That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as'a result of any operation performed pursuant to this permit, and the said Permittee will, at his or,her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability witl;i respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 36 months,which is considered to be the estimated time required to,complete the work involved, but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. ,That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights,title, or interest in real or personal property held or vested in a person not a party to the permit. ADDENDUM FOR MARY ELIZABETH GUYTON 3331 GRAND AVENUE MATTITUCK, NY SCTM#1000-107-1-11 STATEMENT OF EFFECT The proposed project seeks to replace an existing garage with a new dwelling; replace an existing dwelling with a new pool house; and add a swimming pool. The below described design features and mitigation measures will have beneficial effects on the adjacent tidal wetland ecosystem, due in part to increased dwelling and septic setbacks from wetlands, and potential improvements to groundwater and surface water quality. A) Project Design 1) The existing dwelling, whose habitable footprint is located 51 feet from wetlands, will be removed and replaced with an accessory pool house with the same setback. A new dwelling will be constructed significantly farther landward, partially in place of an existing accessory garage near the road,more than 100 feet from wetlands. As a result, the new dwelling and new pool house each will have a conforming wetlands setback pursuant to Section 275-3(D)(1)(a)(5). The covered porch on the waterside of the pool house will maintain the same wetlands setback as the existing dwelling porch. 2) The proposed swimming pool will be located 76 feet from wetlands, 26 feet more than the setback required pursuant to Section 275-3(1))(1)(a)(5). 3) Town-defined lot coverage would increase only to 6.4% as a result of the project, almost 10,000 sf less than permissible by code. B) Mitigation measures 1) Two existing nonconforming septic systems,the closest component of which is located 79 feet from wetlands, will be replaced with a single low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located 151 feet, or nearly twice the distance, from wetlands. Unlike conventional septic systems, the I/A OWTS is designed to significantly reduce nitrogen loading into the groundwater table and ultimately surface waters. 2) A stormwater drainage system consisting of leaders, gutters, and drywells will be installed to collect and recharge roof runoff from the dwelling, pool house, and sheds; and a dedicated pool drywell will be installed to contain pool backwash. 3) The proposed driveway,parking, and utility areas will be comprised of pervious gravel surfaces, as will the 238 sf patio associated with the garden and the 190 sf patio on the waterside of the new dwelling. 4) To maintain the site in as natural a condition as is reasonable and practicable, a 25,800 sf(0.6 acre) non-turf buffer is proposed adjacent to the wetland areas associated with Mattituck Creek, including the entire embankment and areas adjacent thereto. Within the proposed non-turf buffer, all trees shall be preserved; all pathways are to be comprised of pine needle mulch; and all planting beds are to be comprised of native vegetation. The entire embankment area will remain naturally vegetated and undisturbed. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR MARY ELIZABETH GUYTON 3331 GRAND AVENUE MATTITUCK,NY SCTM#1000-107-1-11 Policies 5 & 6 The proposed project seeks to replace an existing garage with a new dwelling; replace an existing dwelling with a new pool house; and add a swimming pool. Consistent with LWRP Policies 5 & 6,the below described design features and mitigation measures will further the goals of protecting and improving water quality, and protecting the quality and function of the surrounding Mattituck Creek tidal waters and wetland ecosystem, due in part to increased dwelling and septic setbacks from wetlands, and potential improvements to groundwater and surface water quality. A) Project Design 1) The existing dwelling, whose habitable footprint is located 51 feet from wetlands, will be removed and replaced with an accessory pool house with the same setback. A new dwelling will be constructed significantly farther landward, partially in place of an existing accessory garage near the road,more than 100 feet from wetlands. As a result, the new dwelling and new pool house each will have a conforming wetlands setback pursuant to Section 275-3(1))(1)(a)(5). The covered porch on the waterside of the pool house will maintain the same wetlands setback as the existing dwelling porch. 2) The proposed swimming pool will be located 76 feet from wetlands, 26 feet more than the setback required pursuant to Section 275-3(D)(1)(a)(5). 3) Town-defined lot coverage would increase only to 6.4% as a result of the project, almost 10,000 sf less than permissible by code. B) Mitigation measures 1) Two existing nonconforming septic systems,the closest component of which is located 79 feet from wetlands, will be replaced with a single low-nitrogen, innovative/alternative sanitary system (I/A OWTS) located 151 feet, or nearly twice the distance, from wetlands. Unlike conventional septic systems, the I/A OWTS is designed to significantly reduce nitrogen loading into the groundwater table and ultimately surface waters. 2) A stormwater drainage system consisting of leaders, gutters, and drywells will be installed to collect and recharge roof runoff from the dwelling, pool house, and sheds; and a dedicated pool drywell will be installed to contain pool backwash. 3) The proposed driveway,parking, and utility areas will be comprised of pervious gravel surfaces, as will the 238 sf patio associated with the garden and the 190 sf patio on the waterside of the new dwelling. 4) To maintain the site in as natural a condition as is reasonable and practicable, a 25,800 sf(0.6 acre) non-turf buffer is proposed adjacent to the wetland areas associated with Mattituck Creek, including the entire embankment and areas adjacent thereto. Within the proposed non-turf buffer, all trees shall be preserved; all pathways are to be comprised of pine needle mulch; and all planting beds are to be comprised of native vegetation. The entire embankment area will remain undisturbed. And across the entire site, 81 of the 116 trees on the property having a caliper of 8 inches or greater will be preserved (approximately 70 percent). 5) A project limiting fence will be installed to contain site disturbance and potential surface runoff during construction.
