
existing bulkhead. Install 124 If. of new bulkhead in same location in accordance with
detail sheet design. New bulkhead to be raised 6" to be level with the southerly bulkhead.
Establish a 10' wide buffer landward of new bulkhead and filled with sand or stone.

RESOLVED to SUPPORT the application of 67 SOUND CHESHIRE LP to construct a 1'X
35' gravel drive and walk leading to a 29.6'X 27' residence with 9.5'X 5' covered entrance.
AC's to be installed on western side of house. 13'X 7' plunge pool with pool equipment

surrounded by 4'X 16' sound deadening enclosure and pool drywell. Pool to be enclosed
with 123 If. of pool fencing. Proposed 122'X 30' buffer to be established along the northern
property line. 15'X 94' buffer along the eastern property line. 8'X 2' deep drywells in both
the eastern side yard and front yard. House to connect to existing public water and sewer
lines. All trees to be removed will be placed 1:1 with native species.

RESOLVED to SUPPORT the application of ROBERT P. NELSON to dredge existing
bulkhead basin to a -4.0' MLW(approx. 550 cy. of bottomland) while maintaining 10'
separation from existing bulkheads. Ten-year maintenance permit requested.

RESOLVED to SUPPORT the application of BRYAN KARP for the in-place replacement
of 96 If. of existing bulkhead and raise 18" higher, replace and extend existing bulkhead
return to a total of 56 If. and raise 18" higher. Remove of existing concrete.

RESOLVED to SUPPORT the application of CYNTHIA DGHEIM to maintain concrete slab
on-grade, with 100' by 2.16' proposed walk, obtain C.O. for existing house 918 sf.,
concrete covered porch 97 sf., and proposed split-rail fence on the south side.

RESOLVED to SUPPORT the application of BASILICE DM REV. TRUST to remove
existing wood bulkhead (75 If.) and dispose of material offsite. Construct 75 If. of new vinyl
bulkhead in same location with two (2) 10' returns. New bulkhead to be elevated 18"
above existing top of bulkhead. Total new bulkhead will be 95 If. Provide approx. 22 cy. of
clean fill to bring grade to new top of bulkhead. Furnish 10' non-turf buffer landward of
new bulkhead. Plant with permissible vegetation or substitute sand or stone at the owner's
discretion.

RESOLVED to SUPPORT the application of WALTER R. MILLER, JR. to remove existing
steps and wood railing along cleared walking path, and construct a 4'X 64' timber bluff
stairway, consisting of 4'X4' entry steps and 4'X 8' entry landing, 4'X 16' steps, 4'X 4'
landing, 4'X 18' steps, 4'X 4' landing, and 4'X 10' steps; and restore existing pathway and
areas of existing vegetation disturbed or lost during construction with shade tolerant native
vegetation.

RESOLVED to NOT SUPPORT the application of 225 WILLIAMSBURG DRIVE LLC c/o
WILLIAM TOTH to remove and replace 101 If. of deteriorated timber bulkhead in same
location as existing with new vinyl bulkhead including.two 16' vinyl bulkhead,returns on
either side of the existing wood boat ramp which shall be replaced in kind to match
existing dimensions utilizing all untreated timbers; remove existing 3'X 40' long boardwalk
and replace with new 4'X 40' long boardwalk with untreated timber decking; install and
perpetually maintain a 10' wide non-turf buffer along the landward edge of bulkhead;
install'a proposed 14'X 24' in-ground swimming pool in rear yard; install a proposed
24.4'X 34.4' second story directly above footprint of existing one-story residence;

construct proposed 20'X 23.9' single story addition on south side of residence; install
proposed 16'X 20' covered porch with second story balcony above on south side of
residence and replace existing conventional sanitary system with new I/A style sanitary
system in a new landward location.

RESOLVED to SUPPORT the application of GLENNA & DONALD RYAN for a proposed
fixed pier consisting of a fixed 13.5'X 4' ramp and 4'X 55 catwalk leading to a 3'X 14'
aluminum ramp and a 6'X 20' float with two (2) 8" pilings on either end.

closer to the concrete steps to the west, and to retain the Oak tree on the property line.

RESOLVED to NOT SUPPORT the application of WILLIAM JIMENEZ to demolish and
remove the existing residence, wood deck, frame garage, shed and existing septic
system. Construct two-story frame house and garage, front covered porch, breezeway,
rear screen porch, rear steps, proposed barn, concrete aprons, AC & generator on
concrete slabs, proposed IA OWTS with absorption trenches, modified pervious driveway,
and proposed drywells. Approx. 7,200 cf. of earth to be excavated for proposed
improvements. All 7,200 cf. to remain at site for backfill.

RESOLVED to SUPPORT the application of SAMUELS CREDIT SHELTER TRUST to
replace in-kind and location, existing marine infrastructure/boat basin, including bulkhead
and decking.
Located: 155 Fisherman's Beach Road, Cutchogue. SCTM#1 11-1-8.4

The CAC Supports the application, however there is a concern with the stability of the
fence on the east side of the property and recommends the fence posts are replaced.

RESOLVED to SUPPORT the application of NEIL STRONSKI & PATRICIA PEREZ to
remove a 14" dia., 6" dia. and two (2) 12" dia. locust trees at top of bluff. Construct 100 If.
upper retaining wall.with 6' return along northerly property line. Backfill with approx. 30 cy.
of fill from off site. Install 10' non-turf buffer landward of relocated top of bluff as per
Trustee Permit#9488. Plant permissible vegetation in non-turf zone or substitute
stone/sand at owner's discretion. Construct 93 If lower retaining wall with a 12' return
along northern property line. Backfill with approx. 200 cy. of fill. Excavate 12" below top of
bulkhead to retaining wall (90 cy.). Deposit landward of retaining wall. Cover area with one
(1) layer of jute O/E and plant with Cape American beach grass at 1' OC. Place heavy
stone 6-8: as scour pad (2.2 tons) between proposed lower retaining wall and existing
bulkhead with filter fabric underlayment (1065 sf.).

RESOLVED to SUPPORT the application of CHRISTOPHER AUSTIN & ELIZABETH
AUSTIN for the replacement of the existing bulkhead and dock. Proposed 120 If. navy
style vinyl bulkhead to replace existing wood bulkhead and to be raised 18". Proposed 30'
return along western property line, and 20' return along eastern property line. Bulkhead to
be backfilled with 75 cy. of clean fill from an upland source. Proposed 4' wide steps
proposed to beach. Existing dock to be removed and construction of new dock with 4'X
12' thru flow ramp landward of bulkhead, 4' X 91' catwalk with thru flow extending to a 3'X
20' aluminum ramp and 6'X 20' float. Three (3) 10" pilings adjacent to float, two (2) 10"
piles east of float, Dock to have water and electric. Spartina alterniflora plugs to be
planted in front of bulkhead after construction. Any trees removed to be replaced with
native species at a 1 to 1 ratio.

native vegetation, the existing spartina is maintained, and exterior lighting is dark skies
compliant.

RESOLVED to SUPPORT the application of 2740 DEEP HOLE DRIVE LLC to construct
approx. 4,345 sf. partially elevated masonry pool patio (use approx. 102 cy. of on-site
excavation material to achieve proposed patio elevation) upon which will be installed a 5'
high pool enclosure fence, a 10' wide pergola, an outdoor kitchen, and a 3'X 3' shower (to
be connected to a french drain installed around patio, which is to be connected to a
proposed stormwater drainage system located more than 100' from wetlands), all located
at least 100' from wetlands; and install a 3'X 101' stone walkway consisting of 3'X 2'
pavers.,set in sand to existing dock.

Bayberry located seaward of the construction area, are retained.

RESOLVED to NOT SUPPORT the application of CHARLES & SHERRY SOLON for the
construction of a proposed 4'X 54' long fixed pier with steps down to a 4'X 16' long fixed
pier T-section. All decking shall be thru-flow for the entire pier.

The CAC does Not Support the application in accordance with Ch. 275-11 Construction
and Operation Standards.
Prohibited locations and activities.

No new docks will be permitted over vegetated wetlands or such that it causes habitat
fragmentation of vegetated wetlands in the following areas: Downs Creek, Hallocks Bay,
Hashamomuck Creek and Pond, Long Creek (branch of Mattituck Creek, East of Grand
Avenue bridge), Pipe's Cove Creek and West Creek.

John Stein will attend the next Board of Trustees meeting scheduled for Wed., June 14,
2023.
The next meeting of the Conservation Advisory Council will be held on Wed., July 12,
2023 at 4:30PM in the Conference Room.
There being no further business to come before the Council, the meeting was adjourned
at 6:00 PM.
