We previously furnished a copy of this determination to the Building Department as an update to their initial Action of Disapproval and for the pending building permit application file. It is my understanding after speaking with the Building Inspector several days ago that a building permit has now been issued to you. Also, for your information, the Suffolk County Department of Planning has jurisdiction under the County Administrative Code due to the location of your property within 500 of a waterway. BASIS OF APPEAL: Notice of Disapproval issued by the Building Inspector dated 8/29/96. Setback from bulkhead, Section 100-244B, front yard and total side yards. The lot lines for this lot require a waiver or other approval since the deed creating lot 8/12/83 does not conform to minimum lot requirements in Bulk Schedule AA (different than that shown on "ldhp of Willow Terrace, Section One" filed in the Suffolk County Clerk's Office as Map #5407; ref: Nonconforming size setback provisions at 100-244). RELIEF PROVISIONS: Sections 100-239.4B, 100-24A, 100-26, 100-244B. RELIEF REQUESTED: Fifteen ft. from southerly (side) property line, 15 ft. at northerly (side) , 35 feet from the front property line, and 75 feet to the highwater mark (closer at approx. 57 feet when measured from the bulkhead constructed after 1983). Also requested is recognition of the lot as deeded of a similar configuration as that shown on Willow Terrace, Section One, Lot #2 which had received a vacant land certificate of occupancy #Z11710 on June 3, 1983. REASONS/FINDINGS: Town subdivision records show that this is known as Lot #2 on the Map of Willow Terrace, except that the deed conveying the premises in August 1983 shows 96.5 ft. frontage and a slight deviation from the angle of the subdivision lot lines. The lot as deeded consists of the same lot area (22,500 sf) as that shown on the filed map. The dimensional configuration of the parcel lends to the difficulties requested by the variance. The bulkhead setback will be similar to other dwellings fronting along Orient Harbor in this immediate area, as will the front yard setbacks for other buildings. The total side yard reduction requested is from 35 feet to 30 feet, for a variance of five feet. Applicant agrees that there will not be a raised deck between the dwelling and the bulkhead, particularly since alternatively, a ground level patio-deck structure may be authorized by the Trustees (without a further variance). Hands Jr. For a Variance to the New York State PETITION NO. 1998-0780 Uniform Fire Prevention & Building Code ------------------------------------------------------- Upon the application of William A. Hands Jr.,filed pursuant to 19 NYCRR 450 on August 25,1998, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a new residence of an Al(single family dwelling)occupancy, two stories in height , of type 4 (ordinary)construction, approximately 2,800 square feet in area, located at 960 Willow Terrace, Orient, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking relief from: 9 NYCRR 719.2(a)(2),which stipulates that foam plastic insulation,when tested in conformity with Reference Standard RS-8, and having a surface flame-spread rating no greater than 75 and a smoke density rating no greater than 450, is permitted on the interior surface of concrete or masonry walls, provided the foam plastic insulation is protected by a thermal barrier. [The petitioner requests relief to allow foam plastic insulation,when tested in conformity with Reference Standard RS-8, and having a surface flame-spread rating no greater than 75 and a smoke density rating no greater than 450, to be permitted on the interior surface of concrete or masonry walls,without being protected by a thermal barrier.] FINDINGS OF FACT 1. The building that is the subject of this petition is constructed with an expanded polystyrene concrete forming unit which is used to construct a one-piece monolithic concrete wall.The forms remain in place and provide an energy efficient concrete wall which are finished with conventional interior and exterior wall coverings.While the above grade portions of these walls are protected as per the Uniform Code, the petitioner wishes to leave the foam plastic insulation on the interior of the cellar walls uncovered. 2. In 1998, a code amendment was approved to allow foam plastic insulation on the interior surface of concrete or 0 printed on recycled paper Petition No. 0780-98 Page 2 masonry walls without a thermal barrier provided that the material has satisfied the requirements for acceptable performance set forth in UBC Standard 26-3, Room Fire Test Standard for Interior of Foam Plastic Systems, 1994. However as of the date of this decision this amendment has not been published in the Uniform Code. 3. 9 NYCRR 719.2(a)requires that foam plastic insulation when tested in conformity with Reference Standard RS-8, shall have a surface flame-spread rating of no greater than 75 and a smoke density rating of no greater than 450. The specifications provided to this office by the petitioner state that the surface flame-spread rating for the material that is the subject of this petition is 10 and the smoke density rating is less than 300. 4. The specifications for the material that is the subject of this petition states that the total toxicity factors (carbon monoxide, carbon dioxide, and poisonous chemicals)found in the smoke cf burning materials is comparable to that of the smoke from burning red oak. 5. The local Code Enforcement Official has been consulted in this matter and does not object to the granting of a routine variance under the provisions of 19 NYCRR 450.6. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 719.2(a)(2),to permit foam plastic insulation on the interior surface of concrete or masonry walls without being protected by a thermal barrier when tested in conformity with Reference Standard RS-8, and having a surface flame-spread rating no greater than 75 and a smoke density rating no greater than 450, be and is hereby PROPOSED TO BE GRANTED. This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing received by the Department the decision shall become FINAL after fifteen days of receipt of the decision by the parties. (a) Plastic materials shall be classified in accordance with their burning characteristics as determined by fire tests conducted in conformity with reference standards RS 9-1 through RS 9-3 (see section 1250.3 of this code).See also Part 1120 of this code. (b) Plastic materials shall be identified by permanent legible markings on each piece. (c) The requirements of this section are limited to construction regulated by this code and shall not regulate plastic materials as permitted in Articles 9, 10 and 11 of this Subchapter. (d) Plastic materials may be used as a roof over an unenclosed structure located at grade level,provided such roof does not exceed 10 feet in height and 1,000 square feet in area. (e) Plastics for light transmission from artificial lighting equipment are not required to i conform to the flame-spread ratings for interior finish. The applicant is proposing installing the sanitary system less than 150 feet from a private well. Findings and Facts 1. Proposed construction of a single family residence on a 22,500 square foot parcel located on Orient Harbor. 2. Site is in Groundwater Management Zone IV. 3. Public water is not available. A shallow on-site well is proposed. Data available on well depth in the area indicates total depth of 24 feet; static water level at 9 feet with 15 feet of water in well casing. 4. Depth to groundwater is about 9 feet. A septic tank with two leaching pools is proposed. 5. Due to the location on Orient Harbor, and the setback requirements for surface waters, the area available for the well and sanitary system is Iimited. The proposed sanitary system will be less than 150 feet from two neighbors' existing wells and less than 150 feet to the proposed on-site well. 6. STREET & LOCALITY: 960 Willow Terrace Lane, Orient; 1000-26-2-21 DATE OF PUBLIC HEARING: February 23, 1999 FINDINGS OFFACT PROPERTY FACTS/DESCRIPTION: The subject property is located along the easterly side of Willow Terrace Lane in Orient. The premises is improved with a new single-family dwelling. The property is approximately 22,500 sq. ft. in total area with 100 ft. frontage along Willow Terrace Lane. BASIS OF APPEAL: The Building Inspector's December 29, 1998 Notice of Disapproval, under Article III, Section 100-239.46 for an "as built" concrete patio, variably elevated between 5" above ground and 16", located at less than 75 feet from the existing bulkhead. AREA VARIANCE RELIEF REQUESTED: "As built" patio, which requires a building permit due to its elevation above ground (variable between 5" above ground at one end and 16" at the opposite end). The patio is approximately 50 feet from the existing bulkhead and does not extend into the side yard (beyond the sides of the existing dwelling). REASONS FOR BOARD ACTION DESCRIBED BELOW: After considering the testimony presented and personal inspections, the Board makes the following determination: s' s 1) Grant of the alternative area variance will not produce an undesirable change in the character of neighborhood or a detriment to nearby properties because the patio is basically low to the ground. 2) The benefit sought by the applicant cannot be achieved by some method feasible for applicant to pursue, other than an area variance because the code is not clear with respect to the definition of ground level "patio construction," although it is clear that patios do not require building permits. Page 2—Appl. No. 4651(Hands) Regular Meeting—February 23, 1 Southold Town Board of Appeals 3) The requested area variance is not substantial in relation to the code require- ment because the patio is basically low to the ground. 4) There has been no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. In considering this application, the Board deems that the grant of a patio at 5" to 16" elevation above grade to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Dinizio, it was RESOLVED, to GRANT the variance as applied for; and BE IT FURTHER RESOLVED, to clarify the following for Building Department's future interpretation and use under the zoning code regarding patios: The height of a "patio" shall be limited, replacing the lawn mower rule of the Building Department, as a clarification of the definition and exemption for "patio construction" under Article II of the Zoning Code: PATIO: The height shall be limited at zero inches, flush (level) with the ground at one end, and limited to a height of 16 Inches from around level at the opposite end, with at least 50% of the entire structure built below grade.
