APPLICATION FOR CERTIFICATE OF OCCUPANCY
This application must be filled in by typewriter OR ink and submitted to the building
inspector with the following: for new building or new use:
1. Final survey of property with accurate location of all buildings, property lines,
streets, and unusual natural or topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal(S-9 form).
3. Approval of electrical installation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains
less than 2/10 of 1% lead.
5. Commercial building, industrial building, multiple residences and similar buildings
and installations, a certificate of Code Compliance from architect or engineer
responsible for the building.
6. Submit Planning Board Approval of completed site plan requirements.
For existing buildings (prior to April 9, 1957) non-conforming uses, or buildings and
"pre-existing" land uses:
1. Accurate survey of property showing all property lines, streets, building and
unusual natural or topographic features.
~. A properly completed application and a consent to inspect signed by the applicant.
If a Certificate of Occupancy is denied, the Building Inspector shall state the
reasons therefor in writing to the applicant.

Please find enclosed a copy of the board's decision, adopted at
our April 24, 1997 meeting. A copy has today also been furnished
to the Building Inspector's Office as an update to their initial
Action of Disapproval and for use in the open building permit
application file. Please contact the Building Department directly
(765-1802) regarding the pending building permit application to
determine if any other documentation would be needed in their
office.

FINDINGS OF FACT
RELIEF REQUESTED BY APPLICANT: To locate accessory storage
building in a front yard with a setback at 10 ft. from the closest
front property line. The size of the building is proposed at 10' by
16 ft, and a height up to 11 ft. maximum.
PROPERTY DESCRIPTION: This property is located in an R-40
Residential Zone District and is a corner lot with frontage along
Equestrian Avenue of 158.55 ft., along Fox Avenue of 121.58 ft. and
along a private right-of-way of 132+- ft. This lot contains a total
area of .42 of an acre and is improved with a single-family dwelling
and small accessory shed, which shed is also locat~ed in a front yard
pursuant to variance granted by the Board of Appeals September 9,
1975. A sketch of the construction and copy of a survey showing
the location are beth a part of this application.
BASIS OF APPEAL: March 4, 1997 Building Inspector's' Action df
Disapproval, which reads as follows: under Article 100-33 and
100-33B(2) "an accessory building is permitted in the required rear
yard. Considering the lot contains under 20,000 sq. ft., it must be
3 ft. from the rear and side lot lines .... " (if same were situate in
a rear yard location). Note: When located in an area other than
the required rear yard, location and setbacks to be decided by the
Zoning Board of Appeals.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
Supplementing'~he above, it is determined that:
(1) The granting of the area variance will not produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because this building will be located in the middle
of the subject lot and it is not visable from any street;
(2) the benefit sought by the applicant cannot be achieved by some
method, feasible for applicant to pursue, other than an area var{ance
because of the topography of the land, the size of the lot, and the
multiple front yard areas~

(3) the requested area variance is not substantial because of the
minimal size of the shed relative to the large size of the property;
(4) the proposed variance will not have an adverse effect or impact
on the physical or environmental conditions in the neighborhood or
district because this is a small shed for accessory storage use only,
with no increased traffic;
(5) the situation has not been self-created because this is a new
shed, and the zoning code defines the nature of use for each of the
yard areas.
(6) based upon the findings notes above and the unique layout of
the property with frontage along three streets, this is the m~mum
variance necessary and adequate, and preserves and protects the
character of the neighborhood and the health, safety, and welfare of
the community.
RESOLUTION/ACTION ADOPTED APRIL 10, 1997:
On motion by Member Doyen, seconded by Member Dinizio, it was
RESOLVED, to GRANT the relief as applied.
VOTE OF THE BOARD: AYES: Members Doyen, Goehringer, Dinizio,
Tortora, and Ostermann. This resolution was duty adopted by
unanimous vote.

After investigation and%inspectionth~ t~ard finds that

findings of the Board are that this is the most logical
place,~olooate an aC¢esso=ybuilding as the legal backyard
is praoti~ally non-existent and it. will notcut off any-
one's view. The Boa=d'finds that it is an unusual hardship
ko have ~hree front yards. The Board agrees with the
rea~oning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the i~aediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood,and will observe the
sp*~it of the Ordinance.
THEREFORE IT WAS RESOLVED, Caroline A. Talbot, 23 Plymouth
Road, West Hartfordv Connecticut be GRANTED permission to
locate accessory building in front yard area at corners of
Fox Avenue, Equestrian Avenue and Private Road, Fishers Island,
New York, as applied for.
