TERMS AND CONDITIONS The Permittee TG3 Holdings LLC residing at 1 Mulford CourtOrient, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. -2. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated.without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. Box 369 Peconic, NY 11958 RE: TG3 HOLDINGS, LLC c/o TIMOTHY QUINN, MEMBER 1 MULFORD COURT, ORIENT SCTM# 1000-14-2-1.6 Dear Ms. Del Vaglio: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, July 19, 2023 regarding the above matter: WHEREAS, Jennifer Del Vaglio on behalf of TG3 HOLDINGS, LLC c/o TIMOTHY QUINN, MEMBER applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated October 12,' 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: establish and perpetually maintain a 15' vegetated non-turf buffer landward of top of bluff; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on July 19, 2023, at which time all interested persons were given an opportunity to be heard, and, 2 WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application of TG3 HOLDINGS, LLC c/o TIMOTHY QUINN, MEMBER to demolish existing 20'x40' vinyl pool and replace in-place with a 20'x40' in-ground gunite pool; demolish existing pool deck and construct a new ±1,600sq.ft. on grade paver pool patio; install new pool enclosure fencing with gates around perimeter of pool patio; relocate existing pool equipment area further landward; and to install a pool drywell for backwash; with the condition to establish and perpetually maintain a 15' vegetated non-turf buffer landward from the top of the bluff; and as depicted on the survey prepared by Kenneth M. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A14-25,and the Suffolk County Department of Planning issued its reply dated December 15, 2022, stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268,Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated February 24, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and therefore INCONSISTENT with the LWRP. It was recommended that the pool be reoriented to increase the distance from the erosion hazard area. The Board agreed that reorienting the pool may create more disturbance to the bluff area,and that the existing footprint should remain. With the conditions imposed herein,the Board now finds the proposed action to be CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION:The subject property is a conforming 253,803.49 square foot parcel located in the Residential R-80 Zoning District. The northerly property line measures 194.78 feet and is adjacent to Long Island Sound. The easterly property line measures 1242.11 feet and the southerly property line measures 219.04 feet and the driveway opens to Mulford Court, the westerly property line measures 12.42.30 feet. The property is improved with a two-story frame residence with an existing 20 ft. x 40 ft. in-ground swimming pool surrounded by a wood deck located at the rear of the residence facing seaward. There is an 80 ft. x 120 ft.tennis court located landward of the residence as shown on the survey map prepared by Kenneth M. Woychuk,LS and dated April 1,2019. BASIS OF APPLICATION: Request for Variance from Article XXII, Sections 280-116A (1) and the Building Inspector's September 12, 2022, Notice of Disapproval based on an application to demolish and reconstruct an accessory in-ground swimming pool; at; 1) located less than the code required 100 feet from the top of the bluff: located at: 1 Mulford Court, Orient,NY. SCTM#1000-14-2-1.6. RELIEF REQUESTED: The applicant requests a variance to demolish and reconstruct a new gunite accessory in- ground swimming pool The proposed construction,on this conforming 253.809.49 square foot parcel located in the Residential R-80 Zoning District, is not permitted pursuant to Article XXII, Section 280-116A(1),which states,"All Page 2,March 16,2023 #7743,Quinn SCTM No. 1000-14-2-1.6 buildings or structures located on lots upon which there exists a bluff landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff." The proposed pool construction has a distance of 60.5 feet from the top of the bluff. Drawings for the 20 ft.by 40 ft.gunite swimming pool were prepared by Havoje Marnika,LPE of HM Engineering and dated November 7,2022. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2,2023,at which time written and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The applicant wishes to demolish the current in-ground vinyl swimming pool which was granted a Certificate of Occupancy April 12, 1991. The applicant proposes to locate a gunite swimming pool in the same footprint location, and replace the old wood deck with new pavers. This seaside neighborhood has many swimming pools located in the rear seaward side. The applicant's property is well screened on both sides and will not disturb neighbors as the old pool was in place since 1991. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Moving the pool to another location further landward or re- orienting the pool to be parallel to the dwelling instead of perpendicular to the dwelling to increase the bluff setback would cause further disturbance to the area near the bluff. Locating the new pool in the same footprint as the existing pool causes the least land disturbance and is more of a maintenance situation for a pool that is in need of replacement after many years. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 39.5%relief from the code. However,the old pool was legally permitted, and the applicant wishes to replace it, in kind,with a new gunite pool. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new in-ground swimming pool while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
