(631) 765-1809 Southold Town Clerk FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF JUNE 15, 2023 ZBA FILE: 47784 NAME OF APPLICANT: Nora Tuthill Glueck PROPERTY LOCATION: 1400 Old Harbor Road(Adj. to Cutchogue Harbor), New Suffolk,NY S CTM: 1000-117-5-14,1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated February 28, 2023 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 22, 2023. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department,as well as the records available, it is recommended that the proposed action relative to setback relief is EXEMPT from Coastal Consistency Review and that the proposed action relative to an `as-built' shed is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However,the conditions imposed in this decision and legalizing the `as-built' shed will deem the action LWRP CONSISTENT. PROPERTY FACTS/DESCRIPTION: The subject, irregular-shaped, 34,913.76 square feet, .802 acre waterfront parcel located in the R-40 Zoning District measures 232.62 feet along Old Harbor Road(commencing at the apparent high water mark at Cutchogue Harbor), then runs southwest 100.67 feet along a residentially developed lot to the north, then follows bulkheading along a canal leading to School House Creek 3.66 feet, 4.3 feet, 105.08 feet, and continues along the tie line at the high water mark 100.88 feet, 18.03 feet, 9.12 feet and continues northeast along a residentially developed lot to south, 33.3 feet, 62.04 feet, 38.67 feet, and 103.22 feet to a bulkhead at Cutchogue Harbor measuring 64.43 feet to the roadway. 15 feet wide right of way bisects the property and runs from Old Harbor Road southwest allowing access to the neighboring waterfront residence,adjacent to the site's southern lot line. The subject parcel is improved with one-story wood-frame building (subject of this application) with an attached harborside porch and wooden deck, a small wood deck, a lengthy wood dock extending into Cutchogue Harbor, a wood dock with attached floating ramp and multi-slip dock on the canal which leads to School House Creek, and a small frame shed as shown on an un-stamped survey prepared by Nathan Taft Corwin, III, licensed Land Surveyor and dated May 3,2001. Page 2,June 15,2023 #7784,Glueck SCTM No. 1000-117-5-14.1 BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's December 2, 2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to a pre-existing seasonal yacht club, and to legalize an"as built" accessory shed at; 1) proposed construction located less than the code required minimum rear yard setback of 50 feet; 2) proposed construction located less than the code required minimum side yard setback of 15 feet; 3) as-built accessory shed located in the non-permitted side yard; located at 1400 Old Harbor Road(Adj. to Cutchogue Harbor),New Suffolk NY. SCTM No. 1000-117-5-14.1. RELIEF REQUESTED: The applicant requests three (3) variances for additions and alterations to an existing structure and to legalize the placement of an `as-built' accessory shed located in a side yard where the code requires a minimum side yard setback of 15 feet and a minimum rear yard setback of 50 feet for the principal structure and accessory structures to be located in the rear yard or in the case of waterfront parcels, the front yard provided the accessory structure meets the minimum front yard setback. When completed,the principal structure will maintain a side yard setback of 11.10 feet and a rear yard setback of 11.3 feet. Additionally,the `as-built' shed will be located in the side yard with a side yard setback of 6.5 feet,where a minimum of 10 feet is required by code. ADDITIONAL INFORMATION: The applicant has an open building permit,#48635,dated December 21,2022 for legalization of"as-built"bathrooms to an existing seasonal yacht club. Town of Southold Board of Trustee's approval for the action was granted on April 15, 2022. The applicant provided a multi-page document labeled "Permit Supplement" which outlines the history of the Old Cove Yacht Club(built prior to the adoption of zoning), its organization as a recreational membership club primarily for children, and information relative to the proposed project, highlighting the need for structural repairs including: "The clubhouse's roof and deck supports have deteriorated to the point of failure. As part of the proposed project the roof and deck supports will be removed, along with the existing patio; following the removal, a new patio, deck (including built in benches),deck supports,and roof will be rebuilt within the current footprint. The proposed project will reduce the total area of deck from 410 square feet to 60 square feet and increase the area of pavers on grade from 370 square feet to 715 square feet. As part of the proposed project the applicant seeks a Trustee's Wetland permit for the clubhouse and `spar' shed, and a Certificate of Occupancy for the clubhouse and accessory structures. The `Spar' shed is used for storage of sailing equipment. There will be no expansion of the structure or of the use as a result of the repairs. No member of the public or immediate neighbor spoke in favor of or against this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 1,2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-bQ(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The main building was constructed in its current location pre- zoning(adopted in 1957) and has operated continuously in its current use since that time. The building's scale and character is similar to surrounding buildings and as a waterfront structure supporting a junior sailing program, the facility is consistent with the overall character of New Suffolk and has contributed to and defined the community's character. Furthermore, the `spar' shed is a small wooden structure that matches the main building in design and Page 3,June 15,2023 #7784,Glueck SCTM No. 1000-117-5-14.1 color. Sheds are a common accessory structure throughout New Suffolk and the Town of Southold in general. Mature landscaping partially obscures the shed from the roadway. Proposed building repairs will enhance the character without infringing on an existing footprint. Few people, pedestrians or those using the roadway or waterfront will be able to discern the relief requested in this application, which will preserve a water dependent use within a waterfront community. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue,other than an area variance. The site is used to support a seasonal junior sailing program in the summer months geared towards children. Altering or relocating the existing structure to meet setback requirements would interfere with the existing building and the lot's small size and disrupt the programming and use of the lawn area where sails are laid out to dry and lessons taught. Likewise, as a result of the lot's small size,there is no alternative location to place a shed for the storage of sailing equipment for the students use and benefit. 3. Town Law V67-b(3)(bM(3). The variances granted herein are mathematically substantial,representing 26%relief _ from the code relative to a reduced side yard setback for the principal structure, 77.4% relief from the code relative to a reduced rear yard setback for the principal structure, and 100% relief from the code relative to the placement of an accessory structure in a side yard. However,the main structure(clubhouse)was constructed in its present location prior to 1957 and has not presented any issues with its pre-existing setbacks. Relative to the small `spar' shed, it is within the character of the community and is partially blocked from view by mature landscaping. While the applicant could relocate it to a `more' conforming location, it would create an unnecessary burden for the students and those storing sailing equipment and needing access to the adjacent dock. 4. Town Law $267-b(3)(b)(4). No evidence has-been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created; the clubhouse structure was built prior to 1957 and the adoption of the current Zoning Code. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit renovations to an existing clubhouse with reduced side and rear yard setback and the recognition of the placement of an`as built'shed in a side yard location,while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Planamento, seconded by Member Weisman(Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the site plan, floor plan, elevations and sections labeled SP-1, DR-1, DR-2, PL-1, S-1, prepared by Zackery E.Nicholson, last revised March 24,2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant shall provide the Zoning Board of Appeals with a copy of the Town of Southold Trustee's permit for the proposed action prior to the issuance of the building permit. Any deviation from the variance(s)grantedherein as shown on the architectural drawings,siteplan and/orsurvey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B)of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. Pre 1957, the clubhouse was moved to Old Harbor Road in New Suffolk. Old Cove has operated in its present location in the New Suffolk community for over 75 years with a focus on youth sailing. Since its inception, Old Cove has been dedicated to the promotion of recreational sailing, racing, cruising, sailing instruction, boating safety and youth sailing instruction. During the summer of 2022, approximately 120 students participated in Old Cove Junior Sailing Program providing access to the water and boating. In addition to the Junior Sailing Program, Old Cove also offers adult programs, including learning to sail and race. The site is zoned R-40 and the current use (recreational membership club) is consistent with zoned uses. The property supports an approximately 490 square foot (sf) one-story clubhouse building with an adjoining 424 sf deck (plus another 50 sf of back deck and steps) and 390 sf patio as shown in Photographs 1-3.The property also supports an approximately 144 sf"spar" shed used to house sails, masts, and other sailing equipment (Photograph 4), and a bulkhead and dock structure. A building permit application was submitted on April 12, 2022 and disapproved on December 21, 2022 because the proposed construction was non-conforming based on setbacks.The current and proposed setbacks are presented in Table 2. As the buildings are pre-existing and the use as a recreational sailing club requiring area for boat rigging,we respectfully request a waiver from the required setbacks.The proposed construction will not reduce the setbacks from existing conditions. While there are special status species in the project area, Project activities would be restricted to within the existing building footprint. There would be no impact to coastal resources or habitats as all work would occur in the uplands land-side of the bulkhead.There would be no grading or changes to slope. The existing slope of the property results in stormwater flowing away from the Peconic Bay and into an area of permeable grass and vegetation. Excavation would be limited to setting new deck and roof supports in the general area of existing supports. Construction debris would be collected daily and deposited in an onsite dumpster to prevent any material from entering the waterways or adjoining properties. The proposed Project is consistent with Southold Town's Local Waterfront Revitalization Plan as it repairs an existing structure with no expansion of use to support a program with historical community presence, that provide recreational access to the water and water-dependent uses. There would be no expansion of use and no direct or indirect impacts to fisheries or coastal habitats.
