No. 3621 (from 1987-Gilliland) 1000-33-1-18 Dear Mr. Kane: After discussing your proposal for minor landscaping changes with our assistant, Linda Kowalski, and in reviewing your letter, it is my opinion that the proposed cutting of small trees and brush for landscaping purposes is permitted as long as it is agreeable with the Town Trustees under the Coastal Management Law. Please note, however, that digging or other disruption with equipment into the soil to remove large trees, stumps, or similar growth is not recommended since it may disturb the condition of the bluff and natural growth which presently aids in the prevention of erosion. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) , no permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such precautions may include maintaining an adequate work area between the tidal wetland jurisdictional boundary and your project (i.e. a 15' to 201 wide construction area) or erecting a temporary fence, barrier, or hay bale berm. GILLILAND for Variances to the Zoning Ordinance : (a) Article III , Section 100-32 for permission to con- struct accessory two-car garage in the frontyard area , (b ) Article XI , Section 100-119 . 2 for permission to locate new dwelling with an insufficient setback from bluff/bank along the Long Island Sound. Foliowing deliberations , the Board took the following action : WHEREAS , a public hearing was held and concluded on April 23 , 1987 in the Matter of the Application of MICHAEL S . GILLILAND under Appeal No . 3621 ; and WHEREAS , at said hearing all those who desired to be heard were heard and their testimony recorded ; and WHEREAS , the board has carefully considered all testimony and j documentation submitted concerning this application ; and t WHEREAS , the board members have personally viewed and are familiar with the premises in question , its present zoning , and the surrounding areas ; and WHEREAS , the board made the following findings of fact : 1 . The premises in question is located along the north side of Sound Drive , Greenport , is identified on the Suffolk County Tax Maps as District 1000 , Section 33 , Block 1 , Lot 8 , and is known and referred to as Lot #109 , Map of Eastern Shores , Section Four , filed March 7 , 1966 . 2 . The subject premises consists of a total area of 30 ,984 sq . ft . with frontage along Sound Drive of 100 feet , and average lot depth of 328± feet . The premises is presently vacant and is located in the "A" Residential and Agricultural Zoning Dis- trict . 3 . The relief requested by this application is a setback of not less than 55 feet "from the 45-foot contour line along the i Southold Town Board of Appeals -8- May 11 , 1987 Special Meeting (Appeal No . 3621 - GILLILAND decision , continued : ) ; Long Island Sound Bluff as more particularly shown by sketched survey (amended October 7 , 1986 ) prepared by Roderick VanTuyl , P . C . The distance below the 45 ' contour to the ordinary high- water mark at its closest point is 57± feet . The proposed house location is 125± feet to the ordinary highwater mark at its closest point and. is fairly level , as compared to the remainder of the property. The bluff face and toe appear fairly stable . There is some vegetation on the bluff face . At the toe of the bluf-f and on the beach (north of the 45 ' contour) , there are numerous large boulders aiding in stabilizing the bluff. The lot does contain depressions along the southerly areas . 4 . Article XI , Section 100-119. 2 , subparagraph A[l ] requires all buildings proposed on lots adjacent to the Long Island Sound to be set back not less than one-hundred (100 ) feet from the top of the bluff , or bank . The Board finds that although it may be possible to construct the dwelling with a minimum setback of 100 feet from the top of bluff (without a variance ) , the proposed location is more feasible in light of the above factors . 5 . For the record , it is noted that the dwelling on the easterly parcel (presently of Ehrenreic) is setback 45± feet at its cloest point to the top of bluff/bank as shown by - survey dated January 24 , 1975 . The premises to the west (Lot 108 ) is vacant . In considering this appeal , the Board also finds and determines : (a) the relief requested is substantial in relation to the requirements , being a variance of 45% , or 45 feet ; (b) the placement of the new dwelling at a point not closer than 55 feet from the top of bluff in not unreasonable and will not be detrimental to adjoining properties or change the character of the districts ; (c ) the circumstances of the property are unique ; (d ) the practical difficulties are sufficient to warrant a conditional granting of the variance , as noted below ; (e ) the difficulty cannot be obviated by some method feasible for appellant to pursue other than a variance ; Southold Town Board of Appeals -9- May 11 , 1987 Special Meeting (Appeal No . 3621 - GILLILAND decision , continued : ) (f) the granting of the relief requested is within the spirit and intent of the zoning ordinance and maps ; (g ) in view of the manner in which the difficulties arose and in view of the above factors , the interests of justice would be served by granting the relief, as indicated below. (These include inspections of the soil excavation for the sewage disposal system and inspections of the water supply well,well lateral,public water supply line, disposal system,piping and final grading. Other inspections may be required. Following satisfactory construction and inspections: 1. The applicant must submit 4 prints of an as-built plan (up to and including 11"x17"), by a licensed design professional, of the subject property showing the following: a. the lot location and dimensior1s; b, the lot number(s) and the name of the subdivision, if applicable; c, permanent structures (i.e.,buildings, driveways,walkways, swimming pools, decks,etc.); d. the exact location of the private well, if applicable (give at least 2 dimensions measured from the comers of the building); j e. the exact location of the public water line, if applicable; f. the exact location of the septic tank and leaching pool(s),if applicable, dive 2 dimensions from the building corners to the covers of the septic tank and each leaching pool; g. the exact location of the sewer line from the dwelling to the street; if applicable; and h. have a clear area at least 3"IIx5" for the Department's approval stamp. I 2. The applicant must submit a certificate from the sewage disposal installer attesting that the system has been installed according to the criteria of the Suffolk County Department of Health Services,when applicable. 3. If a well has been installed as the potable water supply,the applicant must submit a current well water analysis (within one year) and a well driller's certificate. If the well or water quality does not confonn to standards,proof of corrective measures will be required. Refer to "Standards and Procedures for Private Water Systems." 4. In those cases where public seers are utilized for the dwelling,the applicant is also to submit one(1) copy of the sewer line inspection approval from the public sewer district. In districts operated by Suffolk County,two (2) copies of Form S-9, duly executed by the Suffolk County Department of Public Works, are required. 5. In those cases in which the installation and connection of the public water service line has not been inspected by the Department of Health Services, a tap letter from the appropriate water company is required.
