For a Variance to New York State Uniform Fire Prevention and Building Code PETITION NO. 1998-0678 -------------------------------------------------------- Upon the application of Long Creek Homes, Inc., filed pursuant to 19 NYCRR 450 on July 23, 1998, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to a newly constructed Al (one-family dwelling)occupancy, two stories in height, of type 5 construction, approximately 1800 square feet in gross area, located at 1155 Winward Road, Orient Town of Southold, County of Suffolk, State of New York. The petitioner seeking relief from: 9 NYCRR 714.1(c),which requires that an opening for emergency use shall be no higher than 3 feet 6 inches above a finished floor in all above-grade stories, and no higher than 4 feet 6 inches where required in basement and cellar. (The petitioner requests to maintain an existing window in a bedroom on the second floor which is at a height of 4 feet from the finished floor and 3 feet 4 inches from a nailed down step an the floor below the window.] FINDINGS OF FACT 1. The window in question is located in a bedroom on the second level of a single-family dwelling, Al occupancy per 9 NYCRR 701.2. 2. The window is at a height of 4 feet above the finished floor.An eight inch high step is installed on the floor below the window which reduce the height of the window to 3 feet 4 inches. 3. The high ceiling height of the kitchen and dining room adjacent to the bedroom and the garage below the bedroom restrict the height of the window to be in compliance with the Uniform Code. 4. The local authority having jurisdiction has been consulted in this matter and does not object to granting a routine variance under the provisions of 19 NYCRR 450.6. 0 printed on recycled paper ' PETITION NO. 1998-0678 Page 2 CONCLUSION OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 714.1(c), to permit the existing egress window at a height of 4 feet with an 8 inch high nailed down step; be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the building be provided with hardwired smoke-detecting alarm devices installed in conformity with 9 NYCRR 1060.10.The devices shall be provided outside each separate sleeping area, inside each sleeping space and on each floor level as required per 9 NYCRR 721.1. Such devices shall be interconnected so that activation of one device shall cause all devices to sound an alarm. 2. That the existing 8 inch high step shall be maintained and the emergency egress be kept free of obstructions at all times. 3. That the subject building be in compliance with the New York State Uniform Fire Prevention and Building Code in all other respects. This PROPOSED DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writing timely received by the department the decision shall become FINAL after fifteen days of receipt of the decision by the parties.
