No. 4886—GLENN MCNAB STREET & LOCATION: 665 Arrowhead Lane, Peconic 1000-98-3-4.1 (4 and 3 combined) DATE OF PUBLIC HEARING: November 16, 2000 FINDINGS OF FACT PROPERTY FACTS: Applicants are contract vendees of Lots 3 and 4 on the Map of Arrowhead Cove, Peconic, filed June 20, 1963, and will take the two lots as a single parcel measuring 365 feet on Arrowhead Lane, 136 feet deep on the southerly boundary and 118 feet deep on the northerly boundary, with an area of 45,201 sq. ft. The land is undeveloped. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated October 2, 2000, denying a building permit because (1)the front and rear setbacks of the proposed house are both 36 feet whereas Code section 100-30A.3 requires 50 feet, and (2) the proposed garage and pool are located in the side yard, not in the rear yard as required by Code section 100-30A.4. AREA VARIANCE RELIEF REQUESTED: Applicants request a variance authorizing the location of the proposed construction of the house and accessory garage and pool as described above and shown on the Map prepared by Peconic Surveyors, L.S. dated September 25, 2000. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The shape of the subject lot is such that observance of the 50-foot front and rear setback requirements would leave room only for an awkwardly shaped house, wide but shallow in depth. Applicants have developed a plan that takes account of the lot's shape; it includes placing the accessory structures next to the house, rather than in the rear yard, to take advantage of the lot's width. (2) Neighbors to the rear expressed concern over the proposal to build the garage only 30 feet from the property line. The Board understands the neighbors' concerns, but notes that under Code section 100- 33(6)(3), the garage could be built as close as 10 feet from the property line. (3) Because Arrowhead Lane is paved for less than its mapped width, the setback of the proposed house from the pavement will be about 50 feet. The sentiment of neighbors expressed at the hearing leads the Board to believe that it is unlikely that Arrowhead Lane will ever be widened. (4) The action set forth below will enable applicants to build a home that is not inconsistent with the neighborhood, with reasonable setbacks, and will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (5) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (6) The action set forth below is the minimum necessary and adequate to enable applicants to construct a home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. McNab Parcel 1000-98-3-4.1 at Peconic RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Horning, it was RESOLVED, to GRANT a variance for the house as applied for, with setbacks of 36 feet from the front and rear property lines; and further RESOLVED, to GRANT a variance authorizing location of the swimming pool in the side yard as applied for; and further RESOLVED, to DENY the requested variance to locate the garage in the side yard and ALTERNATIVELY to GRANT a variance authorizing location of the garage in the side yard no less than 40 feet from the rear property line and no less than 48 feet from the front property line; Subject to the following CONDITIONS: (1) The pool shall be located between the house and garage as proposed, and shall not extend eastward of the rear wall of the house; (2) Applicant shall plant evergreen screening behind the house and garage, on or near the rear property line, such evergreens to be 3 to 4 feet high, planted approximately 6 feet apart, and continuously maintained; (3) No utilities other than electricity and running water may be installed in the garage, and any shower in the garage shall be designed and located for use as part of a pool changing room; (4) No sleeping shall be permitted at any time in the garage and the Certificate of Occupancy covering the garage shall state that the garage is not habitable space. My family has been here in Peconic for over 55 years and we have seen many disturbing changes during those years, like once beautiful wooded areas and farms being bought up and being over developed. The "garage" is two full floors equaling 2,100 square feet in floor area. In fact it is only about 35% garage — the rest is "studios", "workshops", and a pool cabana. It confirmed my worse fears. I feel that what the McNab's have done is in effect put two houses on the site using a technicality to calling one an accessory to the other. To me this "garage", sitting 30 feet from my backyard, will look and physically have all the attributes of a house. It will detract greatly from my privacy and the enjoyment of my backyard, which in the summer is like my living room. I ask you please to have the McNab's move their garage at least 50 feet from the rear lot line or attach it to their house. I own 680 Smith Road, on a parcel sharing the rear lot line with the McNabs. The garage being proposed is enormous — 1,080 square feet—and placed only 30 feet from, and directly in line with, my back yard. My understanding is that it can be up to 18 feet in height. This "garage" may be larger than my house! When I purchased my house in 1987 I knew that there were lots behind me, but I also knew that a 50-foot rear yard was required thereby protecting my back yard (which is quite small). I have no desire to prevent the McNabs from building their house but with respect to the garage -if the distance between the front yards and rear yards were switched the garage would be 58 feet from my rear lot line. Another possibility is to move the garage 30 feet to the south. Either way my privacy would be protected and my view to the west would remain unobscured by a wall 30 feet long and potentially 18 feet high. I hope that the Appeals Board will consider the impact of the McNab garage on my property in rendering its decision. Sincerely, rn Z4 rrr\\II\J\ Reason for Appeal Continued Zoning Board of Appeals re : Mc Nab Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The subject lots are narrow (only 117 ' ) and become more narrow as the lots approach Indian Neck Lane, the House is only 42 feet in width and will be designed in a "cottage style" with natural materials and beautiful gardens . There is only 36 ' of rear yard which the owners would prefer to maintain as a natural buffer between the existing residences on the private road of the Indian Neck Park subdivision. Three homes abut the rear of the property and the applicants wish to protect their rear neighbor' s privacy. Several lots on Arrowhead Lane are preexisting nonconforming parcels which will not be combined with the adjacent parcel, those lots are permitted a 40 ' setback under our nonconforming lot size of 100-244 . However, in the applicant' s situation the property owners have intentionally merged lot 3 and lot 4 which are two nonconforming lots - the subject property is penalized by the set back requirements of 100-244 . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The house is modest in size the design of the house is intended to create a special garden between the house, pool and garage . Between the house and pool the applicant intends to design a stone patio around the pool with an English garden. The pool and garden will be fenced with hand crafted fence made by Mr. McNabb to protect the garden from the natural habitat which will also enjoy eating the garden if it is not protected (i .e. deer) . The garage is to be used for customary use such as cars, storage, woodworking for the husband, and hobby room for his wife. Mrs McNab does crafts such as special wreaths from the flowers and plants that she grows in the garden. There will be no sleeping quarters and no accessory apartment in the garage . The garage has been positioned with the garage doors in the least intrusive direction, the applicant does not like having garage doors facing the street because it detracts from the character of the house and gardens . A detached garage must obtain a variance since the narrowness of the lot and setback of the house reduces the usefulness of a rear yard The garage and house design have been carefully thought-out to be an asset to the neighborhood and provide an area for the applicant to design a fabulous garden. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The variances are greater than would have been required if the property had been left as two parcels . The total acreage is slightly over one acre but is extremely narrow and long. The rear yard variance becomes greater as the house is pushed away from the front property line . The applicant has placed the house midway on the property to prevent encroaching too far into the rear yard. The front property line actually has an additional 14 feet of land before the road begins . The front yard setback measured from the improved right-of-way to the proposed house will be 50 feet (36 + 14) . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The properties which are located closest to Indian Neck Lane will have similar setback issues because these properties are narrow and cannot be developed as desired without a variance . (See exhibit- tax map highlighted in orange) The smaller lots which have not merged with the adjacent parcel will have an easier time being developed because they will have the benefit of 100-244 . All the parcels which abut the applicant' s lot have 35/36 ' front yard setbacks and accessory structures on or near the property line (see tax map highlighted in blue) 5 . The alleged difficulty was not self-created. The preexisting nonconforming long narrow lot creates the difficulty, the owner is penalized by the merger of two nonconforming parcels without the benefit of 100-244 . 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The applicant wishes to respect the privacy of the abutting property owners along the rear of the property. Her home is close to the applicants and she has used the applicant' s property as a buffer area. The Civic Association president would have the applicant intrude on the abutting rear property owners rather than compromise and permit the house to be located at approximately the same front yard setback that all other nonconforming lot owners will enjoy on he same street . The neighbors have been called and misled to believe that the applicant was building an accessory apartment . The applicant is willing to have the board condition the variances on prohibiting sleeping quarters in the garage. Arrowhead Lane is a beautiful rustic setting, with lots of trees, and has been protected for many years by the 50 foot frontage requirement. Indeed, a couple of years ago we made a variance request for a very minor variance of four feet and most of the other property owners on the street pointed out the importance to the environment of maintaining the 50 foot requirement, and the request was withdrawn. We feel that a varianmce of 14 feet is inappropriate, harmful to the environment of Arrowhead Lane and contrary to the interests of all the residents on Arowhead Lane. We understand that variances are being requested all over the North Fork by property owners attempting to maximize the value of their property to the detriment of the environment of the North Fork. Our perception is this request is no different. Happily, such requests have not been granted and the environment of the North Fork is being preserved. The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your application and hearing must be mailed and shall include a map or sketch showing the new location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, within five (5) days of this letter, including a copy of the plot map of this project, to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. Please submit your Affidavit of Mailing to us after the receipts have been postmarked by the post office. Later, when the green signature cards are returned to you by the Post Office, please mail or deliver them to us. If any signature card is not returned, please advise the Board at the hearing. A town poster is available for posting (by 11/7). When picking up the sign, a $15 check will be requested as a deposit.
