C:utc ho/[a>c. \l' I I4)L.3b Tcluphono (1510) 734-0907 • Fn (1510) 734-7079 March 22, 1993 00prj Buccaneer Books Mr. & Mrs. Hennessey UU Depot Lane Cutchogue, NY 11935 Ref; Fire Well requirements Dear Mr. & Mrs. Hennessey, At a special meeting of the Board of Fire Commissioners on March 22, 1993 the following resolution was adopted and a copy sent to the Southold Town Planning Board. 1) Be it resolved to provide adequate fire protection to the building(s) on the subject property, the Board of Fire Commissioners is continuing to recommend that a fire well be installed as outlined in the letter of the Cutchogue Fire District's secretary, dated December 26, 1991, to the Chairman of the Southold Town Planning Board. 2) Be it resolved that it is further recommended that the construction of this fire well is primary for the benefit of the subject property, however due to the residual benefit to the existing structures and buildings in the surrounding neighborhood, that 75% of the cost of this fire well be paid by the applicant and the balance by the fire district. 3) Be it resolved that it is further recommended that as a condition of any site plan approval and Certificate of Occupancy for the presently constructed building that the land owner agree to an annual inspection by the Chief of the Cutchogue Fire Department to determine the type of materials stored in the warehouse so that the fire district will have adequate notice on how to be prepared to handle an emergency at this location. 4) Be it resolved that it is further recommended that prior to the issuance of site plan approval or Certificate of Occupancy to the present building that a restrictive covenant .be recorded in the Suffolk County Clerk's office to reflect the above resolution. The above resolution was made by Commissioner Robert Doroski, seconded by Commissioner John Bakowski and carried by a majority of the Board. RICHARD G.WARD PLANNING BOARD OFFICE TOWN OF SOUTHOLD May 13, 1997 William Kelly Morton Buildings, Inc. 22355 Cox Lane, Unit#4 Cutchogue, NY 11935 Re: Proposed construction of Phase II of site plan for Buccaneer Books, Depot Lane, Cutchogue SCTM# 1000-96-5-8 Dear Mr. Kelly: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, May 12, 1997: WHEREAS, final approval for Phase I of this project was granted on April 6, 1992, for final surveys dated November 6, 1991, and March 16, 1992; and WHEREAS, the approval granted on May 12, 1994 contained a condition that no building permit may be issued for any part of Phase 2 of this approved site plan r until a survey with Health Department approval is received by the Planning Board and the site plan is re-endorsed by the Planning Board Chairman; and WHEREAS, the Planning Board has received a survey last dated May 16, 1991, prepared by Roderick VanTuyl, with a Health Department stamp approved for construction dated April 17,1997; and WHEREAS, the proposed 60' by 100' storage building will be of the same construction and color as the existing building; and WHEREAS, the twenty foot wide buffer zone to the south of the property, shown ,I Page 2 Proposed site plan for Buccaneer Books May 13, 1997 on the approved plan dated March 16, 1992, will be planted with an additional twenty (20) evergreens, six feet in height, staggered ten foot on center; and WHEREAS, any violation of the conditions of this resolution may be grounds for revoking this approval; be it therefore RESOLVED, that the Southold Town Planning Board authorize the Chairman to re-endorse the plans dated November 6, 1991, and March 16, 1992, subject to a one year review from date of building permit. Enclosed please find 2 copies of the re-endorsed site plan; one for your records and one to be given to the Building Department when you apply for your building permit. Dear Mr. Doroski: Let this confirm our receipt of the letter from Matthew J. Martin, Secretary of the Board of Fire Commissioners, dated March 22, 1993. Upon receipt of said letter, we spoke with you on March 24, 1993, at which time it was agreed that you would waive the requirements concerning the filing of Covenants and Restrictions as set forth in paragraph 3 of Mr. Martin's letter. As I indicated to you, we have no objection to our voluntarily permitting the Chief of the Cutchogue Fire Department to make inspections on an annual basis, but we do object to having to have Covenants filed against our property. Let this also confirm that we are enclosing herewith a check in the sum of $ 8017.50 payable to the Cutchogue Fire District representing our 757 share of the cost of installing the fire well, with the remaining 257 to be paid by the Cutchogue FIre District. This check is being sent to you at your request, with the understanding that you will issue to the Planning Board a letter to the effect that the Cutchogue.Fire District will be installing the fire well and that the Planning Board may sign off on the site plan so that we can receive our Certific4te of Occupancy from the Building Dept. It is critical that we obtain our Certific 'te of Occupancy immediately since our present lease is expiring, and we also must close our building loan with our lending institution. e - ;f Let this also confirm that the well will be maintained by the Fire District and that the Fire district will be obtaining all permits required for the installation of the fire well, and that our payment of the above sum of $ 8,017.50 satisfies our obligation concerning the fire well issue.
