That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. The issues with the written project description are the following: The project description submitted 9/5 has an "L" shaped pool and hot tub with dimensions that do match any of the dimensions on the plans. Also, hot tub dimensions should be noted separately from pool if a wall separates them. Size of newly reconstructed seaward side and side yard landing w/stairs need sizes added. New exterior basement size needs to be added. The issues with the project plans are: The plans submitted 8/31 are not stamped/certified. The current ones can be used for field inspections but stamped/signed plans must be submitted by end of day Friday. Please add the dimensions for: existing front porch, both proposed seaward and side yard landing and steps, What is the structure off of the garage towards pool? Box 1179 Southold, NY 11971 Permit Request for SCTM# 1000-26-2-21 960 Willow Terrace Ln, Orient Dear Trustees: We are the owner residents next door to the property at 960 Willow Terrace Lane (APN #1000-026.00- 02.00-021.000)that is seeking to install a new in-ground pool. As the Trustees consider the permit request (SCTM# 1000-26-2-21), we'd like to provide some additional context for your review. The owners of 960 Willow Terrace Lane("Little Poquatuck, LLC % Parisa Golestaneh") purchased the property on 7/19/21 but have never taken residence. And according to the Daniel Gale Sotheby's Realty website, the property flipped back on the market 7/11/23 with a reference to a "pending permit for a waterfront pool." The permit in question seeks a variance to install an 18'x36' in-ground pool with a depth of 4' to 8'. The pool would be located 40' from the existing bulkhead to the south and 10' from our property line fence to the west. We understand the standard current minimum distance that a pool can be constructed is 100' from the bulkhead. For additional context, our property's pool, is setback 16.5' from the property line fence to the east and 46' from the bulkhead to the south. It's also important to note that our pool was originally permitted in 1973 and subsequently installed in 1990.The current C of O has been in place since 1991. Furthermore, the proposed pool location is adjacent to the primary bedroom of our property with the distance from the house to the pool's edge being less than 25'. Given the proposed 10' setback to our property line, this would not allow for the installation of a reasonable landscape barrier for potentially considerable noise or view liability. In addition to the close proximity of the proposed pool, we would like to point out to the Trustees that we recently replaced our bulkhead in 2022 (NYSDEC Permit#1-4738-00642/000OS), resulting in substantial ground disturbance that renders the adjacent land unsuitable for any further major modification. We hope this additional information gives the Trustees a fuller picture as they consider Little Poquatuck's request for any variances or permits to install a pool at 960 Willow Terrace Lane. In Hurricane Irene, in 2011,waves came over the bulkhead and eroded the slopes and therefore this is very likely to occur again. The proposed pool will be adjacent to an existing pool on the adjoining property, adding additional risk of failure due to erosion during a Hurricane. 2) The homes along this stretch of Willow Terrace Lane all have to be careful not to over-pump our wells during the summer months otherwise our well water becomes overly brackish as salt water penetrates the aquifer. Even assuming(and it is a BIG assumption)that the initial fill is by tanker, pools need constant topping up due to evaporation and this will put further pressure on the aquifer to the detriment of all of us on the street. 3) The current owners of the property have never lived there, and it has been vacant since they acquired it in Aug 2021. The sole reason for their permit application for the pool et al is to increase the value and sellability of the property. Please note, on the same day the permit application notice was posted on the property grounds,the property was also listed for sale and as having an approved remodeling permit and an application for a pool permit. Please find this on Sotheby's website here: 4) Unfortunately,all the points above demonstrate that the mindset of the current owners is that of a "real estate flipper" or short-term speculator and they clearly do not have the long term interests, commitment considerations expected of a homeowner or a good neighbor on this street. Our understanding has always been that construction within 75 feet of a bulkhead required a variance and our hope is that the Trustees will take the above points into consideration when deciding whether to approve a permit for a pool that potentially endangers the environment and will set a dangerous and unfair precedent for others who wish to purchase and flip houses in the neighborhood.
