meeting held on Monday, May 12, 1997:
WHEREAS, Michael Withers is the owner of the property known and designated
as SCTM# 1000-117-5-24 located on New Suffolk Road in New Suffolk; and
WHEREAS, this site plan is for an addition to a residence and to expand an
existing marina parking lot, and to create a new entrance to the parking area,
separate from the entrance to the residence; and
WHEREAS, the residence and marina would require 12 parking spaces; and
WHEREAS, provision has been made for 12 parking spaces; and'
WHEREAS, an examination has been made of all uses and the existing parking
was determined to be adequate for all uses; and
WHEREAS, the proposed changes of an addition to the residence and ' ·
expansion of the parking lot will not be a more intensive use of this properly; and
WHEREAS, the subject property is 1.62 acres, and has been improved by a pre-
existing 1-1/2 story residence, five floating docks, and one stationary dock; and

WHEREAS, both the residence and the marina are permitted uses in this Marine
I (M~I) zone; and
WHEREAS, any violation of the conditions of this resolution may be grounds for
rescinding this waiver; be it therefore
RESOLVED, that the Southold Town Planning Board grant a waiver of site plan
requirements.

Dear Ms. Steelman:
The following action was taken by the Board of Town Trustees
during its regular meeting held'on April 30, 1997 regarding the
above matter:
WHEREAS, Samuels & Steelman on behalf of MIKE WITHERS applied to
the Southold Town Trustees for a permit under the provisions of
the Wetland~OrdihancO 6f;~tHe Town of. SouthoId, "~5~5I'i~&tion dated
AprJ. 1 4, 1997, and,
WHEREAS, said application was referred to the Sou~hold Town
conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on April 30, 1997, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAs, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
w~.ll not affect the health, safety and general welfare of the
people of the town,
NowTHEREFORE BE IT,
PESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a 950 s.f. one story addition to an existing 1 1/2

Dear Mr. Boufis,
Enclosed please find copy of the Trustees Permit and a Waiver from the
Planning Board for the Withers Residence fence permit. Both the Trustees Permit and
the Waiver are for the fence and renovations to the existing residence. A separate
building permit for the renovations will be submitted in the near future.
At this time we are only requesting the building permit for the fence as per the
pending application. If we can answer any questions, please do not hesitate to call.

Dear Mr. Fish,
As per your request this letter is to confirm that the following changes were made
during construction and were approved by this office:
1. Ridge Beam at Living Room. Substituted 2 - 2x1 0 with 1 - 2x1 O.
2. Hip at Attic Storage. Substituted 2 - 2x1 0 with 1 - 2x1 O.
In addition, I would like to clarify the new and existing construction at the second floor
and the intended use.
The original building was renovated into a residence in the mid seventies. At that time
the second floor was converted into two bedrooms with access via a circular stair. To
enlarge the existing residence, a new addition was planned for the north side of the
existing house. Unfortunately the new addition blocked the only window at the north
bedroom. Options were explored to provide additional window area and to meet egress
requirements. The final design was a cross gable that would open up the existing
ceiling and provide windows on both the west and east side.

The owner decided that the north bedroom would not be required and the space would
best be utilized as a open studio, for "model making", painting, and working on a
computer. During construction, the existing bedroom walls were removed and the
studio was open to the new stair. The existing south bedroom was not renovated
except for a new window.
