Hi Liz:
I wish to amend the removal of the pool from the proposed description.
The existing pool was constructed in 1984 and has a C of O. ( see attached).
It is a salt water pool and there is no drywell. My client would be willing to include
the salt water pool and fence provided the Trustees do not require the installation of
a drywell. If my history is correct,the Trustees did not require a drywell during that
period for a salt water pool. Please advise.

Liz:
I have attached a revised project description in accordance with my client's position in this matter.
Ms. Nasary is troubled that the Board not only wants to include her pool and pool fence within
the description, but now requires a drywell for the pool, whether existing or not.
Our position is the pool and fence have a C of O and thus does not require or need a Trustee permit.
The attached revision removes said pool and fence.The remaining description is detailed in the
Site plan the Board now has before it and no further plans are therefore required.

I have attached a revised project description in accordance with my client's position in this matter.
Ms. Nasary is troubled that the Board not only wants to include her pool and pool fence within
the description, but now requires a drywell for the pool, whether existing or not.
Our position is the pool and fence have a C of 0 and thus does not require or need a Trustee permit.
The attached revision removes said pool and fence.The remaining description is detailed in the
Site plan the Board now has before it and no further plans are therefore required.

the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)
Policy Standards. Based upon the information provided on the LWRP Consistency
Assessment Form submitted to this department, as well as the records available to me, it is
my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6
therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The as-built dock does not comply with the Wetland Permit 1518 issued in
1982.
The remaining as-built structures are recommended as inconsistent.
1. It is further recommended that stormwater capable of entering the
wetland from runoff is addressed. The property slopes towards the
creek.
2. A pool dewatering well should be required.
3. A vegetated buffer is recommended landward of the wetland boundary.
An integrated sand sink is also recommended to help control storm
water.
The applicant fails to prove that the action meets the following requirements § 275-11
Construction and operation standards C. 2 (d) of the Southold Tow Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure,
the Trustees shall consider whether the dock will have any of the following harmful effects:
[1] Whether the dock will impair navigation or be located in areas of high vessel
traffic or vessel congestion;
[2] Whether the dock will unduly interfere with the public use of waterways for
swimming, boating, fishing, shellfishing, waterskiing and other water-dependant
activities;
[5] Whether the dock will cause degradation of surface water quality and natural
resources;
[7] Whether the dock will result in the destruction of or prevent the growth of
vegetated wetlands, seagrasses including eelgrass (Zosters marina) and widgeon
grass (Ruppia maritima) or shellfish;
Catwalk is on or close to grade. The past permit required that the catwalk be
elevated 3' above grade. Flow-through decking was not used.
[8] Whether the dock will unduly restrict tidal flow or water circulation;
[10] Whether the dock will adversely affect views, viewsheds and vistas important to
the community;
Dock appears to extend past the pier line and does not meet Chapter 275
standards.
[11] Whether the cumulative impacts of a residential and commercial dock will
change the waterway or the environment and whether alternate design, construction,
and location of the dock will minimize cumulative impacts.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
