1 PUBLIC HEARINGS
2 LL CHAPTER 17 CPF AMENDMENTS
3 WHEREAS , there has been presented
4 to the Town Board of the Town of
5 Southold, Suffolk County , New York, on
6 the 23rd day of May, 2023 , a Local Law
7 entitled "A Local Law Amending Chapter
8 17 ( Community Preservation Fund) in
9 Relation to Creating a Community Housing
10 Fund to be Funded by a 0 . 5% Supplemental
11 Real Estate Transfer Tax . "
12 Now, therefore , be it RESOLVED
13 that the Town Board of the Town of
14 Southold will hold a public hearing on
15 the aforesaid Local Law at Southold Town
16 Hall , 53095 Main Road, Southold, New
17 York, on the 6th day of June , 2023 at
18 7 : 00 PM, at which time all interested
19 persons will be given an opportunity to
20 be heard. The proposed Local Law
21 "Amending Chapter 17 ( Community
22 Preservation Fund) in Relation to
23 Creating a Community Housing Fund to be
24 Funded by a 0 . 5% Supplemental Real
25 Estate Transfer Tax . "

1 SUPERVISOR SCOTT RUSSELL : Who
2 would like to address the Town Board on
3 this particular Local Law?
4 MS . PATRICIA MOORE : Patricia
5 Moore , local attorney . I just had that
6 situation occur this week as a matter of
7 fact . The first time buyer , I know that
8 the qualifications to be exempt from the
9 Peconic tax are based on the price of
10 the property and income . But you
11 removed that provision that is one of
12 the Fanny Mae requirements , I don ' t know
13 if that is what we rely on . And if
14 we ' re removing it , why? First time
15 buyer is usually scraping --
16 SUPERVISOR SCOTT RUSSELL : I was
17 actually wondering the same thing
18 because I thought we were raising the
19 purchase price without -- because the
20 home -- I thought we were raising that?
21 COUNCILMAN GREG DOROSKI : Yes .
22 This is just the mechanism in the way
23 that we ' re going to do it . Actually , it
24 really shouldn ' t be in the Town Code
25 because it ' s a State tax . So in order

1 for us to do that , it ' s cleaner for us
2 to have -- and I guess this is a matter
3 of sequence in what we ' re looking to do .
4 We had a number of people reach out to
5 us . And the Community Housing Plan
6 Board made this recommendation to the
7 Town Board to actually raise the limit
8 because when you look at the stock of
9 housing in Southold Town , there is not
10 really any inventory in that range . And
11 when you look at what they ' re allowed to
12 do in Southampton, where I believe it ' s
13 100% of the limit and East Hampton is
14 120% , we felt like we at least wanted to
15 get to a 100% of what that limit is ,
16 just to reflect what the inventory is .
17 And this was the cleanest mechanism to
18 do it . To remove it from the code as
19 Step 1 . And then petition our State
20 representatives to make the enabling
21 legislation . So as it stands right now,
22 it ' s still -- I believe 80% . That still
23 goes .
24 MS . PATRICIA MOORE : Even though
25 it ' s removed from the code?

1 COUNCILWOMAN JILL DOHERTY : Yes .
2 COUNCILMAN GREG DOROSKI : Because
3 it ' s in the State .
4 COUNCILWOMAN JILL DOHERTY : And
5 it ' s not going to be done this session .
6 So that won ' t happen till next session .
7 SUPERVISOR SCOTT RUSSELL : So we
8 won ' t be able to raise the limit?
9 COUNCILWOMAN JILL DOHERTY :
10 Probably not until next year until the
11 State changes it .
12 MS . PATRICIA MOORE : That is too
13 bad because I actually have a client who
14 could benefit from it . And the
15 limitation, it was $650 or something
16 like that . And I think she looked
17 around and the lowest price was in the
18 7 ' s .
19 COUNCILMAN GREG DOROSKI : And that
20 was the intent here . What is kind of a
21 shame here , is that the legislative
22 session and the State Assembly where
23 this needs to go ends on the 7th I
24 believe . So we ' re kind of getting our
25 ducks in a row on the local level and

1 you know, as soon as the next session
2 opens , we ' re going to get it removed .
3 We have spoken with our State
4 representatives and they ' re very open to
5 changing it . Just to bring it on par
6 with reality .
7 MS . PATRICIA MOORE : So we ' re
8 keeping it?
9 COUNCILMAN GREG DOROSKI : Yes .
10 It ' s still good .
11 COUNCILWOMAN JILL DOHERTY : The
12 State has to do a bill and we ' re hoping
13 that bill gets done at the beginning of
14 the session and not at the end .
15 SUPERVISOR SCOTT RUSSELL : What is
16 the current limit?
17 MS . PATRICIA MOORE : It was in the
18 six ' s . Do you know what that increase
19 will be?
20 COUNCILMAN GREG DOROSKI : I
21 believe it ' s $725 . It ' s not a huge
22 increase .
23 MR. KEVIN MEYERS : It actually
24 makes a big difference . My client would
25 qualify .

2 there is not going to be -- it ' s going
3 to be from the date that it passes .
4 MS . PATRICIA MOORE : Thank you for

9 Southold will hold a public hearing on
10 the aforesaid Local Law at the Southold
11 Town Hall , 53095 Main Road, Southold,

1 the applicant . This is 4 . 72 acre parcel
2 that has received conservation
3 subdivision preliminary approval or
4 conditioning approval . And we ' re in the
5 process of getting Health Department .

2 SUPERVISOR SCOTT RUSSELL : That
3 concludes the business of the agenda . I
4 would invite anybody that would like to
5 comment , to please feel free .
6 MS . ELLEN ZIMMERMAN : Supervisor
7 Russell and Town Board Members . My name
8 is Ellen Zimmerman and I represent the
9 North Fork Civics . With the creation of
10 a Community Housing Fund at last
11 November ' s election was an important
12 step towards increasing Affordable
13 Housing opportunities in the Town of
14 Southold. The Community Housing Fund
15 Advisory Board was appointed to draft a
16 recommended Housing Plan and has worked
17 diligently to produce substantive policy
18 blueprint for our Town Housing Program.
19 While there may be different views on
20 the details of the Housing Plan ' s
21 Program, there are clear guidelines and
22 priorities for how the Housing Fund
23 resources can be used, leveraged and
24 spent to increase Affordable Housing .
25 We commend the Town Board for

1 expeditiously holding meetings
2 throughout the Town in June and
3 ( inaudible ) any Board amendment ' s prior
4 to a hearing and adoption . We agree
5 with the recommendations of this plan to
6 establish a Housing Department and to
7 have staff dedicated solely to the
8 implementation -- to implementing the
9 plan and coordinating with existing Town
10 agencies . As representative ' s of the
11 Town Civic Organizations , we appreciate
12 the Town Board ' s effort to address the
13 issues of Affordable Housing . We offer
14 continuing support to maintain and
15 increasing housing opportunities in our
16 community . We urge you to prioritize
17 the adoption of the Community Housing
18 Plan and establish the staff capability .

22 COUNCILWOMAN JILL DOHERTY : Since
23 you brought up the Housing Plan, if I
24 may share the dates of the June
25 Informational Meetings . Tomorrow night ,

1 June 7th, from 6 : 00 to 7 : 30 we ' re having
2 an informational meeting on the Housing
3 Plan at Southold Recreation Center at
4 970 Peconic Lane in Peconic . All our
5 welcome . On June 15th, from 6 : 00 to
6 7 : 30 P .M. , we ' re having the meeting at
7 TASK, here on the Main Road at Southold .
8 And that will also be in Spanish . On
9 June 20th from 6 : 00 to 7 : 30 at Floyd
10 Memorial Library on 539 First Street in
11 Greenport , that will also be in Spanish ,
12 besides English . On June 22nd, from
13 5 : 00 to 6 : 30 , we ' re having a Zoom with
14 the Fisher ' s Island constituents . All
15 are welcome to join that Zoom. That
16 link will be on the Town ' s website . And
17 June 27th , we have from 5 : 00 to 6 : 30 at
18 Mattituck Laurel Library on Main Road in
19 Mattituck . And we also are having some
20 -- looking into some day meetings at the
21 Senior Center in Mattituck and maybe at
22 Peconic Landing in Greenport . Those
23 will be determined later .
24 SUPERVISOR SCOTT RUSSELL : We will
25 work with Jackie Martinez who works the

1 Human Resource Center in Mattituck to
2 create a series of meetings and
3 educational forums . It ' s an excellent
4 opportunity to seniors to certainly
5 maintain their own home . It gives them
6 an opportunity to age in place , if they
7 need that source of income . They will
8 be able to maintain that property . So
9 there is some pretty exciting
10 opportunities for seniors , as well as ,
11 for everyone .
12 COUNCILWOMAN JILL DOHERTY : It ' s
13 an education component of what this plan
14 is and what the future of the Town is
15 with this money and the transfer tax can
16 do for us . And also to have people read
17 through the plan and give us their
18 expertise . So we can make the best plan
19 we can .
20 SUPERVISOR SCOTT RUSSELL : Who
21 else would like to address the Town
22 Board on any particular --
23 MR. ERIC MCCLURE : Good evening .
24 I am Eric McClure , in Mattituck. I wish
25 1 was here to discuss something other

1 than what I am usually here to discuss .
2 Unfortunately that is not the case . I
3 am here to talk about the noise from
4 Strong ' s Water Club . And they have
5 fired up their Spring Summer Season with
6 Live Music . And I wish I could say that
7 they have taken into account any of the
8 feedback that they have gotten from the
9 Board last year , but apparently had not .
10 This past weekend was pretty loud . I
11 have samples if anyone would like to
12 hear them. Hitting 70 decibel ' s from
13 across the water . I have reached out to
14 -- one of the liaison person who is
15 there , they call it , Friday , to say it ' s
16 pretty loud. Can you ask them to turn
17 it down? She said it would . It didn ' t
18 really seem any different from the first
19 set to the second set . The music mixes
20 were off . So you get the drum and the
21 snare and bass . Same thing on Saturday .
22 Same exact issue . Loud and the base .
23 Still can hear though the windows . A
24 couple of weeks ago, I think the second
25 weekend in May, there was somebody on a

1 boat playing very loud music until 11 : 30
2 at night . I reached out and said they
3 would have a manager try and do
4 something . Although they have a whole
5 set of rules that people agree to when
6 they come in , transient boaters come in
7 for the weekend, they don ' t follow those
8 rules . So again, I am asking the Board
9 for help . I really -- it has gone on
10 for a very long time and have not had --
11 I did file Code Complaint on Friday
12 night . Just so it would be on record.
13 Pretty much -- it varies by band. Some
14 of the bands are quieter . Some are much
15 louder . But really, every Friday and
16 Saturday nights , they ' re really pushing
17 the limits on the code . Which I think
18 the Supervisor in the past has
19 acknowledged that the code may be
20 insufficient for situations like ours .
21 Sound conducting qualities .
22 COUNCILWOMAN JILL DOHERTY : So I
23 had a conversation yesterday with Town
24 Attorney Paul DeChance . And I have not
25 reached out but we talked about that I

1 wanted to reach out to Mr . Strong and
2 ask him to come in so we can have a
3 meeting and have a discussion with some
4 solutions . So you know, a compromise ,
5 that he can still do some music , but the
6 neighborhood can have some peace .
7 MR. ERIC MCCLURE : That would be
8 great .
9 COUNCILWOMAN JILL DOHERTY : I
10 don ' t have the answers but I -- it ' s on
11 the top of my mind and I am going to
12 work towards something .
13 MR. ERIC MCCLURE : I appreciate
14 it . I appreciate the concern and I hope
15 they will be able to come to some type
16 of resolution that they can conduct
17 their business in a positive way .

19 keep in touch with you once we know --

21 great . I would love to be here to talk
22 about other things that are important
23 and important things going on in the
24 Town . Thank you .
